Description of the measure: 4 (1) Subject to these regulations, any food imported into or exported from Zimbabwe shall be subject to inspection, analysis and, where necessary, to detention, disposal or destruction in terms of the Act at any port of entry into or out of Zimbabwe unless the importer or exporter holds a Food Sanitary Certificate issued in respect of the food concerned. A Food Sanitary Certificate is issued in accordance with procedure outlined in the Food and Food Standards (Inspection and Certification) Regulations, 2015.
(2) A Pre-shipment inspection shall ensure that any food intended for importation or exportation is in compliance with the Act or any relevant regulations made in terms of the Act or any other enactment.
(3) Where any food is not specifically covered by the Act, or any regulations, provisions of the CODEX relevant to the food concerned may apply.
(4) Where an importer or exporter fails to produce a Food Sanitary Certificate, the food shall be subject to inspection and analysis in terms of the Act and for that purpose, shall be detained at the port of entry, a designated warehouse or as may otherwise be directed by the competent authority at the said port pending the inspection and analysis.

(6) The cost of inspection, analysis and detention of any food shall be borne by the importer or exporter as the case may be.
(7) Detained food shall not be disposed of in any way or removed from detention except on the written authority of an inspector or an order of a competent court in Zimbabwe.

5. Where an exporter has the prior approval of the competent authority of the importing country for the export of any specified food without a Food Sanitary Certificate, the requirements of section 4 may be waived

6. A Food Sanitary Certificate shall not exempt an exporter or importer from complying with any other preshipment veterinary, biotechnological, plant quarantine, phytosanitary and GMO requirement under the law.

7. (1) Where Zimbabwe has an equivalence agreement with any country, a certificate equivalent to a Food Sanitary Certificate issued by a competent authority of any such county may be accepted at a port of entry and a pre-shipment inspection may, unless specifically demanded by a competent authority on goods cause shown, not be required.
(2) A competent authority in Zimbabwe may seek verification of any certificate equivalent to a Food Sanitary Certificate issued by a competent authority to a Food Sanitary Certificate issued by a competent authority of any country.

Description of the measure: 72A. (1) Any person who wishes to
(a) import a psychotropic substance shall submit an application to the Director-General in Form M.C. 10A;
(b) export a psychotropic substance shall submit an application to the Director-General in Form M.C. 10B.
(2) Any person who imports or exports a psychotropic substance shall, for every import and export, as the case may be, whether such import or export consists of one or more substances, obtain a separate licence from the Authority for such importation or exportation.
(3) An import or export licence granted by the Authority shall state—
(a) the name and address of the importer or exporter, as the case may be;
(b) the international non-proprietary name of the psychotropic substance or if there is no such name, the appropriate name set out in Part I of the Eighth A Schedule;
(c) the quantity to be exported or imported;
(d) the pharmaceutical form;
(e) the period within which the import or export shall be effected;
(f) where the substance is imported or exported in the form of a preparation, the name of the preparation;
(4) An export licence shall state—
(a) the number and date of the import authorization; and
(b) the authority by whom it is issued.
(5) No export licence shall be granted in respect of a psychotropic substance by the Authority unless the exporter produces to the satisfaction of the Authority proof of an import authorization issued by a competent authority of the importing country confirming the approval of the proposed importation.
(6) A copy of the export licence shall accompany each consignment of a psychotropic substance, which is to be exported.
(7) Where any psychotropic substance is imported into Zimbabwe, the Director—General shall return authorization of the government of the exporting country and shall endorse on such authorization the amount of such substance, which has been actually imported.
(8) No psychotropic substance, which is in transit through Zimbabwe being exported from a destination outside Zimbabwe to another destination, shall be permitted to pass through Zimbabwe unless a copy of the export authorization is presented to and approved by the Director-General.
(9) Every consignment of a psychotropic substance whether imported or exported shall be accompanied by an export licence or similar authorization.
(10) Any consignment referred to in subsection (9) which is not accompanied by an export licence or similar authorization shall be detained by a customs officer until such licence or authorization is presented to and approved by the Director-General.
(11) No person shall mislabel any psychotropic substance intended for export.
(12) No psychotropic substance shall be imported or exported by ordinary or registered letter post.
(13) A licence granted by the Authority in term of subsection (1) shall –
(a) in the case of an import licence, be in Form M.C. 27;
(b) in the case of an export licence, be in Form M.C. 28.

Description of the measure: 72F. (1) Any person who is authorized or licensed to manufacture or supply a psychotropic substance set out in Parts I and II of the Eighth A Schedule or who imports or exports such substance shall keep a register and shall enter therein, in chronological sequence, true particulars with respect to such substance—
(a) every quantity of such substance manufactured by him;
(b) every quantity of such substance acquired by him;
(c) every quantity of such substance supplied y him;
(d) every quantity of such substance used by him;
(e) in respect of each acquisition and disposal of such substance details of the quantity, the date, the supplier and the person to whom the substance is supplied;
and the provisions of section 42 of the Dangerous Drugs Regulations, 1975, shall apply, mutatis mutandis.
(2) Subsection (1) shall apply to any hospital, clinic, dispensary, wholesaler or similar institution administered by the State.
(3) Every manufacturer, importer and exporter of a substance set out in Parts II and III of the Eighth A Schedule shall keep a record showing the quantities of such substance manufactured, imported or exported, as the case may be.
(4) The records required to be kept in terms of subsections (1) and (3) shall be kept for a period of five years.

