- 10.3.2 True description of canned fish
10.3.2.1 Where stockfish is used in the preparation of products labelled "curried fish, "fried fish", or "pickled fish" the name "stockfish" need not to appear in the title; in the case of other fish used for these types of products the name of the fish shall appear in the title in conjunction with the descriptions. The type of fish used shall appear in the list of ingredients (see 10.2.1(c)).
10.3.2.2 Mullet shall be described only as "Mullet" or "Haarders" / "Harders".
10.3.2.3 Trachurus spp. shall be described only as "Maasbanker" or "Jack Mackerel".
10.3.2.4 Scomberspp. in any form shall be described only as "Mackerel'/'Makriel" or "Middlecut".
10.3.2.5 The words "middle cut"/middelstuk" shall be used only when coupled with the name of the fish and when in fact middle cuts have been packed; the words "middle cut/middelstuk" shall appear in type of the same size and prominence as that of the name of the fish.
10.3.2.6 Canned sardines or sardine type products are prepared from the following species:

Depending on the species used, the name of the product shall be
a) "Sardines" exclusively reserved for Sardina pilchardus (Walbaum); or
b) "X sardines" where "X" is the name or description of a country, the species, or the common name of the species in accordance with this specification and in a manner not confusing or misleading to the consumer (see 10.3.1) in close proximity and in a letter size at least half the size of the word sardines and in equal prominence, with the exception that the species Spraffus spraffus may be described as brisling sardines.
c) The description "PilchardsISardyne" is exclusively reserved for the species Sardinops ocellatus, S. melanostitus, S. neopilchardus, S. sagax, S. caeruleus and Sardina pilchardus.
d) Sardinella spp shall be described as "Sardinella". The descriptive terms "Pilchards" shall be not used for packs consisting of Sardinella spp.
e) Etrumeus spp. shall be described as "X herring" where "X" is the name or description of a country, a geographic area, the species, or the common name of the species in a manner not to mislead or confuse the customer. The species Etrumeus teres (Rooi-ooglronde haring) qualify for labelling "South Atlantic herring"/'Suid Atlantiese Haring".
f) Engraulis spp. shall be described as anchovies.
g) Canned Saury shall be prepared from Scomberesox spp. and Cololobis spp.
10.3.2.7 Snoek (Thyrsites atun) in any form shall be described only as "Snoek", "Barracouta" or
"Atun".
10.3.2.8 Subject to 10.3.2.1, South African Merluccius spp. shall be described only as "Hake" or
"StockfishlT'Stokvis" or as Cape Whiting.
10.3.2.9 Yellow-tail (Seriola spp.) shall be described only as "Yellow-tail"/Geelstert", "Halfkoord",
"Amberjack".
10.3.2.10 Canned Tuna and Bonito (see 6.1.4) are the product consisting of the flesh of any of the appropriate species listed below:

10.3.2.10.1 The name of the product as declared on the label shall be "Tuna" or "Bonito" and may be preceded or followed by the common or usual name of the species in a manner not confusing or misleading to the consumer.
10.3.2.10.2 The name of the product labelled as "Tuna" shall be qualified or accompanied by a term descriptive of the representation in accordance with 10.3.1.7 and of the colour of the product provided that the term "white" shall be used only for the product of the meat of the tuna species
Thunnus alalunga that shall comply with the requirements of 7.1.4.2(a). The term "light" shall be used for a tuna product that corresponds to the colour designation as set out in 7.1.4.2(b). A tuna product that corresponds to a colour designation as set out in 7.1.4.3 shall be labelled as "dark".
Blends of tuna of different colour designation shall be specifically described in the title of the product. All colour designation terms qualifying "tuna" shall be in letters of at least the same size and prominence as "Tuna" or "Tunny".
The name "Albacore" when used for the labelling of tuna shall be reserved for the tuna species Thunnus alalunga and shall be coupled with "Tuna" or "Tunny" in letters of the same size and prominence.
10.3.2.10.3 Products consisting of the meat of Sarda spp. shall be labelled as "Bonito" and shall not be described as "Tuna" or any reference made to tuna.
10.3.2.11 Kabeljou shall be described only as "Kabeljou" or "Cape Cob
10.3.2.12 Canned salmon (see 7.1.6) is the product prepared from any of the species listed below, with the proviso that the common names in brackets may only be used in conjunction with the corresponding species names as follows:
Salmo salar - (Atlantic salmon, salmon);
Oncorhynchus nerke - (Sockeye salmon, red sockeye salmon, red salmon);
Oncorhynchus kisutch - (Coho salmon, silver salmon, medium red coho salmon);
Oncorhynchus tschawytscha - (Chinook salmon, spring salmon, king salmon);
Oncorhynchus gorbuscha - (Pink salmon, humpback salmon);
Oncorhynchus keta - (Chum salmon, keta salmon, dog salmon); and
Oncorhynchus masou - (Cherry salmon, Japanese or Masou salmon).
Tips, tails, minced and similar forms of canned salmon shall be labelled to disclose their true nature,
ail words qualifying the word "salmon" being in type of the same size and prominence as "Salmon".
The species Oncorhynchus gorbuscha - (Pink salmon, humpback salmon) is the only species that may be labelled "Pink Salmon". The colour of the fish flesh in the can may deviate from the characteristic pink colour provided
a) that the fish is from the abovementioned species,
b) that written verification from an authority in the country where the fish is canned is provided,
c) that there is no pictorial presentation depicting pink salmon on the label, and
d) if white fish is depicted in the pictorial presentation on the label it may not be labelled "Pink Salmon".
The colour of the fish flesh depicted in the pictorial presentation shall be a true reflection of the fish flesh colour of the contents. - Reference of the measure

