- These standards and requirements shall relate to cherries in respect of which an approval for the export thereof is required in terms of section 4 of the Act.

- QUALITY AND FOOD SAFETY STANDARDS
Class
4. There are two classes of cherries, namely "Class 1” and "Class 2”.
Standards for the class
5. (1) A consignment of cherries shall be classified as Class 1 if it --
(a) is of superior quality;
(b) is well-developed and characteristics of the cultivar/variety and/or commercial type with regard to colour;
(c) is of a cultivar/variety specified in Table 1 of Annexure 1;
(d) complies with the quality and food safety standards set out in Table 2 of Annexure 1; and
(e) does not exceed the maximum permissible deviations by number set out in Table 3 of Annexure 1.
(2) A consignment of cherries shall be classified as Class 2 if it --
(a) is a cultivar/variety specified in Table 1 of Annexure 1;
(b) complies with the quality and food safety standards set out in Table 2 of Annexure 1; and
(c) does not exceed the maximum permissible deviations by number set out in Table 3 of Annexure 1.
(3) No consignment of cherries classified as "Class 1” and "Class 2" shall contain --
(a) plant injurious organisms of phytosanitary importance as specified by the Directorate Plant Health;
(b) any organisms which may be a source of danger to the human being; and
(c) Arthropoda infestation including the organisms which do not form part of plant injurious orga¬nisms, excluding organisms which may be a source of danger to the human being, on more than 3% of the cherries or three free running Arthropoda per pallet load or part thereof in the consignment: Provided that it does not exceed a maxi-mum of one Arthropoda per container.
Physical hazards
6. No consignment of cherries classified as "Class 1”and "Class 2" shall contain:
(a) any foreign matter in excess of the tolerance as set out in Table 2 of Annexure 1;
(b) any organisms which may be a source of danger to the human being in excess of the tolerance as set out in Table 2 of Annexure 1.
Biological and chemical hazards
7. No consignment of cherries classified as "Class 1" and "Class 2" shall contain biological or chemical contaminants in quantities or at levels that exceed the maximum limits prescribed in terms of the Foodstuffs, Cosmetics and Disinfectants Act, 1972 (Act No. 54 of 1972): Provided that --
(a) if the limit of the importing country is lower than is permissible in terms of Act 54 of 1972, the prescribed limit of the importing country shall be complied with; and
(b) the Executive Officer may warrant permission for cherries with a higher limit, to be exported to countries were such higher limit is permissible: Provided that the producer or exporter shall sign an affidavit in which it is declared that cherries with higher limits shall only be exported to a country where these higher limits are permissible;
Chemical treatment
8. (a) Any person intending to export cherries during any particular season shall, before submitting the first consignment during that season for inspection, on request furnish the Executive Officer within 24 hours with a certificate certifying --
(i) which chemical remedies have been used during the spray program on the cherry trees; and
(ii) which chemical remedies have been used on the cherries as a post-harvest treatment.
(b) Subject to the provisions of subitems (a), the follow-on consignments of only the producer concerned whose cherries exceeded the maximum chemical residue limits, shall be held back from export for not more than four working days in order to establish if the cherries complies with the prescribed residue limits: Provided that if the consignments of the producer concerned, again comply with the prescribed residue limits, it shall not be held back from export any longer.
CONTAINERS
General
9. Containers in which cherries are packed shall --
(a) be new, clean, dry, undamaged and suitable;
(b) shall not impart a foreign taste or odour of any substance which may be injurious to human health or to the cherries;
(c) be free from any visible signs of fungus growth;
(d) be free from Arthropoda infestation; and
(e) be strong and rigid enough to ensure that the original shape be retained and not bulge out, dent in, break or tear, to the extent that cherries are damaged or are at risk of being damaged, during normal storage, handling or transport.
TRACEABILITY REQUIREMENTS
10. Producers, packhouse managers and exporters shall:
(a) establish the traceability of cherries at all stages of production, packing, handling and distribution;
(b) be able to identify any person or supplier from whom they have been supplied with cherries, or any substance intended to, or expected to be used in the production or processing of cherries;
(c) have in place systems and procedures to identify other businesses to which their cherries have been supplied;
(d) ensure that adequate procedures are in place to withdraw cherries from the market where such cherries present a serious risk to the health of consumers;
(e) immediately withdraw cherries which were identified as food products that present a serious risk to the health of consumers;
(f) immediately inform the Executive Officer of such withdrawal;
(g) immediately make available to the Executive Officer, on request, any relevant information or documentation mentioned in (a), (b), (c), (d), (e) or (f); and
(h) keep records of the information mentioned in (g), as well as any other relevant information for at least two years.
