- 7. Essential requirements of fumigators or commercial applicators.
The operator of the business in premises in which the business of manufacturing, formulating, packaging, storing, usage or distribution of agricultural chemicals is undertaken shall, to the satisfaction of the board,have adequate technical knowledge of the chemistry, toxicology, efficacy,safety and general use of the chemical being handled.
28. Advertising statements to be substantiated, etc.
(1) Every statement used in advertising any agricultural chemical shall be technically substantiated by the person carrying out the advertisement.
(2) No advertisement in relation to an agricultural chemical shall contain any statement or visual presentation which directly or by implication, omission, ambiguity or exaggerated claim could mislead the buyer in particular with regard to the safety of the agricultural chemical, its nature or composition, suitability for use or official recognition or approval.
(3) Agricultural chemicals whose use is restricted to trained or registered fumigators or commercial applicators only shall not be publicly advertised except through journals for fumigators or commercial applicators - Reference of the measure