- 2. (1) No person shall sell in the Republic of South Africa tomatoes, other than imported tomatoes referred to in subregulation (2), --
(iv) unless the tomatoes are marked with the particulars and in the manner prescribed in regulation 10.
Marking requirements
10. (1) Containers containing tomatoes destined for sale shall be marked in clear and legible block letters and numerals in a manner described in subregulation (5) with the following particulars:
(a) The name of the FBO or trademark and physical or postal address of either the producer or owner or importer or packer of the tomatoes packed in that container.
(b) The expression "Product of followed by the name of the country of origin of the tomatoes.
(c) The class, in the case of Class 1, Class 2, Class 3 and Lowest Class: Provided that additional to the class names the following names may be used:
Class 1 - First,
Class 2 - Select,
Class 3 - Standard,
Lowest Class - Budget.
(d) The size group of the tomatoes in the container, indicated as either minimum diameter and maximum diameter or as --
"Extra Large" or "XL",
"Large" or "L",
"Medium Plus" or "M+",
"Medium" or "M",
"Medium small" or MS
"Small" or "S" and Baby or Mini tomatoes: Provided that the size group indication may be omitted in the case of speciality types of tomatoes and tomatoes packed in the transparent plastic bags and punnets.
(e) The net mass of the contents as prescribed by the Trade Metrology Act, 1973 (Act No. 77 of 1973).
(f) The word "tomatoes", in the case of containers the contents of which are not visible from outside.
(2) If containers containing tomatoes are packed in a carrier container, each carrier container shall be marked with the particulars in subregulation (1), as well as with the number of containers it contains, on at least one end of every carrier container by means of stamping or stenciling or by pasting a printed label thereon.
(3) The particulars prescribed in subregulation (1) shall be indicated on the container by stamping, printing or by affixing a label thereon.
(4) Particulars shall be printed in English or both in English and any other official language:
Provided that internationally acknowledged symbols may be used.
(5) If at any stage the class or size designation should change the labels shall be replaced unless the new class or size designation is stamped across the old class or size designation, in clear legible block letters of at least 2 mm larger than the previous marks, with a suitable stamp.
(6) Each container containing tomatoes shall be provided with only one or more labels that shall be -
(a) intact, clean and neat;
(b) manufactured from paper or other suitable material; and
(c) affixed firmly to the container and in such a manner that re-stamping is possible without opening or damaging the container.
If classified tomatoes are displayed for sale in loose quantities -
(a) any quantity of a particular class, size group or cultivar shall not be displayed mixed with tomatoes of any other class, size group or cultivar;
(b) the class, size group and country of origin of the tomatoes shall be indicated in clear, legible block letters of at least 10mm on a notice board prominently placed at the quantity of tomatoes.
(8) Containers containing unclassified tomatoes shall be marked in clear and legible block
letters and also comply with subregulations 10(1)(a), (b), (e),and (f) and subregulations 10(2), (3), (4) and
(6).