PACKING REQUIREMENTS
General
11. (1) Only cherries of the same quality and cultivar shall be packed in the same container.
(2) Cherries in the same container shall be reasonably uniform in size.
(3) Each container shall be packed firmly and to capacity.
(4) If cherries are packed in prepacked units, such units shall be packed in a suitable manner in an outer container : Provided that the prepacked units are new, clean, dry, undamaged and suitable.
Packing material
12. If packing material is used inside the containers, such packing material shall be new, clean, dry, odourless and of a quality such as to avoid causing any external or internal damage to the cherries.
Stacking of containers on pallets
13. If containers containing cherries are palletised --
(a) the pallet shall be clean, undamaged and suitable;
(b) the pallet shall comply with ISPM 15 requirements, no visual sign of infestation and the stamp shall be marked on two opposite sides, be legible, permanent and registered;
(c) pallets manufactured from wood shall be without bark;
(d) the pallet shall be free from visible signs of fungus growth;
(e) the pallet shall be free from Arthropoda infestation;
(f) the containers shall be stacked firmly and square with each other and the pallet;
(g) only containers of the same dimensions shall be stacked on a pallet; and
(h) the containers shall not be stacked upside-down on a pallet.
Strapping of pallet loads
14. (1) A pallet load of containers shall be strapped in a suitable manner.
(2) If containers without lids are being used, a suitable covering shall be placed on top of the pallet load of containers before the pallet load is strapped.
MARKING REQUIREMENTS
General
15. (1) Each container containing cherries shall be marked clearly, indelibly, legibly and not untidy, upside-down or askew, in block letters and numerals on any short or long side of the lid or container, where lids are not used, by printing, stamping or by means of specially designed labels with the following particulars: Provided that all particulars shall be grouped on the same side:
(a) The expression "Cherries".
(b) The appropriate cultivar/variety.
(c) The expression "Class 1", "Cat 1", "Category 1", "Category I", "Class I", "Cat I", "Class 2", "Cat 2", "Category 2", "Category II", "Class II", "Cat II".
(d) The country of origin: Provided that no abbreviations or the expression "South Africa" on its own shall be used (e.g. "Products of South Africa", "Produced in South Africa", "Manufac¬tured in South Africa" or any other similar expression).
(e) The name and physical or postal address of the producer, exporter or owner of the contents of container.
(f) The producers' code (PUC) and the packhouse code (PHC) which is registered with the Executive Officer by the producer or packhouse, as the case may be: Provided that --
(i) if a producer has more than one farm, each farm shall be registered separately; and
(ii) such code shall be preceded by the expression "Producer", "FBO", "Packhouse", "PUC", "PHC", "Packer", "Farm number" or "Grower Code".
(g) The applicable minimum and maximum diameter.
(h) The applicable packing date on at least 90 per cent of the containers: Provided that if the packing date is expressed in a code, it shall be registered and approved with the Executive Officer.
(2) Subject to the provisions of subitem (1), each outer container containing prepacked units shall be marked with an indication of the total number of prepacked units per outer container: Provided that if the total number of prepacked units is visible from the outside, it does not have to be indicated on the outer container.
(3) If the country to which the cherries are exported, prescribes requirements with regard to the marking of containers which differ from the aforesaid requirements, the containers containing such cherries may, notwithstanding the provisions of these standards and requirements, be marked in a manner so prescribed and approved by the Executive Officer.
Prohibited particulars
16. No person shall use any name, word, expression, reference, particulars or indication in any manner, either by itself or in conjunction with any other verbal, written, printed, illustrated or visual material, in connection with the sale of a product in a manner that conveys or creates or is likely to convey or create a false or misleading impression as to the nature, substance, quality or other properties, or the class or grade, origin, identity or manner or place of production, of that product. - Reference of the measure

- PROHIBITIONS
2.(1) No person shall acquire, process, package or repackage asbestos; manufacture asbestos containing materials, or distribute asbestos or asbestos containing materials.
