25. (1) Except where specifically prescribed, all other marking requirements as specified by these regulations shall be clearly legible and be indicated at least in English, in a letter or figure size of at least 1 mm for lower case vowels.
(2) The container of a dairy product or an imitation dairy product shall be marked with the following particulars:
(a) The class designation and if applicable the additions to the class designation in letters of the same type, size, colour and font, prominently on the main panel in letter size of at least 2mm for lower case vowels.
(b) The additional particulars on the main panel, where applicable.
(c) The name and address of the manufacturer, packer, importer or seller of that dairy product or imitation dairy product: Provided that in the case where it is not possible to use the physical address a postal address with a telephone number may be used.
(d) The nett and/or drained mass, or volume whichever one is applicable, of the dairy product or imitation dairy product packed therein as required in terms of the Trade Metrology Act, 1973 (Act No. 77 of 1973): Provided the height of the mass or volume indications shall comply with the requirements as set out in the Trade Metrology Act, 1973 (Act No. 77 of 1973).
(e) The ingredient list, in the manner prescribed in the regulations published under the Foodstuffs, Cosmetics and Disinfectants Act, 1972 (Act No. 54 of 1972).
(f) The "best before" or "use by" or "sell by" date and the batch code or batch number in the manner prescribed in the regulations published under the Foodstuffs, Cosmetics and Disinfectants Act, 1972 (Act No. 54 of 1972).
(g) The country of origin, which shall be declared as follows:
(i) "Product of (name of country)" if all the main ingredients, processing and labour used to make the foodstuff are from one specific country; or
(ii) "Produced in (name of country)", "Processed in (name of country)", "Manufactured in (name of country)", "Made in (name of country)" or similar words when a foodstuff is processed in a second country which
changes its nature:
(iii) Provided that the words "Packed in (name of country)" may be used in addition to the requirement of sub-paragraph (i) or (ii) above.
(3)The particulars referred to in sub-regulation (2) (a), (c), (d) and (f) shall be marked on an outer container in which more than one container of a dairy product or an imitation dairy product is packed.
(4) If a primary dairy product known as milk or cultured milk is sold from a tank into the container of the buyer, the tank from which such milk or cultured milk is sold shall be marked in the immediate vicinity of the tap with the applicable class designation and the manner of heat treatment, e.g. "pasteurised" or if not heat treated, the expression "raw" or "unpasteurised", in letters and figures of which the minimum vertical height is at least 50mm.
(5) In the case of a multipack, only the particulars prescribed in sub-regulation (2) (a) shall be indicated on the individual containers: Provided that such individual containers may not be sold loose and that the outer container or the foil lid is marked with all the prescribed marking requirements.
(6) If a primary dairy product known as cheese is cut and packed in the retail trade, the container or wrapper thereof shall be provided with a label indicating the particulars referred to in subregulation ( 2) (a), (c), (d), (e), (f) and (g) and regulation 29.
(7) No word or expression may be bigger than the class designation unless it is --
(a) a registered trade mark or trade name; or
(b) the name that is used in connection with the sale of the cheese specified in Table 9: Provided that the difference in letter size may not exceed 5 mm.
Indication of class designation
26. (1) The class designation of a dairy product or an imitation dairy product shall be --
(a) the applicable class designation or the alternate class designation as specified in regulations 3 and 22; or
(b) any combination of the class designation and the alternate class designation:
Provided that the designation shall represent the true description of the product concerned.
(2) In the case of other dairy products or imitation dairy products of which the class designation or the alternate class designation thereof is not provided for by these regulations, the class designation shall be the true description of the product concerned: Provided that it is not misleading and that in the case of modified dairy products or imitation dairy products the word "modified" or "imitation", as the case may be shall form part of the class designation.
(3) If imitation milk is derived from plant material, the word "milk" shall be preceded by the name of the plant concerned and the word "imitation" may be omitted.
(4) The word "process" in the class designation of process cheese and process cheese with added foodstuff may be substituted by the word "processed".
(5) The class designation may be marked in altered word sequence provided, that the altered word sequence does not constitute a misrepresentation, or does not directly or by implication create a misleading impression regarding the quality, nature, origin, class or composition of that dairy product or imitation dairy product concerned.
Additions to class designation
27. (1) In the case of reconstituted or recombined milk, the word " reconstituted" or "recombined" shall form part of the class designation.
(2) If a primary product has been obtained from the milk of an animal other than a cow of the bovine specie, the applicable class designation for that product shall be preceded by the name of the specie of the animal concerned.
