Administration of the E-Permit System at the Nimule Border by South Sudan
The Government of the Republic of South Sudan, through the relevant revenue authorities, introduced an E-Permit System for cross-border trade. While the introduction of the electronic permit system itself is not considered the primary concern, significant concerns have arisen regarding its administration and implementation at the Nimule border.
In particular, traders and transporters are reportedly subjected to additional re-verification and revaluation procedures even after completing the required electronic permit processes. These additional procedures have resulted in delays, prolonged clearance processes, increased bureaucracy and congestion at the border.
The additional administrative requirements have significantly increased the time and cost of conducting cross-border trade, with adverse effects on traders, manufacturers, exporters and transporters. They have also disrupted business operations, increased logistical and compliance costs, and, in some cases, affected exporters' ability to access and serve the South Sudanese market effectively.
The continued application of these additional procedures raises concerns regarding their consistency with the EAC principles of trade facilitation and the free movement of goods and persons among Partner States. The measures may constitute a Non-Tariff Barrier (NTB) where they result in unnecessary duplication of verification and valuation processes beyond those required under the applicable regional and national procedures.
The matter should be urgently raised with the relevant South Sudanese authorities through the appropriate bilateral and EAC NTB mechanisms to seek clarification on the basis for the additional re-verification and revaluation requirements.