11. No wording, illustration or other device of expression which constitutes a misrepresentation or which directly or by implication can create a misleading impression of the contents shall appear on a container containing tomatoes or on a label affixed thereto or which is displayed therewith. - Reference of the measure

- 10.3.3 True description of the contents of fish paste
Any fish named in the description of a fish paste shall be used in sufficient quantity to justify the use of the name. If only one variety of fish is named, the paste (except in the case of anchovy) shall contain at least 60 % by mass of that fish. Where two or more varieties are named, except where one variety is anchovy, the total quantities of the named fish shall be not less than 60 % by mass and the quantity of any one particular variety of fish named shall be not less than 15 % by mass. In the case of fish paste labelled anchovy, the anchovy content shall be not less than 30 % by mass. Where anchovy appears in the name of the product, the anchovy content shall be not less than 10 % by mass and the total quantities of the varieties of fish indicated in the name of the product shall be not less than 50 % by mass. In the case of fish pastes made from more than one variety of fish, the names of the varieties featuring in the title shall appear in the title in decreasing order of amounts by mass present. All types of fish used in the preparation shall appear in the list of ingredients in decreasing order of amounts by mass present. For the purpose of this subsection the term "fish" shall be deemed to include molluscs and/or crustacea, provided that the presence of molluscs andlor crustacea as a fish paste ingredient shall be specifically stated on the label. - Reference of the measure

Crab meat shall be prepared from any of the edible species of the sub-order Brachyura of the order Decapoda and all species of the family Lithodidae.
The name "Shrimp", "Shrimps" or "Prawns" shall only be used for the product prepared from species of the families Penaeidae, Pandalidae, Crangonidae, Palaemonidae.
"X Shrimp", "X Shrimps" or 'X Prawns" may be used where the " X is the name of a country or a geographic area from that the shrimps originate or the common name.

- 2(1) No person shall, subject to the provisions of subregulation (2), sell dried fruit for human consumption in the Republic of South Africa -
(e) unless such product is marked with the particulars and in the manner prescribed in regulation 8 and 9; and
(f) if such product is marked with particulars and in a manner so prescribed as particulars with which it shall not be marked.
Marking Requirements
8. (1) Information required by these regulations shall appear on containers and outer containers of dried fruit in letters -
(a) not less than 3 mm in height for a mass of more than 3 kg;
(b) not less than 2 mm in height for a mass of more than 250 g; or
(c) not less than 1 mm in height for a mass of 250 g or less.
(2) Containers of dried fruit shall be clearly and legibly marked in printed letters in at least English with the following particulars:
(a) The name and address of the packer of that dried fruit: Provided that in the case where it is not possible to use the physical address a postal address shall be used.
(b) The country of origin of dried fruit shall be declared on the label as follows:
(i) "Product of (name of country)" if all the main foodstuffs, processing and labour used to make the dried fruit product are from one specific country;
(ii) "Produced in (name of country)", "Processed in (name of country)", "Manufactured in (name of country)", "Made in (name of country)" or similar words when a dried fruit is processed in a second country which
changes its nature;
(iii) in the case where more than one country can be the origin, the words "Product of (name(s) of country(ies)" separated by the expression 'and/or'; or
(iv) the words "Packed in (name of country)" shall be used in addition to the requirement of paragraph (i) or (ii) above.
(c) A true description of the kind of product, type of fruit, the grade, cut style and the size group (if sized), shall be indicated on the main panel of a container: Provided that acceptable abbreviations shall be used to indicate the size group.
(d) In the case of preservative free dried fruit the expression "preservative free" and the grade designation "grade X preservative free" shall be indicated as a unit.
(e) Mixed colour dried fruit shall be marked with the expression "mixed colour' and mixed sizes shall be marked with the expression "mixed sizes" and with the two main sizes used.
(f) In the case of the dried fruit presented for sale in cut styles not prescribed by these regulations; be marked with the cut style in accordance with normal trade practice: Provided that abbreviations shall not be used and the words or expressions used to describe the cut style are not misleading.
(g) In the case of mixed dried fruit and dried fruit mixed with other foodstuffs, the product description shall be labelled as "dried fruit mix" or "dried fruit with the name of the added foodstuff": Provided that the dried fruit and foodstuff used shall be indicated in descending order of mass on the product description.
(h) In the case of vacuum-, freeze dried and dried fruit from any other drying method the words indicating the method of drying shall be marked on the main panel.
(3) The word "dried" may be omitted from the name of the dried fruit or true description of a dried fruit product if a dried fruit product is packed in a container or outer container of which a continuous portion of at least 25 percent of the area thereof is transparent;
(4) The date marking, production or lot (batch) shall be indicated on each container of dried fruit by a best before date preceded by the words "best before" or "BB": Provided that the best before date may be used as a production or batch identification.
(5) The Food Business Operator Code (FBOC) which is registered with the Executive Officer shall be indicated on each container: Provided that it shall be preceded by "FBOC" or "FBO" followed by the allocated code or the code shall be indicated at the end of the batch code.
(6) The net mass and the height thereof shall be indicated in accordance with the Trade Metrology Act, 1973 (Act No. 77 of 1973).
(7) In the case of outer containers, at least particulars prescribed in subregulations (2)(a)(b)(c)(h) ; and regulations 8 (4 ) to (6) of marking requirements shall be indicated.
(8) In the case of a non conformance on marking requirements after an official inspection; a supplementary label containing the information set out in subregulations (1) to (5) may be used to cover the incorrect information, instead of relabeling or repacking.
(9) Besides the requirements of these regulations containers and outer containers of dried fruit shall also comply with the requirements of the regulations published under the Foodstuffs, Cosmetics and Disinfectant Act, 1972 (Act No. 54 of 1972).
Restricted Particulars on Containers and Outer Containers
9. (1) The words "dried fruit mix", "dried fruit" or the name of a fruit which refers directly or by implication to any kind of dried fruit shall not appear on a container containing less than 55% (m/m) dried fruit.
(2) No word, registered trade mark, brand name, mark, illustration, depiction or other method of expression that either directly or by implication constitutes a misrepresentation or creates or shall create a misleading impression regarding the contents, quality, origin, grade or size group of the dried fruit in a container, shall be indicated on a container or on an outer container containing such containers.
(3) The word "organic" shall not be indicated on a container or outer container of dried fruit unless the dried fruit was produced, processed and handled in compliance with organic standards and certified by a certification body or authority.
(4) No claim regarding the absence of any substance that does not normally occur in dried fruit shall be marked on the container or outer container of such dried fruit product except in cases where it is allowed in terms of the requirements of the Foodstuffs, Cosmetics and Disinfectant Act, 1972 (Act No. 54 of 1972). - Reference of the measure