(3) If a flavouring has been added to a dairy product or an imitation dairy product in order to render a distinctive specific flavour thereto, the class designation for that product shall be preceded by the descriptive name for the distinctive flavour concerned and the expression "X Flavoured", or followed by the expression "with X Flavour" or "with X Flavouring", where "X" indicates the name(s) of the flavouring(s) used unless the flavourant concerned as been added with the intention to enhance the flavour of the fruit or added foodstuff concerned.
(4) Subject to the provisions of regulation 11 (2), the applicable class designation shall include the actual name of the foodstuff or fruit added if a foodstuff or fruit has been added to a dairy product or imitation dairy product.
(5) The expression "plain" may form part of the class designation if no foodstuff, fruit or flavouring has been added to a dairy product or imitation dairy product.
(6) The word "with" in the class designation of a composite dairy product or imitation dairy product may be omitted: Provided that the indication of the class designation is not misleading.
(7) The words used to describe the texture or appearance e.g. "chunky", "smooth", etc. may form part of the class designation: Provided that such description is not misleading.
Additional particulars on the main panel
28. (1) The main panel of a container of a primary dairy product of the type known as dairy powder blend and dairy liquid blend shall be marked with a product description of the product concerned:
Provided that --
(a) such product description shall consist of an indication of the descriptive names of the main dairy ingredients of the product concerned, indicated in descending order of mass; and
(b) the letter size of the indication of the descriptive names referred to in paragraph (a) shall not be less than 50 per cent of the size of the class designation.
(2) (a) If vegetable fat, marine fat and/or animal fat is a constituent of a modified dairy product or an imitation dairy product, the expression 'with (name of the fat)" shall immediately follow the class designation in a letter size not less than 50 per cent of the size of the class designation, except in the case where the class designation includes the indication of the added fat.
(b) The provisions of paragraph (a) above shall also apply in the case where added protein and/or carbohydrates is/are obtained from a source other than a primary dairy product.
(c) The requirements of sub-regulation (2) shall be indicated in letters of the same colour and font as the class designation.
(3) If a dairy product or an imitation dairy product has been sweetened, the expression "sweetened" shall be indicated on the main panel of a container thereof in a letter size of at least 2 mm in height for lower case vowels.
(4) If the types of primary dairy products known as milk and cream have been heat treated, the manner of processing thereof shall be included on the main panel in close proximity to the class designation in a letter size not less than 50 per cent of the size of the class designation.
(5) The provisions of sub-regulation (4) shall mutatis mutandis apply to fermented dairy products if it is subjected to heat treatment after fermentation: Provided that the applicable class designation for the dairy product concerned shall be "heat treated fermented milk" or "heat treated dairy product".
(6) If the types of primary dairy products known as milk and cream have not been heat treated as contemplated in sub-regulation (4), the applicable class designation for that product shall include the expression "Unpasteurized" or "Raw".
(7) The expression "long life" may be indicated on the label of commercially sterile dairy products.
(8) The expression "extended shelf life" may be indicated on the container of milk if the milk has been treated in a suitable manner to ensure that all pathogens are destroyed and that the product is not microbiologically degraded when stored unopened at 6-8°C for at least 21 days, excluding UHT and sterilised milk.
(9) The expression "not for baby/infant feeding" shall be indicated on the main panel of the container of imitation dairy products, modified dairy products and that of goat milk in the manner prescribed in the regulations published under the Foodstuffs, Cosmetics and Disinfectants Act, 1972 (Act No. 54 of 1972).
Batch identification
29. (1) A container of a dairy and imitation dairy product shall be clearly marked with the batch code or batch number in such a way that the specific batch is identifiable and traceable.
Additional particulars on containers
30. (1) A container of a powdered dairy product or powdered imitation dairy product shall be marked with directions for the reconstitution thereof in order to obtain a final ready-to-use product.
(2) A container of butter of the class known as medium fat butter, and of modified butter of the class known as medium fat modified butter shall be marked with the expression "not suitable for frying (purposes)".
(3) If the fat content of a dairy product or an imitation dairy product is indicated on the container thereof, the indicated fat content of the product concerned shall not differ by more than 15 per cent calculated from the actual fat content thereof.
Restricted particulars on containers and outer containers
31. (1) Subject to the provisions of sub-regulation (2) --
(a) no class designation other than the applicable class designation of a dairy product or an imitation dairy product shall, except in the circumstances set out in regulation 28, be marked on a container thereof; and
(b) no word or expression which so nearly resembles the class designation of a dairy product that it could be misleading with regard to the composition of an imitation dairy product shall be marked on the container of such imitation dairy product.
