Description of the measure
3.(1) The issuing authority may issue a permit authorising, subject to the provisions of this Order and of any other written law- (a) the import into the Republic of Zambia of any goods listed in the Second Schedule; on such terms and conditions as may be specified in, or attached to, the permit.
3. (2) A permit issued under this paragraph shall-(a) if it relates to the import of goods into the Republic of Zambia, be in Form No. 1
4. (1) Subject to the provisions of sub-paragraph (2), no person shall import into the Republic of Zambia any goods listed in the Second Schedule except in accordance with the terms and conditions of a permit issued under paragraph 3.
4. (2) The provisions of sub-paragraph (1) shall not apply in relation to-
(a) any goods which are in the course of transit through the Republic of Zambia to a place beyond the borders thereof;
(b) any goods not exceeding twenty thousand kwacha in value which are imported in any one week into the Republic of Zambia by an individual residing in the Republic of Zambia for his personal domestic consumption and not for sale or disposal to any other person;
(c) any goods not exceeding twenty thousand kwacha in value which are imported in any one week into the Republic of Zambia as a bona fide gift from a person residing outside the Republic of Zambia to a person residing in the Republic of Zambia.
4. (3) Any person importing maize meal, including hominy chop, maize cones, maize grits, maize offals, processed maize with or without additives and maleie hydrazide, also known as M.H., shall require an import permit in relation to goods-
(a) which are in the course of transit through the Republic of Zambia to a place beyond the borders; or
(b) which are exported under an export permit issued under the principal Order if the exporter satisfies the Ministry responsible for agriculture, food and fisheries, that such exporter has, on the basis and by reason of his having been earlier issued with such export permit, incurred a contractual and legally enforceable obligation prior to the publication of this Order.

33. Subject to the other provisions of this Act, the Board may issue the following licences—
(b) a cotton seed seller’s licence which shall authorise the holder to purchase, sell, export, import or otherwise market cotton seed on such premises as may be specified in the licence
35. A licence issued under this Part shall be subject to the following conditions—
(d) that where the licence is for the importation or exportation of cotton the licence shall be subject to an import or export permit issued under the Control of Goods Act;

10(1) A person shall not research on. develop, produce, import, export, transit, carry out any contained use, release or place on the market any genetically modified organism or any product of a genetically modified organism or deal in any manner with any genetically modified organism or a product of a genetically modified organism without the prior approval of the Authority.
13(1) Any person who intends to conduct research on. develop, apply, import, transit, release, place on the market or carry out any contained use of any genetically modified organism or product of any genetically modified organism shall submit an application in writing to the Authority for authorisation.

Description of the measure
40. (1) Any person who, without a permit from the Minister as provided by section forty-one, imports any restricted seed into Zambia in contravention of any regulation made by the Minister under section thirty-nine, shall be guilty of an offence.
41. (1) Notwithstanding the provisions of any regulation made under section thirty-nine, the Minister may, at any time and as often as he deems it expedient, permit the importation into Zambia of any specific restricted seed, or of any specific variety or class of restricted seed.
42. (1) No person may import into Zambia for purposes of sale any prescribed seed for sowing, unless he is a registered seed importer.
43. (1) No registered seed importer shall import any prescribed seed into Zambia unless-
(a) such seed is not restricted seed, the importation of which has been prohibited by regulation made under section thirty-nine;
(b) such seed is not restricted seed, the importation of which has been made subject to conditions or limitations prescribed by regulation made under section thirty-nine and such prescribed conditions or limitations have not been fulfilled or performed;
(c) such seed being restricted seed, the importation of which has been prohibited by regulation made under section thirty-nine, a permit for its importation has issued under the provisions of section forty-one;
(d) such seed being restricted seed, the importation of which has been made subject to conditions or limitations prescribed by regulation made under section thirty-nine and such prescribed conditions or limitations have not been fulfilled or performed, a permit for its importation has issued under the provisions of section forty-one.