7. (1) Subject to the provisions of regulation 8, information required to appear on any label shall be-

Marking requirements
8. (1) Containers containing classified garlic destined for sale, shall be marked in clear and legible block letters of at least 5 mm in height with the following particulars:
(a) The name and address or trade mark of the producer, owner, packer and/or local dispatcher.
(b) The expression “Product of” followed by the name of the country of origin of the garlic.
(c) The class, in the case of Class 1 and Class 2.
(d) The size group of the garlic in the container, indicated as a minimum diameter and maximum diameter
(e) The net mass of the contents, in letters of a size as prescribed by the Trade Metrology Act, 1973 (Act No. 77 of 1973).
(f) The word "garlic", in the case of containers the contents of which are not visible from outside
(g)If containers is packed in a carrier container each carrier container shall be marked with the particulars set out in subitem (1), as well as with the number of container it contains and its contents, on at least one end of every carrier container by means of stamping or printing or by pasting a printed label thereon.
(2) The particulars prescribed in subregulation ( 1) shall be indicated on the container or on a label affixed to the container.
(3) Particulars shall be printed in English or both in English and any of the other official languages.
(4) If at any stage the class or size designation should change the labels shall be replaced unless the new class or size designation is stamped in red ink across the old class or size designation, in clear legible block letters of at least 2 mm larger than the previous marks, with a suitable stamp.
(5) Any labels shall be firmly affixed to each container. If more than one label is used, the markings on different labels shall not be contradictory.
(6) Each container containing garlic shall be provided with one or more labels that shall be (a) intact, clean and neat;
(a) manufactured from manilla paper or other suitable material; and
(c) affixed f m l y to the container and in such a manner that re-stamping is possible without opening or damaging the container.
(7) If classified garlic is displayed for sale in loose quantities- -
(a) any quantity of a particular class, a size group or a cultivar shall not be displayed mixed with garlic of any other class, size group or cultivar; and
(b) the class, size group and country of origin of such garlic shall be indicated in clear, legible block letters of at least 10 mm in height on a notice board prominently placed at such a quantity of garlic.
(8) Containers containing unclassified garlic destined for sale, shall be marked in clear and legible block letters of at least 5 mm in height with the name and address of the producer or owner and with the expression
“Unclassified garlic”.