(2) If the class designation of a dairy product, or a word or expression referred to in subregulation (1)(b), forms part of a registered trade mark that has been in use before 20 November 1987, such trade mark may be marked on a container of an imitation dairy product if --
(a) the registered trade mark is framed clearly on the container of the imitation dairy product concerned; and
(b) an abbreviation of the trade mark symbol that is permissible under the Trade Marks Act, 1993 (Act No. 194 of 1993), is marked within such frame.
(3) (a) No word, mark, illustration, depiction or other method of expression that constitutes a misrepresentation or directly or by implication creates or may create a misleading impression regarding the quality, nature, class, origin or composition of a dairy product or an imitation dairy product shall be marked on a container of such product.
(b) The provisions of paragraph (a) above shall, in the case of an imitation dairy product of the type known as imitation milk product, not be construed so as to include a prohibition on an illustration or depiction of a drinking glass or glass jug containing a liquid with a white colour.
(4) No registered trade mark or brand name which may possibly, directly or by implication, be misleading or create a false impression of the contents of a container or outer container containing a dairy product or an imitation dairy product, shall appear on such a container.
(5) The words "natural", "super", "extra", "pure", "fine" or any other word or expression that directly or by implication creates or may create the impression that a dairy product or an imitation dairy product is of a special or particular quality shall not be marked on the container of such product.
(6) The words "mature" or "vintage" may be marked on the container of cheese only if such cheese has --
(a) subject to the requirements in regulation 13 (5), been ripened for the applicable minimum ripening period specified in column 7 of Table 9;
(b) after organoleptic evaluation according to the method specified in item 1 of Table 19, attained an average score of at least 4; and
(c) broken down sufficiently.
(7) The words and expressions "choice" and "specially selected" may be marked on the container of a primary dairy product of the type known as cheese and butter only if, after organoleptic evaluation according to the method mentioned in item 1 of Table 19 --
(a) in the case of cheese with the designation Gouda or Cheddar, it attained an average score of at least 4; or
(b) in the case of butter, it attained an average score of at least 3.
(8) No claim regarding the absence of any substance that does not normally occur in a dairy product or an imitation dairy product shall be marked on the container of such product, except in the cases where the negative claim is allowed for in the regulations published under the Foodstuffs, Cosmetics and Disinfectants Act, 1972 (Act No. 54 of 1972).
(9) No comparison with or reference to the respective merits or demerits of dairy products against imitation dairy products, whether relevant or not, shall be marked on the container of a dairy product and an imitation dairy product.
(10) The word "instant" may only be marked on the container of a dairy product if such product, when reconstituted in accordance with the usage instructions thereof, will disperse in water at 20 °C within 60 seconds when stirred.
(11) The word "fresh" may only be marked on a container of a primary dairy product of the type known as pasteurised, ultra pasteurised and unpasteurised milk or raw milk with no added foodstuff or minerals, and on the container of a primary dairy product of the type known as pasteurised and unpasteurised/raw cream.
(12) An imitation dairy product labelled as "non-dairy" or "dairy free" shall not contain any dairy ingredients.
(13) The word "organic" shall not be labelled on a container of dairy product unless the product was produced, processed and handled in compliance with recognised standards and certified by an accredited certification body or authority.
(14) Subject to the provisions of regulation 11 (2), depictions, illustrations or expressions which emphasise the presence of the added foodstuff or fruit in a dairy product or imitation dairy product shall only be allowed if the requirements on Quantitative Ingredient Declarations (QUID), as specified in the regulations published under the Foodstuffs, Cosmetics and Disinfects Act, 1972 (Act No. 54 of 1972), have been complied with.