(2) No person shall import asbestos or asbestos containing material into the Republic, or export asbestos or asbestos containing materials from the Republic.
(3 No person shall import asbestos containing waste into the Republic.
(4) The provisions of sub-regulation (2) and (3) shall not apply to a person -
(a) importing asbestos or asbestos containing material which is in transit from a State outside the Republic to another State outside of the Republic, unless further repackaging or processing of the asbestos or asbestos containing material is performed in the Republic; or
(b) importing asbestos which is solely for use in analysis or research and which is not intended to develop a new use for asbestos or asbestos containing material; or
(c) importing asbestos or asbestos waste from a State, which is a member of the Southern African Development Community, for safe disposal at a disposal site for which a permiit has been issued in terms of section 20 of the Environment Conservation Act, 1989;
provided that persons conducting the activities in paragraphs (a), (b) and (c) register the activity with the Minister as contemplated in regulation 4 of these regulations.
(5) The provisions of sub-regulation (1) and (2) shall not apply to a person who, on the date of the commencement of these regulations, is lawfully importing an identified product or asbestos for use in the manufacture of an identified product, nor to any person manufacturing or distributing an identified product for local use, provided that the person conducting the activity registers the ACTi, •it’s with the Minister as contemplated in regulation 4 and acts in accordance with an approved Asbestos Phase-out Plan as referred to in regulation 5 of these regulations. - Reference of the measure

- This Compulsory Specification applies to the handling, preparation, processing, packing, transportation, freezing, storage and quality of frozen shrimps (prawns), langoustines and crabs, and products derived therefrom, for human consumption, which are to be offered for sale.
- Description of the measure
- 3.12 The testing of frozen shrimps (prawns), langoustines and crabs, and products derived therefrom against the requirements of this Compulsory Specification shall be done by test facilities that are accredited to use the referenced test methods. In the case where there are no test facilities available that are in compliance with the foregoing, the NRCS shall determine which facilities can be used in terms of its conformity assessment policy.
5 Markings
Frozen shrimps (prawns), langoustines and crabs, and products derived therefrom shall be marked in accordance with the requirements of the latest edition of SANS 788. In terms of South African produced products the official factory / establishment number issued by the NRCS in accordance with section A 1.5 of this Compulsory Specification shall be included.
A.2.2 For locally produced products, where applicants require approval for export or any other purposes, applicants shall supply details of the frozen shrimps (prawns), langoustines and crabs, and products derived therefrom per consignment for which approval is sought by providing information with regards to the type of approval required (e.g. certificate of compliance, health guarantee to a particular country or other specific certification for official purposes). This application shall as a minimum be made 10 working days prior to the date on which it is needed.
B.1.2 Health guarantees shall only be issued for approved factories / establishments
appearing on the official lists drawn up by the specific countries or trade blocks
requiring such guarantees.
B.1.3 As required, finally prepared and packed frozen shrimps (prawns), langoustines
and crabs, and products derived therefrom shall be monitored on the basis of random
testing and surveillance programmes.
B.1.4 For the issuing of health guarantees, it is required that for every consignment:
a) The product originates from factories / establishments approved by the NRCS
in terms of the requirements of this Compulsory Specification;
b) All products and product codes are reflected in the request for export; and
c) The product covered by such a guarantee is fully traceable to its origin. - Reference of the measure

- 1.1 This Compulsory Specification applies to the harvesting, preparation, packing, conveyance and quality of live aquacultured abalone.
1.2 Wild harvested live abalone is excluded from the scope of this Compulsory Specification - Description of the measure
- 3.8 The testing of live aquacultured abalone against the requirements of this Compulsory Specification shall be done by test facilities that are accredited to use the test methods as referenced in the SAMSM&CP. In the case where there are no test facilities available that are in compliance with the foregoing, the NRCS will determine
which facilities can be used in terms of its conformity assessment policy. This includes testing undertaken by farms and/or packers to demonstrate conformance with this Compulsory Specification 4.2 Live aquacultured abalone for packing shall be obtained from sources that are officially approved by DAFF.