Description of the measure
4. (1) Save as is provided in regulation 8, no person shall import any growing medium or plant, including any unmanufactured plant product specified in the Fourth Schedule or seed specified in the Fifth Schedule, unless a permit authorising the importation of that growing medium or plant is submitted.
5. (1) Subject to the provisions of sub-regulation (2), no person shall import an invertebrate, the importation of which is not governed by the provisions of another law, unless a permit authorising the importation of that invertebrate is submitted.
5. 2) No person shall import an injurious organism unless-
(b) a permit authorising the importation of that injurious organism is submitted.
6. Application for a permit to import a growing medium, injurious organism, invertebrate or plant shall be made to the Permanent Secretary and, if the Permanent Secretary so requires, shall be made in Form No. 1.
7. (1) A permit authorising the importation of a growing medium, injurious organism, invertebrate or plant shall be issued by the Permanent Secretary in Form No. 2.
14. (1) No person shall import-
(c) any plant specified in the Sixth Schedule; without the consent in writing of the Minister.

Description of the measure: 59 (1) A person shall not import, manufacture or sell any animal feed without a permit from the Director.
(2) A person shall not import, manufacture or sell any animal feed unless the animal feed conforms to the standards and specifications prescribed under this Act.
(3) A person who contravenes subsections (1) and (2) commits an offence and is liable, upon conviction, to a fine not exceeding five hundred thousand penalty units or to imprisonment for a period not exceeding five years, or to both
60 (1) A person shall not import without a permit from the Director—
(a) any animal feed which contains bone or any other substance derived from an animal carcass; or
(b) bones or any other substance derived from an animal carcass for the purpose of manufacturing any animal feed.
29 (1) A person shall not import an animal, animal product or article without an import permit issued by the Director.
(2) The Minister may, by statutory instrument, provide for the prohibition, restriction and regulation of the importation of any animal, animal product, animal by-product or article.
(3) Without derogating from the generality of subsection (1), the Minister may, by regulation:
(a) provide for the disinfection or treatment of any imported animal, animal product, animal by-product or article or their containers;
(b) designate ports of entry, routes and methods of transportation;
(c) provide for the detention of any animal, animal product,animal by-product or article which is imported and the
measures to be taken during the detention;

(2). The provisions of subsection (1) shall not apply to the import or export of –
(a) any wild life or trophy which was acquitted by the importer or exporter before the convention applied to it, if the importer or the exporter hold the certificate to that effect –
(i) in the case of import granted by an appropriate authority in the country from which the wild life or trophy concerned is being imported ; or
(i) in the case of an export, issued by the Director ; or
(b) any wildlife which was bred in captivity, ranched artificially propagated as the case may be, or any trophy of such wild life , if the importer or the exporter holds the certificate to that effect –
(i) in the case of an import , granted by an appropriate authority in the country in which the wild life concerned was bred or propagated :or
(ii)in the case of an export, issued by the Director,
Or
(c)herbarium specimens, other preserved, dried or embedded museum specimens , or plants material ,
Where-
(i)their import or export is effected by-
A. a museum which is a national museum for the purposes of the National Museum and Monuments Act [Chapter 313];
B. any other museum approved by the Director ; and
C. any scientist approved by the Director ; and
(ii) the specimens and material carry a label issued or approved by the Director

(3) No permit or certificate shall be required in terms of sub section (1) for the import or export of any wild life or trophy
(a) which a personal or household effect, save in the following cases-
(a) where a person who is ordinarily resident in Zimbabwe imports into Zimbabwe any wild life referred to in Part I of the Second Schedule , or any trophy of such wild life , which he acquired outside Zimbabwe ; or
(b) where a person who is ordinarily resident in Zimbabwe imports into Zimbabwe wild life referred to in Part II of the Second Schedule , or any trophy of such wild life, which he acquires outside Zimbabwe in the country where the wild life was removed from the wild , if that country requires the prior grant of an export permit before any export of such wild life or trophy ; or
c) where a person who is not ordinarily resident in Zimbabwe exports from Zimbabwe any wild life referred to in Part I of the Second Schedule or any trophy of such wild life which he acquires within Zimbabwe ; or
(d) where a person who is not ordinarily resident in Zimbabwe exports from Zimbabwe any wildlife referred to in Part II of the schedule which was removed from the wild within Zimbabwe, or any trophy of such of such wild life , if he acquired such wild life or trophy within Zimbabwe.

5(1) Subject to the provisions, of this , the Director may issue to any person-
(a) a permit authorizing , subject to the provisions of any other law, the import into Zimbabwe of any controlled goods , wild life or trophy ;

(3) No permit shall be issued in terms of subsection (1) or (2) for the import into Zimbabwe of any wild life referred to in Part I and V of the Second Schedule or any trophy of such wild life, unless-
(a) the Director or Controller as the case maybe, is satisfied that an export permit or a re-export certificate or trophy concerned by an appropriate authority in the country from which the wild life or trophy concerned is being imported ; and
(b) the Director is satisfied , or , in the case of a permit issued by the Controller , the Director has certified to the Controller, that-
(i) the import will be for purposes which are not detrimental to the survival of the species of wild life concerned ; and
(ii) the wild life or trophy will not be used for primarily commercial purposes and
c) in the case of an import of a live specimen of such wild life, the Director is satisfied that the proposed recipient is suitably equipped to house and care for it.