(15) The provisions of this regulation shall mutatis mutandis apply to particulars that are marked on --
(a) an outer container in which one or more separate containers of a dairy product or an imitation dairy product is packed;
(b) a notice board displayed at or in the immediate vicinity of a dairy product or an imitation dairy product that is kept or displayed for sale; and (c) all advertisements for dairy and imitation dairy products. - Reference of the measure

8. Subject to the provisions of Section 3 of the Act and the Regulations Relating to the Labelling and Advertising of Foodstuffs published in Government Notice No.R.146 of 1 March 2010, as amended, the following shall be indicated on the label of a foodstuff regarding the presence of a sweetener:
a. In the case of a mixed, compounded or blended foodstuffi. sweeteners shall be indicated by its common name in the list of ingredients, provided that in the case of a non-nutritive sweetener, the words "non-nutritive sweetener" shall appear in brackets immediately following the name of the sweetener; or the words "non-nutritive
sweetener" followed by a semi-colon and the name of the nonnutritive sweetener; and
ii. in the case of the sweetener steviol glycosides, it shall be described as "Steviol Glycosides", or "Steviol Extract";
b. A foodstuff containing sugar alcohols or polyols, singly or in combination, in excess of 50g/kg of the final product shall be labelled with the expression "excessive consumption may have a laxative effect"; provided that for sugar-free chewing gum the statement is required if the sugar alcohol content of the product exceeds 250g/kg; and
c. A foodstuff containing aspartame and aspartame-acesulfame salt must bear:
i. the word "aspartame" or aspartame-acesulfame salt in the list of ingredients followed by an asterisk; and
ii. an asterisk shall appear on a separate line directly below the list of ingredients followed by the words: "Contains phenylalanine" OR "Phenylketonurics: contains a source of phenylalanine". - Reference of the measure

- 2. (1 ) No person shall sell litchis in the Republic of South Africa --
(e) unless such litchis are marked with the particulars and in the manner prescribed in regulation 11.
MARKING REQUIREMENTS
11. (1) Each container including prepacked units containing litchis shall be marked clearly, neatly,
indelibly, legibly, on any visible short or long side of the lid or container, where lids are not used, by printing,
stamping or by means of specially designed labels with the following particulars: Provided that all particulars
shall be grouped on the same side:
(a) the expression "Litchis", "Lychees", or other common name relating to Litchi chinensis: Provided that if the contents are visible from the outside, this expression does not have to be indicated on the container;
(b) the appropriate cultivar/ variety;
(c) the expression "Class 1", "Class 2" or "Lowest Class", as the case may be;
(d) the name and physical or postal address of the producer, packer or owner of the contents of the container;
(e) the country of origin; Provided that no abbreviations or the expression "South Africa" on its own shall be used (e.g. "Product of South Africa", "Produced in South Africa", or any other similar expression; and
(f) the applicable date of packing/ date code or an internationally recognised code.
( 2) If containers are marked by means of affixing labels thereupon, such labels shall be clean and securely attached and shall not be superimposed on other labels.
Prohibited particulars
12. No person shall use any name, word, expression, reference, particulars or indication in any manner, either by itself or in conjunction with any other written, printed, illustrated or visual material, in connection with the sale of a product in a manner that conveys or creates or is likely to convey or create a false or misleading impression as to the nature, substance, quality or other properties, or the class or grade, origin, identity or manner or place of production, of that product.
Display
13. (1) If litchis in containers for sale are being displayed, such container shall be placed in such a manner to ensure that the prescribed markings on the containers or labels, as the case may be, are clearly visible.
( 2) If litchis are displayed for sale other than in containers, --
(a) any quantity thereof of a particular class or cultivar, as the case may be, shall not be so displayed mixed with litchis of any other class or cultivar; and
(b) the class and cultivar of such quantity of litchis shall be displayed in clear legible letters on a notice board prominently placed at such quantity of litchis. - Reference of the measure

- 2. (1) No person shall sell a consignment of maize products in the Republic of South Africa --
(d) unless such maize products are marked with the particulars and in the manner prescribed in regulation 6.
Marking requirements
6. (1) Each container in which a maize product is packed shall be marked in clearly legible symbols, letters and figures with --
(a) the name and physical address of the manufacturer, packer, processor, distributor and/or importer of the maize product concerned;
(b) the grade of the maize product as mentioned in regulation 3; and
(c) the net mass of the maize product concerned in that container as prescribed in terms of the Trade Metrology Act 1973 (Act No, 77 of 1973).
(2) Each container in which a fortified maize product is packed, shall contain the particulars in terms of Foodstuffs, Cosmetics and Disinfectants Act, 1972 (Act No. 54 of 1972).
(3) The provisions of this sub-regulation (1 and 2) shall not apply with regard to a maize product which --
(a) is sold in bulk; or
(b) is repacked in quantities of less than 50 kg, where the mass concerned is measured in the presence of the buyer of that maize product or his agent, and is taken from a container which is marked as contemplated in
subregulation (1).

