- 9. Subject to the provisions of these Regulations, an inspector may-
(d) cause any imported growing medium or plant which on inspection appears to be infested with an injurious organism and any plant in the same container to be destroyed immediately without compensation if the injurious organism is of a specially dangerous character or, in the opinion of the inspector-
(i) disinfection is impracticable or will not be a complete safeguard; or
(ii) the delay caused by disinfection would give rise to the risk of the introduction or spread of the injurious organism.
10. A consignment of fruit found by an inspector on importation to be infested with living caterpillars of the apple codling moth (Cydia pomonella (L.)) shall be destroyed without compensation:
Provided that the inspector may-
(a) if less than five per centum of the fruit is infested, cause the infested fruit in such consignment to be separated from the uninfested fruit and permit the release to the importer of the uninfested fruit;
(b) if five per centum or more of the fruit is infested-
(i) in consignments of not more than two containers of not more than one bushel each, believed by the inspector not to be for re-sale, cause the infested fruit to be separated from the uninfested fruit and release the uninfested fruit to the importer; or
(ii) in other consignments in which, owing to the immature development of the caterpillars there is in the opinion of the inspector no immediate risk of the introduction or spread of that moth within Zambia, permit the importer or consignor, within such period as the inspector may fix, to cause such consignment to be returned to the country of last export.
11. A consignment of potatoes found by an inspector on importation to be infected with wart disease (Synchytrium endobioticum (Schilb.) Percival) and a consignment of seed potatoes found by an inspector on importation to be infested with the root knot eelworm (Meloidogyne javanica (Treub)) or with any other species of eelworm injurious to plants shall be-
(a) destroyed without compensation; or
(b) if the inspector so permits, returned to the country of last export. - Reference of the measure

(2) Any person who contravenes the provisions of this section, commits an offence and is liable on conviction to a fine not exceeding one million shillings or to imprisonment for a term not exceeding three months, or to both such fine and imprisonment.
21.-(l) The Minister shall upon advice by the National. Seeds Committee approve any new plant variety.
(2) The Director shall establish and maintain a national catalogue of approved plant varieties and shall cause to be entered therein varieties imported, sold or distributed in Tanzania.

- 27.-(1) Plant protection substances and plant resistance improvers shall be used only in accordance with good professional practice.
(2)The Minister shall issue or cause to be issued a Code of Conduct for the proper use of plant protection substance, plant resistance improvers and equipment, which shall include, but not limited to, the following-
(a) measures to minimise or discourage the use of plant protection substances, plant resistance improvers and equipment, and other measures which do not attach priority to biological, biotechnological, plant breeding, cultivation and cropping measures,
(b) discouraging or prohibiting the use of plant protection substances, plant resistance improvers and equipment in cases where it is expected that their use will have harmful effects on health of man, animals, ground water or the natural environment;
(c) compulsory requirements to the users of plant protection substances, plant resistance improvers and equipment to observes directions for use;
(d) requirements to any person who applies plant protection substance, plant resistance improvers and equipment within the framework of this Act or instructs or supervises persons who apply the plant protection substances, plant resistance improver and equipment, to have necessary degree of reliability and possess necessary specialist knowledge and skills and to ensure that, the use of plant protection substances and equipment does not result in any avoidable harmful effects on the health of man, animals and the natural environment;
(e) requirements to a person using plant protection substance or plant resistance improvers to furnish proof that he possesses such specialist knowledge and skills for use of the plant protection substance as he is required;
(f) Prohibition. of the marketing of the plant protection substances or plant resistance improvers in retails trade by means of vending machines or other forms of self service;
(g) prohibition of retail selling of plant protection substances, plant resistance improvers and equipment, wholly or in part, if certain facts justify the assumption that the trader or person selling plant protection substances and equipment for him does not possess specialist knowledge necessary for properly informing the purchaser about the use of the plant protection substances, plant resistance improvers and equipment and the risk involved;
(h) requirements to traders or persons selling the plant protection substances, plant resistance improvers and equipment on their behalf to furnish proof that they possess the necessary specialist knowledge;
(i) prohibition of all kinds of handling of plant protection substances, plant resistance improver and equipment by minors, people of unsound mind and people in any other proven state or condition, who when handling plant protection substances, plant resistance improver and equipment, may be predisposed to harmful effects;

(1) No person shall after two years from the date of publication of these regulations sell any raw milk, raw cream, raw skimmed milk, raw reconstituted (prepared) milk, raw reconstituted (prepared) skimmed milk or raw milk that has become sour, except in the areas of jurisdiction of the local authorities listed in Annex C.
(2) Any local authority that is of the opinion that it can exercise sufficient control over the selling of the raw dairy products referred to in subparagraph (1) may request the Minister, in writing through the relevant provincial health department, to be listed in Annex C.
(3) Any local authority that is listed in Annex C may request the Minister in writing to delete its name from the list. - Reference of the measure