9. No wording, illustration or other device of expression which constitutes a misrepresentation or which directly or by implication can create a misleading impression of the contents shall appear on a container containing garlic or on a label affixed thereto or which is displayed therewith. - Reference of the measure

6. (1) Subject to the provisions of subregulation (9), the main panel of each container containing Edible Ices, excluding the class Soft Serve, shall be marked with the following particulars at least in English:
Class designation
(a) The applicable class designation or alternative class designation as specified in columns 2 and 3 of Table 2 and Table 3: Provided that --
(i) in the case of --
(aa) the classes Frozen Fruit Sorbet and Frozen Fruit Ice , the word "Fruit" may be substituted by the name(s) of the specific fruit(s) used; and
(bb) the class Flavoured Ice, the word "Flavoured" shall be preceded by the name(s) of the specific fruit(s) and/or flavouring(s) used;
(ii) an altered word sequence of the class designation or alternative class designation is permissible on condition that the altered word sequence does not constitute a misrepresentation, or not directly or by implication create or may create a misleading impression regarding the quality, nature, origin or composition of the product concerned; and
(iii) no word or expression may be bigger than the class designation or alternative class designation unless it is a registered trade mark or brand name.
Additions to the class designation
(b) The applicable additions to the class designation or alternative class designation:
(i) If a flavouring has been added to Edible Ices in order to render a distinctive flavour thereto, the applicable class designation or alternative class designation shall either be preceded by the expression "X Flavoured" or followed by the expression "with X Flavour" or "with X Flavouring", where "X" indicates the name(s) of the flavouring(s) used, unless the flavouring concerned has been added with the intention to enhance the flavour of the fruit or added foodstuff concerned.
(ii) If lactic acid and yoghurt flavouring, instead of real yoghurt, have been added to the class Dairy Ice-cream, Ice-cream, Frozen Dairy Dessert, Frozen Dessert or Soft Serve, the applicable class designation or alternative class designation shall either be preceded by the expression "Yoghurt Flavoured" or followed by the expression "with Yoghurt Flavour" or 'with Yoghurt Flavouring".
(iii) If a foodstuff has been added to Edible Ices in order to render a distinctive taste thereto -
(aa) the applicable class designation or alternative class designation shall be followed by the expression "with X", or wording having a similar meaning, where "X" indicates the generic name(s) of the foodstuff(s) added (e.g. "with chocolate pieces", "with choc-chip cookies", "with pineapple and mango pieces", etc); or
(bb) the applicable class designation or alternative class designation shall be preceded by the generic name(s) of the foodstuff(s) added (e.g. "choc-chip cookies ice -cream ", "mango and peach frozen yoghurt", etc.); and
(cc) the requirements on Quantitative Ingredient Declarations (QUID), as specified in the regulations published under the Foodstuffs, Cosmetics and Disinfects Act, 1972 (Act No. 54 of 1972), shall be complied with.
The expression "pasteurised"
(c) The expression "Pasteurised" in the case where -
(i) Frozen Yoghurt has been pasteurised after fermentation; and
(ii) blends of yoghurt and either dairy ice-cream mix or ice-cream mix has been pasteurised.
The expression "contains no live cultures"
(d) The expression "contains no live cultures", "contains no live micro-organisms", or wording having a similar meaning, in close proximity to the class designation or alternative class designation, in the case where -
(i) Frozen Yoghurt has been pasteurised after fermentation; and
(ii) blends of yoghurt and either dairy ice-cream mix or ice-cream mix has been pasteurised.
(2) Subject to the provisions of subregulation (9), each container containing Edible Ices, excluding the class Soft Serve, shall either on the main panel or on any other conspicuous place thereon, be marked with the following particulars at least in English:
Name and address
(a) The name and address of the manufacturer, packer, importer, seller or person or entity on whose behalf the product has been packed in a letter size of at least 1 mm in height.
Country of origin
(b) The country of origin which shall be declared on the label as follows in a letter size of at least 1 mm in height:
(i) "Product of (name of country)" if all the main ingredients, processing and labour used to make the product are from one specific country;
(ii) "Produced in (name of country)", "Processed in (name of country)", "Manufactured in (name of country)", "Made in (name of country)", or wording having a similar meaning, when the product is processed in a
second country which changes its nature; or
(iii) In the case where single ingredient agricultural commodities are imported in bulk and where owing to climatic, seasonal or other contingencies more than one country may be the source of the single ingredient
agricultural commodity, the wording 'Product of (name(s) of country(ies))' separated by the expression 'and/or', shall be declared on the label of the final pre-packed foodstuff: Provided that the final end product remains a
single ingredient agricultural commodity: Provided further that the words "Packed in (name of country)" may be used in addition to the requirements of subparagraph (i) or (ii) above.