7. No wording, illustration or other device of expression which constitutes a misrepresentation or which directly or by implication can create a misleading impression of the contents shall appear on the container containing any grade of maize products or on a label affixed thereto or which is displayed therewith. - Reference of the measure

13. (1) Each container containing jam, jelly or marmalade shall be clearly and legibly marked or labeled with the following particulars in at least English:
(a) A true description of the contents thereof which shall include, on the main panel the type of jam, jelly or marmalade; provided that:--
(1) if any permitted visible ingredient has purposefully been added to the product, an indication thereof shall be marked in close proximity to the product designation in the letters at least 50 per cent of the size of the
product name;
(ii) if a flavouring has been added to the product in order to render a distinctive flavour thereto and the added flavour differs from the flavour of the ingredients of the product, the name of the product shall be preceded
by the words "X" flavoured or followed by the words "with X" flavour, where "X" denotes the descriptive name of the distinctive flavour;
Provided that in the case of apple jelly that is coloured and flavoured, the product name shall indicate the distinctive taste or flavour of the final product;
(iii) the product name shall in the case of mixed fruits include the name of the fruits contained in descending order of weight of the raw material used, provided that in the case where more than three fruits are used the
expression "mixed fruit" may be used as a product name;
(iv) in the case where the pips or seed have been purposefully been added to the product, an indication of the presence of pips or seeds shall be marked in the letters at least 50% of the size of the class designation;
and
(v) the expression "Preserve" or "Conserve" may be used instead of the expression "jam" or "Extra fruit jam".
(b) An indication of the grade thereof, on the main panel; provided that the expression "Caterers Grade" may be used instead of the expression "manufacturers Grade".
(c) The name and physical address of the manufacturer, owner, importer, packer or importer in a letter size of at least 1 mm.
(d) The ingredient list in a manner set out in the regulations made under the Foodstuff, Cosmetics and Disinfectants Act, 1972 (Act No. 54 of 1972) in a letter size of at least 1mm.
(e) The country of origin, which shall be declared as follows:
(i) "Product of (name of country)" if all the main ingredients, processing and labour used to make the foodstuff is from one specific country;
(ii) "Produced in (name of country)", "Processed in (name of country)", "Manufactured in (name of country)", "Made in (name of country)" or similar words when a foodstuff is processed in a second country which
changes its nature; or
(iii) the words "Packed in (name of country)" may be used in addition to the requirement of paragraph (a) or (b) above.
The net mass of the contents as required in terms of the Trade Metrology Act, 1973 (Act No. 77 of 1973).
(g) A code mark which has been approved, in writing, by the Executive Officer and which shall consists of the product concerned, the date of manufacture and the name of the processing establishment thereof; provided that:--
(i) the processing establishment identification code shall be indicated on the last position on in the sequence; and
(ii) in the case of a transparent containers where the contents are clearly visible , the product code need not to be indicated.
(2) No word shall be larger than the size of the product name, except in case of a trade mark.
(3) Except where specifically prescribed, all other markings shall be indicated in minimum letter size of at least 2 mm height, provided that the height of the mass indications shall comply with the requirements in terms of the Trade Metrology Act, 1973 (Act No. 77 of 1973).
(4) The label on a container containing jam, jelly or marmalade shall:- -
(a) be clean and neat;
(b) be pasted securely and cannot be separated from the container at point of sale;
(c) not be pasted over labels; and
(d) be affixed to such a container only by, or on behalf of the packer concerned.
Marking requirements on the outer containers
14. (1) If one or more containers containing jam, jelly or marmalade are packed in an outer container, such container shall be marked or labeled with the following particulars:-
(a) the number of containers packed therein;
(b) the net mass of the content thereof;
(c) the name and physical address of the manufacturer, owner, importer, packer or importer;
(d) an indication of the grade: provided that the expression "Caterers' Grade" may be used instead of the expression "manufacturers' Grade"; and
(e) a true description of the content: provided that when any such package contains assorted kinds of jam, jelly or marmalade, words signifying the assortment concerned may be marked thereon.
(2) In the case of transparent outer containers where the marking requirements on the containers are visible from the outside, the requirements of subregulation (1) need not be complied with.
Restricted particulars
15. (1) No wording, illustration or any other means of expression which constitutes a misrepresentation or which directly or by implication creates or may create a misleading impression regarding the contents or grade, nature or quality shall appear on a container or outer container containing jam, jelly or marmalade.
(2) No trade mark or brand name which may possibly, directly or by implication, be misleading or create a false impression of the contents of a container containing jam, jelly or marmalade, shall appear on such a container. - Reference of the measure

MARKING REQUIREMENTS
10. (1) Each container containing canned fruit shall be clearly and legibly marked or labelled with the following particulars:
(a) A code mark which has been approved, in writing, by the Executive Officer and which consists of the name of the canning establishment, the product concerned and the date of manufacturer thereof: Provided that -
(i) the canning establishment identification code shall be indicated at the last position in the sequence: Provided further that in the case where the codes are indicated in two lines, the identification code shall be the last digit in the second line; and
(ii) in case of a transparent container where the contents are clearly visible, the product code need not be indicated.