Description of the measure: 11 (1) Any person who wishes the Committee to approve any advertisement, informational or educational material on baby and young child nutrition may apply in writing for such approval to the Committee at the offices of the Nutrition Unit of the Ministry of Health and Child Welfare and shall submit with his application the material concerned or, where appropriate, a sample or copy in the form in which it shall be presented to the end user/customer.
(2) Within thirty days after receiving an application in terms of subsection (1), the Committee shall examine the material concerned and may- '
(a) approve it, either absolutely or subject to conditions; or (b) refuse to approve it; and shall notify the applicant in writing of its decision and, where it has refused to approve the material, of its reasons,
(3) The Committee shall not approve any advertisement, informational or educational material on baby and young child nutrition in terms of subsection (2) unless it is satisfied-
(a) that it includes clear and accurate information on the following matters
(i) the importance, benefits and superiority of breast-feeding; and
(ii) maternal nutrition; and
(iii) the preparation for and maintenance of breast-feeding; and
(iv) the adverse effects on breast-feeding of introducing bottle-feeding; and
(v) the difficulty of reversing the decision not to breast-feed even for a short period; and
(vi) the proper use of designated products; and
(vii) the adverse effects of the use of pacifiers on breast-feeding; and
(b) that it does not use any pictures of infants; and
(c) that it does not use any other pictures or text which may idealize the use of a designated product and discourage breast-feeding; and
(d) if the material referred to in subsection (1) deals with the use of infant formula or any other food or drink which requires a feeding bottle, that it· includes clear and accurate information on-
(i) the instructions for the proper preparation and use of the product including the cleaning and sterilisation of feeding utensils; and
(ii) the approximate total current financial cost of feeding a baby on the designated product for a period of at least six months; and
(iii) the health and other hazards of bottle-feeding; and (iv) the health and other hazards of improper preparation of the product; and
(v) how to feed infants from a cup; and
(e) if the material referred to in subsection (1) includes the topic of feeding babies and young children with complementary foods, that it includes clear and accurate information on-
(i) the instructions for the proper preparation and use of the product including the cleaning and sterilisation of feeding utensils; and
(ii) the approximate total current financial cost of feeding an infant on the designated product for a period of at least six months; and
(iii) the health and other hazards of bottle-feeding; and (iv) the health and other hazards of improper preparation of the product;
(v) how to feed infants from a cup; and
(vi) the health and other hazards of introducing complementary foods too early or too late; and
(vii) the fact that complementary foods can easily be prepared at home using foods normally consumed by the family; and
(f) where the material is intended to be published for use by health workers, that it is restricted to scientific and factual information; and
(g) the material referred to in subsection (1) shall not make any reference to a proprietary product in such materials.
(4) Where the Committee has refused to approve any advertisement informational or educational material on infant nutrition in terms of subsection (2), the applicant may at any time resubmit the material to the Committee, having made such alterations to the material as he considers necessary to secure the Committee's approval.