(c) The net mass or volume of the Edible Ices packed therein as required in terms of the Trade Metrology Act, 1 973 (Act No. 77 of 1973): Provided that the letter sizes of such indications shall comply with the requirements of the Trade Metrology Act, 1973 (Act No. 77 of 1973).
Individual units packed in multipacks
(3) In the case where individual un its are packed in a multipack, only the particulars prescribed in subregulations (1)(a), (1)(b), (2)(a) and (8) need be indicated on the containers containing the individual units: Provided that such individual units may not be sold loose.
Multipacks
(4) In the case of a multipack, at least the following marking requirements shall be indicated on the multipack:
(a) The particulars prescribed in subregulations (1) and (2); and
(b) The number of containers (individual units) contained therein as required in terms of the Trade Metrology Act, 1973 (Act No. 77 of 1973).
Outer containers
(5) In the case of an outer container, at least the following marking requirements shall be indicated on the outer container:
(a) The particulars prescribed in subregulations (1)(a), (2)(a) en (2)(b); and
(b) The number of containers (individual units) or multipacks contained therein as required in terms of the Trade Metrology Act, 1973 (Act No. 77 of 1973).
Soft Serve dispensing machines
(6) The class designation "Soft Serve" shall be indicated conspicuously on each soft serve dispensing machine where Soft Serve is sold in single serve portions.
Single serve portions
(7) In the case of Edible Ices, excluding the class Soft Serve, sold in single serve portions, the applicable class designation or alternative class designation shall be indicated conspicuously on either the immediate container in which it is displayed, or on the display freezer unit itself.
Ingredients list
(8) The ingredients list shall be indicated in the manner prescribed in the regulations published under the Foodstuffs, Cosmetics and Disinfectants Act, 1972 (Act No. 54 of 1972) in a letter size of at least 1 mm in height.
(9) The particulars referred to in subregulations (1) to (8) shall be indicated in detached letters and figures --
(a) that are clearly legible;
(b) that are of the same type;
(c) that appear on a contrasting background; and
(d) of which the minimum vertical height is 3 mm, except where otherwise indicated and in the case of subregulations (6) and (7) where a minimum letter size of 50 mm is required: Provided that --
the minimum vertical height shall be applicable to the smallest letter or figure in the indications; and
(ii) if the letter size of the additions to the class designation or alternative class designation, as required in subregulation (1)(b), differs in size from letter size of the class designation or alternative class designation
indication, the difference in size between the smallest and the largest letter shall not exceed 3 mm. Restricted particulars on containers, multipacks and outer containers
7. (1) (a) No class designation other than the applicable class designation or alternative class designation shall be marked on a container, multipack or outer container.
(b) No word or expression which so nearly resembles the class designation or alternative class designation of a product that it could be misleading with regard to the composition shall be marked on the container, multipack or outer container.
(2) Depictions or illustrations of the specific fruit(s) added to or used in the manufacturing of Edible Ices shall only be allowed if the product concerned contains at least 6% (m/m) or more fruit: Provided that depictions or illustrations of any other ingredient(s) emphasised on a container, multipack or outer container shall only be allowed if the requirements on Quantitave Ingredient Declarations (QUID), as specified in the regulations published under the Foodstuffs, Cosmetics and Disinfects Act, 1972 (Act No. 54 of 1972), have been complied with.
(3) No word, mark, illustration, depiction or any other method of expression that constitutes a misrepresentation or directly or by implication creates or may create a misleading impression regarding the quality, nature, class, origin or composition of Edible Ices shall be marked on a container, multipack or outer container.
(4) No registered trade mark or brand name which may possibly, directly or by implication, be misleading or create a false impression of the contents of a container, multipack or outer container containing Edible Ices, shall appear on such a container, multipack or outer container.
(5) No claim regarding the absence of any substance that does not normally occur in Edible Ices shall be marked on the container, multipack or outer container thereof except in cases where it is allowed for in the regulations published under the Foodstuffs, Cosmetics and Disinfectants Act, 1972 (Act No. 54 of 1972).
(6) (a) The words "fresh", "freshly", "natural", "nature's", "pure", "traditional", "original", "authentic", "real", "genuine", "home made", "selected", "premium", "finest", "quality" or "best", or any other words, statements, phrases, logos or expressions having a similar meaning, whether directly or by implication, shall not appear on a
container, multipack or outer container of an Edible Ice product unless the criteria on the use of such terms, as set out in the guidance notes compiled by the United Kingdom's Food Standard Agency, have been complied with. The latest version of these guidance notes is available on the Department's website or may be obtained directly from the office of the Executive Officer.
(b) Registered trade marks or brand names bearing the words, statements, phrases, logos or expressions referred to in paragraph (a) and which have been in use on containers, multipacks or outer containers containing Edible Ices prior to the publication of these regulations, shall not be subject to these restrictions.
(7) No claim which compares the total fat, saturated fat, cholesterol, sugar, sodium or salt, or energy value of two or more similar Edible Ices by using words such as "reduced", "less than", "fewer", "light" and "lite", or words having a similar meaning, shall be made on the container, multipack or outer container thereof, unless the following conditions are complied with:
(a) The Edible Ice product shall be compared with a different version of the same or similar product.
(b) The Edible Ice product being compared shall be clearly marked on the container and multipack with the following information:
(i) A statement of the amount of difference in the energy value or relevant nutrient content, expressed as a percentage.
(ii) The identity of the Edible Ice product(s) to which it is being compared in close proximity to or as part of the comparative claim.
(c) The comparison shall be based on a relative difference of at least 25% in the energy value or nutrient content of an equivalent mass or volume.
(d) The Edible Ice product shall be marked with the prescribed nutritional information declaration required in terrors of the regulations published under the Foodstuffs, Cosmetics and Disinfects Act, 1972 (Act No. 54 of 1972).
(8) The provisions of this regulation shall mutatis mutandis apply to-
(a) particulars that are marked on a soft serve dispensing machine in the case of the class Soft Serve;
(b) particulars that are marked on the container or the display freezer unit in the case of Edible Ices, excluding the class Soft Serve, sold in single serve portions;
(c) particulars that are marked on a notice board displayed at or in the immediate vicinity of Edible Ices that are kept or displayed for sale; and (d) all advertisements for Edible Ices. - Reference of the measure