(b) The name or trade mark of the manufacturer or packer.
(c) The physical address of the manufacturer or packer.
(d) A true description of the contents thereof indicated on the main panel: Provided that if a permissible artificial colouring and artificial flavouring matter has been added to canned fruit the words disclosing that fact shall be declared on the list of ingredients.
(e) The packing medium in which the canned fruit is packed, shall be declared on the product name or in close proximity to the product name: Provided that it is still declared on the main panel.
(f) An indication of the grade thereof: Provided that the expression "Caterers Grade" may be used instead of the expression "Manufacturers Grade".
(g) The net mass of the contents thereof, as required in terms of the Trade Metrology Act, 1973 (Act No. 77 of 1973).
(h) The expression "Product of" followed by the name of the country of origin: Provided that no abbreviations shall be used.
(2) If one or more containers with canned fruit are packed in an outer container, such outer container shall be marked with the following particulars:
(a) The name or trademark of the manufacturer or packer.
(b) The physical address of the manufacturer or packer.
(c) A true description of the contents thereof.
(d) An indication of the grade thereof: Provided that the expression "Caterers Grade" may be used instead of the expression "Manufacturers Grade".
(e) The net mass of the contents thereof as required in terms of the Trade Metrology Act, 1973 (Act No. 77 of 1973).

(c) not be pasted over other labels; and
(d) be affixed to such container only by or on behalf of the packer or manufacturer concerned or his agent.
(5) Subject to the provisions of subregulations (1) and (2) and regulation 11, canned fruit shall comply with the additional marking requirements, where applicable, for each kind of canned fruit as set out in Part II.

- 2. (1) No person shall sell in the Republic of South Africa fresh vegetables, other than imported fresh vegetables referred to in subregulation 2;
(e) unless the containers concerned are marked according to the requirements set out in regulations 10 and 11;
Marking requirements
10. (1) Each container containing fresh vegetables destined for sale shall be marked in clear and legible letters and figures with the following particulars: Provided that all particulars shall be grouped on the same side:
(a) The name or trademark and physical or postal address of either the producer or owner or importer or packer of the fresh vegetables packed in that container.
(b) The expression "Class 1", "Class 2", "Class 3" and "Lowest Class", as the case may be.
(c) The total number of prepacked units per outer container.
(d) The total number(count) of vegetables in each container or the net mass as prescribed by the Trade Metrology Act, 1973 (Act No. 77 of 1973) or size of the vegetables if prescribed in Part II for the specific type of vegetable.
(e) The name of the type of fresh vegetables in the case of containers where the contents are not visible from outside.
(f) The packing date.
(g) Country of origin.
(2) If containers containing fresh vegetables are packed in an outer container, each outer container shall be marked with the particulars in subregulation 1, as well as with the number of containers it contains, on at least one end of every carrier container by means of stamping or stenciling or by pasting a printed label thereon. Provided that outer containers which allow visibility of the individual prepacked units need not provide any marking.
(3) The particulars prescribed in subregulation 1 shall be indicated on the container by stamping, printing or by affixing a label thereon.
(4) Particulars shall be printed in English or both in English and any of the other official languages: Provided that internationally acknowledged symbols may be used.
(5) If at any stage the class or size designation should change, the labels shall be replaced unless the new class or size designation is stamped across the old class or size designation, in clear legible letters of at least 2 mm larger than the previous marks, with a suitable stamp.
(6) If classified fresh vegetables are displayed for sale in loose quantities ;
(a) any quantity of a particular class, shall not be displayed mixed with fresh vegetables of any other class; and
(b) the class and country of origin in case of imported fresh vegetables shall be indicated in clear, legible letters on a notice board prominently placed at the quantity of fresh vegetables.

MARKING REQUIREMENTS
9. (1) Each container of onions or shallots destined for sale shall be marked clearly, legible, indelibly and not untidy, or askew by printing, stamping or by means of specially designed labels described in sub regulation (4) with the following particulars:
(a) The name or trademark and physical or postal address of either the producer or owner or importer or packer of the onions or shallots packed in that container.
(b) The expression "Class 1", "Class 2", "Class 3" and "Lowest Class", as the case may be.
