  Description of the measure

  15. Testing of seed
  (1) Any person who, having produced or acquired any seed which has not been tested pursuant to this Part or under section 28, intends to sell the seed for the purposes of cultivation, shall cause a sample of the seed to be delivered to NPVSO for testing.
  27. Test of imported seed
  (1) Notwithstanding any other enactment and subject to subsection (3), on importation of any seed, a seed importer to whom the seed was consigned shall, within 30 days of its delivery to him, cause a sample of the seed to be delivered to NPVSO for testing.
  (2) Any imported seed shall not be sold or otherwise disposed of by any person before the receipt by the seed importer of a report on such test from NPVSO confirming that the seed conforms to such standards of germination, varietal and physical purity and seed health and such other requirements as NPVSO may determine.

  Description of the measure

  20 Sampling of excisable goods
  (1) The Director-General or any person authorised by the Permanent Secretary may, for the purposes of analysis or control, take a reasonable quantity of any excisable goods other than leaf tobacco, free of charge, as a sample from any person found in possession of the goods.
  (2) The Director-General may, subject to such conditions as he thinks fit to impose, authorise samples of excisable goods to be removed from a factory free of excise duty for display or for experimental purposes.
  (3) The Director-General may, on the recommendation of the Tobacco Board and subject to such conditions as he thinks fit to impose, authorise leaf tobacco in packages not exceeding 5 kilogrammes in weight to be removed from a tobacco warehouse for experimental purposes.

  "8. Taking of samples
  (1) The manner of taking samples of fertilizers shall be as follows—
  (a) where the fertilizer is packed in containers, samples shall be taken at random from different parts of the whole quantity, as follows: G.N. 123/1985
  (i) if the quantity of fertilizer does not exceed three tonnes, from not less than two unopened containers per 1.01 tonne or part thereof; and G.N. 123/1985
  (ii) if the quantity exceeds 3.03 tonnes, from one additional unopened container for every additional 1.01 tonne or part thereof: Provided that in no case need samples be taken from more than twenty containers;"

  "10. Sampling inspection and analysis
  (1) An inspector or any other officer charged with the collection of a remedy for the purposes of these Regulations shall collect a sample determined by an approved research institution.
  (2) A sample of a remedy shall be analysed following methods prescribed from time to time by the Malawi Bureau of Standards or any other institution recognized by the Minister.
  (3) A remedy shall be deemed to have complied with the provisions of these Regulations if, upon analysis, the composition is found to be in conformity with the declared percentages and quantities of ingredients referred to in regulation 7 (2) (f)."

  (1) Any sample of a pesticide taken under this Act shall be taken into three parts each of which shall immediately be sealed and suitably labelled or marked in the presence of the person in charge of or in possession of the pesticide, or their representative; one part shall be sent to an analyst together with a certificate in the prescribed form signed by the inspector or officer; the second part together with a copy of the certificate shall be delivered or posted in accordance with guidelines issued by the Board to the person in possession of the pesticide; the third part shall be retained by the Register.

  40. (1) Upon importation into Malawi of any prescribed seed, the seed importer to whom the prescribed seed is consigned shall within seven days of its delivery to him[/her], request a sample to be taken and sent for test to a seed testing laboratory.
  (2) No person shall sell or otherwise dispose of imported prescribed seed prior to the receipt, by the seed importer who imported such prescribed seed, of a report on the test of the sample thereof from the seed testing laboratory confirming that the imported prescribed seed conforms to the prescribed seed standards.
  (3) A person who contravenes of fails to comply with subsection (1) or (2) shall be guilty of an offence.

  Pharmaceutical products and medical devices
  pharmaceutical product: any substance capable of preventing, treating human or animal diseases and any other substance intended for administration to a human being or an animal in order to diagnose diseases, restore, correct or carry out modification of organic or mental functions. It also means products used in disinfecting premises in which food and drugs are manufactured, prepared or stored, cleaning hospitals, equipment and farm houses.