(a) any goods which are in transit through Zimbabwe to a place beyond the borders thereof;
(b) any goods which are imported into Zimbabwe—
(i) by a person or family residing in Zimbabwe for their personal domestic consumption and not for sale or disposal to any other persons; or
(ii) as a bona fide gift from a person residing outside Zimbabwe to a person or family residing in Zimbabwe;
if the value of such goods does not exceed the equivalent of two hundred and fifty United States dollars or, where goods of the same class are imported into Zimbabwe by the same family more than once in any calendar month, if the aggregate value of such goods imported into Zimbabwe during that calendar month does not exceed the
equivalent of two hundred and fifty United States dollars.
4. The Secretary may issue a permit authorising, subject to this order and any other law in force in Zimbabwe—
(a) the import into Zimbabwe any goods listed in the First Schedule;
5. An application for the issue of a permit under this order shall be made in writing and, subject to section 6, shall be addressed to the Secretary for Industry and International Trade, Private Bag 7708, Causeway, Zimbabwe.
6. Where a permit is required in accordance with this order and also in accordance with the Animal Health (Import) Regulations, 1989, published in Statutory Instrument 57 of 1989 (hereinafter called "Animal Health (Import) Regulations") to authorise the import into Zimbabwe of the same goods—
(a) an application for the issue of a permit in terms of this order shall be deemed to be an application for the issue of a permit in terms of the Animal Health (Import) Regulations;
(b) if the Secretary issues a permit, he or she shall thereupon forward the permit and the application to the appropriate person authorised to issue a permit in terms of the Animal Health (Import) Regulations to be dealt with by such person in accordance with such regulations unless—
(i) he or she is satisfied that the person authorised to issue a permit in terms of the Animal Health (Import) Regulations has already issued a permit which is in force; or
(ii) the applicant specifically requests otherwise;
(c) the Secretary shall not issue a permit under this order, if he or she is satisfied that the person authorised to issue a permit in terms of the Animal Health (Import) Regulations has already refused to issue a permit;
(d) if the Secretary issues a permit under this order after being furnished with a permit issued by the person authorised to issue a permit under the Animal Health (Import) Regulations which is in force, he or she shall thereupon forward both permits to the applicant.
7. (1) The Secretary may, by notice in writing to a permit holder, revoke a permit issued by him or her under section 4 if the permit holder has failed to comply with this order or if any statement made in the application for a permit is found to be inaccurate or misleading.
(2) A permit revoked in terms the subsection (1) shall be returned immediately by the holder thereof to the Secretary.
8. A permit issued under section 4 shall not be transferable and any purported transfer of such permit shall be invalid.
9. Nothing contained in this order or in any permit issued thereunder shall exempt the holder of such permit from complying with the provisions of the Grain Marketing Act [Chapter 18:14] or any other law in force in Zimbabwe controlling the import into or export from Zimbabwe of the goods to which such permit relates.
10. Any permit issued under section 6 of the Control of Goods (Agriculture) (Import and Export) (Agriculture) Order, 1974, published in Rhodesia Government Notice 216 of 1974, shall be deemed to have been issued by the Secretary under section 4 of this order.

Description of the measure: 4 (1) The Director may issue permits authorising, subject to these regulations or any other law, the import into or transit through Zimbabwe of any animal or infections thing on such conditions as may be specified in the permit.
(2) A permit issued under subsection (1) shall be in the form set out in the Third Schedule.
6 (1) Subject to this section, no person shall import into Zimbabwe any animal or infectious thing otherwise than in accordance with the conditions of a permit issued under section 4.
(2) Subsection (1) shall not apply in relation to the import into Zimbabwe of—
(a) an animal which is in the course of transit by air through Zimbabwe to a place beyond the borders of Zimbabwe and which is not off-loaded within the borders thereof;
(3) Notwithstanding subsection (2), any animal or infectious thing originating in or passing through a country specified in the Fourth Schedule shall require a permit.
9. Nothing contained in these regulations or in any permit issued thereunder shall exempt the holder of such permit from complying with the provisions of any other law controlling the import into or the export from Zimbabwe of the animal or infectious thing to which such permit relates.d in the Fourth Schedule shall require a permit.

16. Registration of dealers
(1) Every dealer in a scheduled crop shall register with the Authority.
(2) A person shall not deal in a scheduled crop unless the person is registered
in accordance with this Act.
(3) The Cabinet Secretary shall, in consultation with the relevant county
executive committee member responsible for agriculture, prescribe regulations
providing for the procedure for registration of dealers and the regulations shall also
set out the appeal process in case of refusal or denial of registration.
(4) A person who contravenes subsection (2) commits an offence and shall on
conviction be liable to imprisonment for term not exceeding three years or to a fine
not exceeding five million shillings or to both.

4. (1) No person shall import into Mauritius, a consignment of fish or fish product, unless he is registered with the Permanent Secretary and where the consignment is intended for re exportation he is registered with the competent authority
(2) A person shall apply to be registered with the Permanent Secretary in such form and manner as he may determine.

Description of the measure
3. Every person who is engaged in the business of salt iodization shall furnish by sending by post or delivering to the Registrar a statement in writing in the form set out in the First Schedule containing the following particulars-
(a) the name of the business;
(b) the address of the business;
(c) the general nature of the business; and
(d) date of commencement of the business.
5. The Registrar shall issue a certificate of registration in the form set Certificate set in the Second Schedule to every firm or person registered under these Regulations.