(c) The expression "produce/product of followed by the full name of the country of origin thereof or the country of origin declared as required by the regulations published in terms of the Foodstuffs, Cosmetics and Disinfectants Act, 1972 (Act 54 of 1972).
(d) In the case of Class 1 and Class 2, the size group namely "Extra Large", "Large", "Medium", "Small" or "Pickles" as the case may be.
(e) The net mass of the contents as prescribed in terms of the Trade Metrology Act, 1973 (Act No. 77 of 1973).
(f) The name onions or shallots in the case of containers where the contents of which are not visible from outside.
(2) The particulars prescribed in sub regulation (1) shall be indicated on the container by stamping, printing or by affixing a label thereon.
(3) If at any stage the class or size designation should change the labels shall be replaced unless the new class or size designation is stamped across the old class or size designation, in clear legible block letters of at least 2 mm larger than the previous marks, with a suitable stamp.
(4) Each container containing onions or shallots shall be provided with one or more labels that shall be-
(a) intact, clean and neat;
(b) manufactured from suitable material; and
(c) affixed firmly to the container and in such a manner that re-stamping is possible without opening or damaging the container.
Display
10. Wherever onions or shallots are displayed for sale in loose quantities-
(a) any quantity of a particular class, or a particular size group or cultivar shall not be displayed mixed with onions or shallots of any other class, size group or cultivar; and
(b) adherence to the marking requirements is optional: Provided that if marked, the class, and in the case of Class 1 and Class 2 also the size group of such quantity of onions or shallots, shall be indicated in clear legible block letters of at least 10 mm in height on a notice board prominently placed at such a quantity of onions or shallots.

8. The regulations are hereby amended by the substitution of regulation 22(2)(a) by the
following regulation;
22. (2) (a). A vignette, graphic, or pictoral presentation of a product on a pet
food shall not misinterpret the contents of the package. When a graphic or picture of animal
protein, vegetables. cereals and grains is used on the label it shall be used subject to the
following rules-
(i) Where a label shows graphics or pictorial of vegetables, fish, milk and eggs it
shall mean that there is at least a 4%. of the ingredient appearing in the picture or graphic in the
final product;
(ii) Where a label shows graphics or pictorial of cereals and/or grains. it shall mean
that there is at least a 14%, of the ingredient appearing in the picture or graphic in the final
product; and
(iii) Where a label shows graphics or pictorial of meat, it shall mean that there is at

(2) Subject to the provisions of subregulation (1), each outer container containing prepacked
units shall be marked with an indication of the total number of prepacked units per outer container: Provided
that if the total number of prepacked units is visible from the outside, it does not have to be indicated on the
outer container.
(3) If an indication highlighting a special grading, presentation or size is indicated on the same side as the particulars in subregulation ( 1 ), it shall not be used with the expression "Peaches" or "Nectarines", the cultivar name or the class indication.

MARKING REQUIREMENTS FOR PEARS
General
11. (1) Each container containing pears, shall be marked clearly, indelibly, legibly and not untidy, upside-down or askew in any short or long side of the lid or container, where lids are not used, by printing, stamping or by means of specially designed labels with the following particulars: Provided that all particulars shall be grouped on the same side:
(a) The expression “Pears”.
(b) The appropriate cultivar/variety;
(c) The applicable minimum and maximum diameter: Provided that it --
(aa) may be replaced with the applicable count, preceded by the expression "Count" in the case of pears packed in layers; or
(bb) shall be replaced with the applicable minimum diameter, in the case of Class 2 or Lowest Class pears which are not sized.
(d) The class namely “Class 1” or “Class 2” as the case may be.
(e) The name, physical address and the contact of the producer or owner of the contents of the container
(f) The country of origin. Provided that no abbreviations or the expression "South Africa" on its own shall be used (e.g. "Produce of South Africa", "Produced in South Africa", or any other similar expression).
(g) Indication of date code/date on containers at least 90% of the containers and prepacked containers: Provided that if the packing date is expressed in date code, it shall be registered with the Executive Officer.
(2) Subject to the provisions of Subitem (1) each outer container and bulk container containing prepacked units shall be marked with an indication of the total number of prepacked units per outer container: Provided that if the total number of prepacked units are visible from the outside, it does not have to be indicated on the outer container.
(3) Prohibition of false or misleading description for products- No person shall use any name, word, expression, reference, particulars or indication in any manner, either by itself or in conjunction with any other verbal, written, printed, illustrated or visual material, in connection with the sale of a product in a manner that conveys or creates or is likely to convey or create a false or misleading impression as to the nature, substance, quality or other properties, or the class or grade, origin, identity or manner or place of production, of that product shall be indicated on the same side as the particulars in subitem (1).
