Description of the measure
Article 1
The surcharges on imports of sugar classified in positions 17.01.11; 17.01.12; 17.01.91 and 17.01.99 of the Customs Tariff are fixed monthly, and applied by Customs.
The surcharges on the sugar defined above are equal to the differences between the reference prices and the applicable CIF prices
Article 2
The reference prices are as follows
Positions: 17.01.11 and 17.01.12 US $ 385 / Ton
Positions: 17.01.91 and 17.01.99 US $ 450 / Ton
When importing sugar from 17.01.91 and 17.01.99 positions are for the consumption of an industry which, for duly substantiated technical reasons, requires this type of product in quantities of more than 600 tonnes per year, they benefit from a special regime detailed in Annex I to this Regulation and shall be in force until 30 April 2002.
Article 3
For categories 17.01.11 and 17.01.12 the CIF price applicable for a particular month is the average calculated on the basis of the FOB price quoted in the first contract on the 11th of the month in question on the New York Stock Exchange and the price of the day provided for the 30 days prior to the 21st day of the previous month plus the appropriate freight and insurance costs based on international quotations.