4.5 All official sampling of live aquacultured abalone and water shall take place according to the requirements of the SAMSM&CP.
4.8 The live aquacultured abalone harvested, packed or shipped for the purpose of placing on the market for human consumption, shall not contain any chemicals, microbiological contaminants, and marine biotoxins at levels that could be detrimental to the health ofthe consumer as per requirements of the SAMSM&CP.
4.9 The live aquacultured abalone product shall be traceable according to the requirements of the movement document referred to in the SAMSM&CP

- 1.1 This Compulsory Specification applies to the handling, preparation, processing, packing, transportation, freezing, storage and quality of frozen fish, marine molluscs, and products derived therefrom, for human consumption, which are to be offered for sale.

- The aim and objectives of this statutory measure are to compel any person directly and indirectly involved in imports and/or exports (e.g. end-consumers, importers, starers, exporters, processors, including any person, e.g. a producer, trader, transporter, agent,etc. who acts in the capacity of the aforementioned persons) of maize and/or wheat to keep records and submit returns to SAGIS. • Obtain complete and reliable information; and
• Assist the more efficient and effective planning, risk management and marketing of maize and/or wheat for food security.
SAGIS was specifically established for the purpose of handling information, gathering, processing and dissemination on behalf of the various cereal and oil seed industries in South Africa. This statutory measure will be administered by SAGIS but as a task separate to its main task of monthly national marketing information. SAGIS publishes macro maize and wheat import and export information on a regular basis for the grain industry and other interested parties. This information is obtained and furnished from the returns submitted to SAGIS. The information gathered by SAGIS by means of records and returns is available free of cost on SAGIS's website. - Records to be kept by end-consumers, importers, starers, exporters and processors of maize and/or wheat
5. (1) Each end-consumer, importer, storer, exporter and processor of maize and/or wheat shall keep complete records for each week (Saturday to Friday) in respect of maize and/or wheat imported or exported by him. These shall also include any person, e.g. a producer, trader, transporter, agent, etc. who acts in the capacity or on behalf of the aforementioned persons.
(2) Each person mentioned in sub clause (1), irrespective of whether or not he has premises, shall keep the following records:
(a) Imports- in respect of imported maize and/or wheat, records shall be kept of:
(i) Name and address of importer and/or person on whose behalf imports are made.
(ii) Quantity of maize and/or wheat imported per country of origin.
(iii) Quantity of imported maize and/or wheat destined for: (aa) consumption in South Africa.
(bb) exports per country of destination in Africa.
(cc) exports per country of destination overseas.
(iv) Name of border post through which maize and/or wheat was imported.
(v) Name and address of the first premises where maize and/or wheat, imported through a border post, was handled.
(vi) Name of harbor and owner of harbor premises where the imported maize and/or wheat was handled.
(vii) Name and particulars of the vessel in which maize and/or wheat was imported.
(b) Exports- in respect of maize and/or wheat that is exported, records shall be kept in respect of:
(i) Name and address of the exporter and/or the person on behalf of whom the export took place.
(ii) Quantity of maize and/or wheat exported per country of origin namely:
(aa) Produced in South Africa.
(bb) Imports per country of origin in Africa.
(cc) Imports per country of origin overseas.
(iii) Quantity of maize and/or wheat exported per land of intended destination.
(iv) Name and address of the last premises from where maize and/or wheat was dispatched to a border post.
(v) Name of border post through which maize and/or wheat was exported.
(vi) Name of harbor and owner of harbor premises where the exported maize and/or wheat was handled.
(vii) Name and particulars of the vessel in which maize and/or wheat was exported.
(3) Records mentioned in sub clauses (1) to (2) shall be -
(a) kept separately in respect of maize and/or wheat;
(b) recorded on a computer or in ink in a book; and
(c) kept at the head office or usual place of business of the person who is required to keep it for a period of at least four years after the end of the period in respect of which such records were kept.
Returns to be submitted by end-consumers, importers, starers, exporters and processors of maize and wheat
6.(1) Every end-consumer, importer, storer, exporter and processor of maize and/or wheat shall, before noon, on a Monday of every week, or in the case of public holidays on a Monday, the first working day of the week, submit to
SAGIS an accurate return in respect of his maize and/or wheat imports and/or exports. These shall also include any person, e.g. a producer, agent, trader, transporter etc. who acts in the capacity of the aforementioned persons.