Description of the measure: 100B. (1) No person shall export a substance listed in Table I of the Sixteenth Schedule without obtaining an export licence granted by the Authority.
(2) Any person who wishes to export a substance listed in Table I of the Sixteenth Schedule shall submit an application to the Director-General in Form M.C. 11A and such application shall be accompanied by the appropriate fee.
(3) An Export Licence referred to in subsection (1) shall state—
(a) the names and addresses of the exporter and importer;
(b) the name and address of the consignee, if any;
(c) the name of the substance in Table I of the Sixteenth Schedule;
(d) the quantity to be exported;
(e) the expected point of entry in the importing country;
(f) the expected date of dispatch;
(g) any other details as may be required by the importing country.
(4) Where the Authority grants the issue of an export licence the Director-General shall send a copy of such licence to the competent authority of the importing country prior to the intended exportation.
(5) An Export Licence granted in terms of this section shall be in Form M.C. 30.

101C. Any person who imports or exports a substance set out in Table I of the Sixteenth Schedule shall, before the 31st March in each year, submit a return to the Authority stating the amounts so imported or exported from January to December in the previous year.

6. Application for payment
An application for a compensatory payment made by a person claiming to be entitled thereto shall be made to the Commissioner, through the Treasury, a person appointed by the Treasury or an appointed dealer as the case may be, in the prescribed form.

7. Action to be taken on application
(1) Where an application for compensatory payment is received by the Treasury or a person appointed by the Treasury or an appointed dealer, any of them shall, if satisfied that exportation of the eligible goods concerned is completed as required by section 5, notify the Commissioner the appropriate amount of compensatory payment due to the exporter in respect of the exports and when so authorized by the Commissioner, shall pay to the applicant on behalf of the Commissioner the appropriate amount of compensatory payment.
(2) In respect of an application for a compensatory payment, the Commissioner—
(a) if he is satisfied that the applicant is not entitled thereto, or that there has been a breach of this Act or regulations made thereunder in relation to the eligible goods concerned, or to the exportation thereof, may disallow the application in whole or in part; or
(b) in any other case, shall allow the application.
(3) Where an application is disallowed under paragraph (a) of subsection (2), any payment made under subsection (1) in relation to that application shall be repayable to the Commissioner by the person by whom it was received to the extent required by the disallowance.
FIRST SCHEDULE
(1) The rate of compensatory payment shall be, in respect of goods exported—
(a) before the 18th June, 1982, twenty per cent;
(b) on or after 18th June, 1982, but before 15th June, 1984, ten per cent;
(c) on or after 15th June, 1984, but before 14th June, 1985, fifteen per cent;
(d) on or after 14th June, 1985, twenty per cent, of the value of the goods.
(2) For the purposes of paragraph 1 the value of goods exported shall be the f.o.b value of those goods declared for export or the payment in respect thereof received in foreign currency by an authorized dealer, whichever is less.

22. Powers of export processing zone developers and operators
(1) An export processing zone developer shall have power to—
(a) act or appoint an export processing zone operator to undertake management and administration of the export processing zone on its behalf subject to section 19(1);
(b) lease, sub-lease or sell land or buildings to licensed export processing zone enterprises, and charge rent or fees for other services that may be provided, in convertible foreign currency.
(2) The export processing zone developer shall—
(a) make improvements to the export processing zone site and its facilities according to the plans approved by the Authority;
(b)provide or facilitate provision of infrastructure and other services according to the design and engineering studies submitted to the Authority together with the application;
(c)provide adequate enclosures to segregate the zone area from the customs territory for the protection of revenue together with suitable provisions for the movement of persons, conveyances, vessels and goods entering or leaving the zone;
(d) provide adequate security on the site office accommodation and facilities for customs as determined by the Authority;
(e) adopt rules and regulations for businesses within the zone, which shall promote its safe and efficient operations;
(f) maintain adequate and proper accounts and other records in relation to its business and report on zone activities, performance and development to the Authority on an annual basis or as required by the Authority, the Commissioner of Customs and Excise, the Central Bank, the Central Bureau of Statistics or other relevant authorities; and
(g) register any lease agreements and service.
(3) The accounts and records required under paragraph (f) of subsection (2)
shall be maintained in English.
(4) An export processing zone operator shall have the powers stated in paragraph (b) of subsection (1).
(5) An export processing zone operator shall comply with all the provisions of this section including paragraphs (d), (e), (f) and (g) of subsection (2).
(6) Any export processing zone developer or export processing zone operator who fails to maintain adequate and proper accounts and other records as required by this section shall be guilty of an offence and liable to a fine not exceeding three hundred thousand shillings.