- 3. (1) No person shall sell groundnuts in the Republic of South Africa-
(c) unless the groundnuts are packed and marked in accordance with the packing requirements set out in regulations 8, 9 and 10.
8. (1) All containers that contain groundnuts shall be marked clearly and legibly on each container or on a label that is affixed thereto with the following particulars:
(a) The name and address of the owner.
(b) The processor's code that have been approved by the executive officer in writing on request of the processor (Imported groundnuts are excluded).
(c) The net mass of the contents as prescribed in terms of the Trade metrology Act, 1973 (Act No. 77 of 1973).
(d) The class, grade and count of the contents: Provided that these may be indicated by means of a series of symbols as set out in subitem (3), in the sequence of class, grade and where applicable, the count.
(e) The lot number of the consignment concerned.
(f) The country of origin.
(2) All containers that contain groundnuts which exceed the prescribed maximum total aflatoxin level as permitted in terms of Foodstuffs, Cosmetics and Disinfectants Act, 1972 (Act No. 54 of 1972), should be clearly indicated that such groundnuts are not intended for direct human consumption.
(3) The symbols as mentioned in subitem (1 )(d) for the different -
(a) classes are:
(i) A in the case of groundnuts classified as Class A;
(ii) B in the case of groundnuts classified as Class B;
(iii) C in the case of groundnuts classified as Class C;
(iv) D in the case of groundnuts classified as Class D; and
(v) E in the case of groundnuts classified as Class E.
(b) grades are:
(i) K in the case of groundnuts graded as Choice Grade;
(ii) S in the case of groundnuts graded as Standard Grade;