(2) The returns, as available at SAGIS’ offices, shall be submitted for the physical exports and imports that realized during the period stated in clause 5(1).
(3) The return shall be transmitted electronically to:
The fax number or e-mail address as furnished on the official return forms or as specifically requested by SAGIS.
(4) The return shall be transmitted electronically to reach the general manager of SAGIS before or on the deadline date mentioned in sub clause (1).

- 4.1.2 Requirements for importing countries
In order to meet the requirements of an importing country, products for export may be packed to requirements that deviate from those laid down in this specification, subject to the following conditions:
a) prior written application for the packaging of the product in accordance with the proposed deviation shall be made to the authority administering this specification, full details of the intended deviation being furnished;
b) the deviation shall not, in the opinion of the authority administering the specification, after consultation with organizations representing the industry, result in the packing and exporting of a product of doubtful quality or of such nature as to affect deleteriously the Republic of South Africa's export image in the market concerned; and
c) the products hall be accurately described on its container or label and the labelling or marking shall not be misleading to the consumer.
6.4 Marking on outer containers and packages for export
Outer containers and packages for export shall be marked in accordance with the requirements of the importing country and may be marked differently from the requirements of 6.1 and 6.3, provided that there is no attempt to misrepresent the contents. Details as required by 6.1(c) shall be printed on each outer container and package.
7.2.2 Delivery for export
The frozen product for export shall be conveyed from the factory to the freezer storage depot and
delivered into the transporting vessel's freezer storage facilities at a temperature of-1 8 ̊Cor lower.
If, at any time during this transportation, the temperature of the product rises above-18 ̊C,it shall be
lowered to the required temperature as rapidly as possible. The product shall be reinspected if the

- 3. (1) Subject to the provisions of these Regulations and unless a person complies with regulation 5
and 6 of these Regulations, no person may -
(a) use, process, or produce PCB materials or PCB contaminated materials;
(b) import PCB materials or PCB contaminated materials into the Republic of South Africa, or export PCB materials or PCB contaminated materials from South Africa; or
(c) sell PCB materials or PCB contaminated materials in South Africa.
(2) The provisions of sub-regulation (1) do not apply to persons who import PCB waste from a State which is a member of South African Development Community, for the purpose of treatment or safe disposal at a facility authorised in terms of section 20 of Environmental Conservation Act, 1989 (Act No. 73 of 1989) or section 49 of National Environmental Management: Waste Act, 2008 (Act No. 59 of 2008).
PCB phase-out plans and inventories
6. (1) A PCB Holder who is registered in accordance with regulation 5 of these Regulations; must develop a phase-out plan and submit it to the Director-General within one year of the coming into effect of these Regulations.
(2) The phase-out plan contemplated in sub regulation (1) must, as a minimum include-
(a) name and contact details of the person submitting the pan;
(b) registration number issued by the Director-General in terms of regulation 5(3) of these Regulations;
(c) a comprehensive inventory of non PCB materials, PCB materials and PCB contaminated materials in use or stored; specifying-
(i) the type of equipment;
(ii) serial number;
(iii) specific location;
(iv) name of the manufacturer;
(v) date of manufacture;
(vi) type of dielectric fluid contained;
(vii) KVA rating;
(viii) fluid weight in (kg) or fluid volume in (L); and
(ix) PCB concentration in (mg/kg).
(d) the time period within which the person plans to have completely phased-out all PCB materials or PCB contaminated materials which must not exceed the time frames set in regulation 4 of these Regulations; and
(e) the strategy outlining the annual reduction targets.
(3) The Director-General must acknowledge receipt of the phase-out plan within 14 days of receipt, and may, after consideration of the plan, in writing-
(a) approve the phase out plan for implementation and notify the applicant of the approval and outline any applicable conditions or requirements; or
(b) require incomplete information to be furnished or amendments to be effected and a revised phase out plan to be resubmitted within a specified time frame; or
(4) A person whose phase-out plan has been approved by the Director-General must implement such a plan and may only deviate from such a plan upon written approval to do so by the Director-General. - Reference of the measure
