Description of the measure
Article 27
1. The export of rough diamonds requires the prior authorization of the Kimberley Process Management Unit, Precious Metals and Gems.
2. Applications for the export of rough diamonds shall be addressed to the Management Unit of the Kimberley Process, Precious Metals and Gems and shall be accompanied by the following elements:
A) Identification of the exporter and the importer;
(B) the origin and / or provenance of rough diamonds;
(C) weight of the carat consignment and its value;
D) Exporter's license, obtained from the Ministry that oversees the area of ​​Commerce;
E) Unique Tax Identification Number (NUIT):
F) Certificate of Tax Discharge, issued by the respective Fiscal Area Directorate;
(G) declaration by the exporter or his representative if he is a legal person on an honor pledge that rough diamonds do not originate from conflict zones;
 (H) elements of the lot's gross signature, including:
(i) macroscopic description and photographs of the diamond batch;
(ii) granularity frequency diagram;
(iii) quality frequency diagram.
3. In cases where the exporter is not the producer, proof that the batch of rough diamonds intended for export has been purchased from the holder of the mining concession, mining certificate, mining password or license to market rough diamonds, Is made by presenting the original or certified copy of the purchase and sale receipts in the model defined by the Kimberley Process Management Unit, Precious Metals and Gems that can document the chain of transactions.
4. Each batch intended for export shall contain only the rough diamonds identified with the same code, and the Kimberley Process Management Unit, Precious Metals and Gems may require that within the same code, lots shall be classified by size, In view of the greater homogeneity of the lots.
Article 37
1. The export of precious metals and gems requires the prior authorization of the Kimberley Process Management Unit, Precious Metals and Gems.
2. Applications for the export of precious metals and gemstones shall be addressed to the Management Unit of the Kimberley Process, Precious Metals and Gems, together with all the information necessary to identify the exporter and the importer, the origin and provenance of the metals Precious stones or gems, of the weight and value of the consignment, namely:
A) Identification of the exporter and the importer;
(B) origin and / or provenance of precious metals and gemstones;
(C) weight of the carat consignment and its value;
D) Exporter's license, obtained from the Ministry that oversees the area of ​​Commerce;
E) Unique Tax Identification Number
F) Certificate of Tax Discharge, issued by the respective Fiscal Area Directorate;
(G) declaration by the exporter or his representative if he is a legal person, on an honorable basis, that precious metals and gemstones do not originate in conflict zones
3. In cases where the exporter is not the producer, he shall demonstrate that the batch of precious metals and gems destined for export has been purchased from a mining concession holder, a mining certificate, a mining password for the production of precious metals or gems or Marketing license of precious metals or gems, by presenting the original or copy
Authenticated from the purchase and sale receipts of the model defined by the Kimberley Process Management Unit, Precious Metals and Gems capable of documenting the chain of transactions.