(4) If pears are displayed for sale in loose quantities—
(a) any quantity of a particular class, size group or cultivar shall not be displayed mixed with pears of any other class, size group or cultivar; and
(b) if imported, the country of origin of the pears shall be indicated in clear, legible block letters on a notice board placed at the quantity of pears.
Prohibited particulars
12. No wording, illustration or other means of expression which constitutes a misrepresentation or which directly or by implication, create a misleading impression of the contents, shall appear on a container which contains pears.
Display
13. (1) If pears in containers for sale are being displayed, such container shall be placed in such a manner to ensure that the prescribed markings on the containers or labels, as the case may be, are clearly visible.
(2) If pears are displayed for sale other than in containers, --

MARKING REQUIREMENTS FOR APPLES
12. (1) Each container containing apples shall be marked clearly, indelibly, legibly and not untidy, upside-down or askew in block letters and numerals on any visible short or long side of the lid or container, where lids are not used, by printing, stamping or by means of specially designed labels with the following particulars: Provided that all particulars shall be grouped on the same side:
(a) The expression "Apples".
(b) The appropriate cultivar.
(c) The applicable minimum and maximum diameter: Provided that it
(aa) may be replaced with the applicable count, preceded by the expression "Count', in the case of apples packed in layers; or
(bb) shall be replaced with the applicable minimum diameter followed by the expression "and over", in the case of Class 2 apples which are not sized;
or
(d) The applicable minimum and maximum weight: Provided that it
(aa) may be replaced with the applicable count, preceded by the expression "Count', in the case of apples packed in layers; or
(bb) shall be replaced with the applicable minimum weight followed by the expression "and over", in the case of Class 2 apples which are not sized.
(e) The appropriate class in accordance with regulation 3.
(f) The name and physical or postal address of the producer or owner of the contents of the container.
(g) The producer's code or the packhouse code (excluding imported apples) which is registered with the Executive Officer by the producer or packhouse, as the case may be: Provided that
(i) the packhouse code shall be used if the origin of the apples cannot be traced back to the producer;
(ii) if a producer has more than one farm, each farm shall be registered separately; and
(iii) such code shall be preceded by the expression "Producer", "Packhouse", "Packer", "PUC", "PHC", "FBO" or any other suitable term having a similar meaning.
(h) The country of origin.
(i) Indication of date code/date on at least 90% of the containers and prepacked containers: Provided that if the packing date is expressed in date code, it shall be registered with the Executive Officer.
(2) Subject to the provisions of subitem (1), each outer container containing prepacked units shall be marked with an indication of the total number of prepacked units per outer container: Provided that if the total number of prepacked units is visible from the outside, it does not have to be indicated on the outer container.
(3) No indication highlighting a special grading, presentation weight or size shall be indicated on the same side as the particulars in subitem (1).
(4) The net weight must be indicated on jumble cartons.
(5) If apples are displayed for sale in loose quantities
(a) any quantity of a particular class, size group or cultivar shall not be displayed mixed with apples of any other class, size group or cultivar; and
(b) if imported, the country of origin of the apples shall be indicated in clear, legible block letters on a notice board placed at the quantity of apples.

The product may contain soya and/or other non-meat proteinaceous materials subject to the following:
6.12.1 If required to do so by the authority administering this specification or the authority administering
the regulations under the current Foodstuffs, Cosmetics and Disinfectants Act, the manufacturer of the
canned meat product shall disclose to the authority the composition of the non-meat proteinaceous preparation that has been used and the concentration at which it is present in the meat product.
6.4 2.2 Where soya and/or other non-meat proteinaceous material is present in products that contain the meat content called for by this specification, the presence of non-meat proteinaceous material shall be declared in the ingredients panel of the label. The meat content of the product may be declared immediately below the title in type of at least half the size of that used for the words in the title and of minimum size 2 mm.
6.12.3 Where any part of the meat content of a product laid down by this specification has been replaced by soya and/or other non-meat proteinaceous material, the presence of this substituted material shall be declared conspicuously and prominently in the title of the product, in the main panel of the label, in the same colour as the rest of the title and in type of at least half the size of that of the words appearing in the rest of the title. The meat content shall be declared immediately below the title in type of at least half the size of the larger type used for the words in the title and of minimum size 2 mm. - Reference of the measure
