Labels of designated products to be approved
12. (1) No person shall market any designated product unless the label thereof has been approved by the Committee in terms of section 13.
(2) Subsection (1) shall not apply in relation to any designated product which was manufactured and covered, enclosed or packed in its container before the date of commencement of these regulations.
(3) In any prosecution for an offence in terms of subsection (1), the burden of proving that the designated product concerned was manufactured and covered, enclosed or packed in its container before the date of commencement of these regulations shall lie upon the person charged.
Screening of labels by Committee
13. (1) Any person who wishes the Committee to approve any label may apply in writing for such approval to the Committee at the offices of the Nutrition' Unit of the Ministry of Health and Child Welfare, and shall submit with his application a specimen of the label concerned.
(2) Within thirty days after receiving an application in terms of subsection (1), the Committee shall examine the label concerned and may choose to:
(a) approve it, either absolutely or subject to conditions; or (b) refuse to approve it;
and shall notify the .applicant in writing of its decision and, where it has refused to approve a label, of its reasons.
(3) The Committee shall not, in terms of subsection (2), approve the label of a designated product unless-
(a) it is as simple and as clear as possible in Shona, English and Ndebele; and
(b) the Committee is satisfied that it provides sufficient information about the appropriate use of the product and that it does not-discourage breast-feeding; and
(c) the Committee is satisfied that the label adequately specifies-
(i) the ingredients used; and
(ii) the composition and nutrient content or analysis of the product; and
(iii) the storage conditions required for the product; and
(iv) the batch number; and
(v) the date before which the product should be consumed under specified storage conditions and presented in manner stipulated in accordance with the Foods and Foods Standard Act [Chapter 15:04]; and
(vi) that the designated product is supplementary to breast-milk; and
(vii) the appropriate age of introduction; and
(viii) prominently and in bold, conspicuous, non-serif characters of not less than ten-point size, in black against a white background, that "Breast-milk is the best food for your baby. It protects against diarrhoea and other illnesses."; and
(ix) the manufacturer's name and physical address; and
(d) in the case of a designated product which does not meet all the requirements for infant formula but which can be modified to do so, the Committee is satisfied-
(i) that the label carries a clear and adequate warning that the unmodified product should not be the sole source of nourishment for a baby; and
(ii) where the label carries instructions for modifying the product into infant formula or ether breast- milk substitute, the label, complies with the requirements specified for labels of infant formula or other breast-milk substitutes; and
(e) in the case of a cereal marketed as a complementary food, the label carries an exhortation to continue breast- feeding a child upto two years and beyond; and
(f) the Committee is satisfied that-
(i) the label, or the portion thereof that bears the matter specified in subparagraph (ii) will be printed on the container or will not be easily separable therefrom; and
(ii) the following matter is clearly printed in black against a white background on the label and in an understandable form-
A.the words "Important Notice" in bold characters of not less than ten-point size in black against a white background; and
B.a statement on the superiority of breast- feeding; and
C. a statement that the designated product should be used only after seeking the advice of a health worker as to the need for and proper use of the product; and
D.instructions for its proper preparations; and
E. a warning concerning the health and other hazards of improper preparations;
and
(iii) the label does not bear pictures of infants; and (iv) the terms "humanized", "maternalized" and similar terms are not used; and
(v) having regard to the designated product concerned, the label bears, as may be appropriate, a prominent notice in bold, conspicuous, non-serif characters of not less than eight-point size black against a white background stating "To avoid illness of your baby, follow the preparation instructions carefully. Do not use more or less quantities than indicated. Cup feeding is safer than bottle feeding. If you use a feeding bottle, your baby may reject the breast." and
(vi) in the case of infant formula, the label indicates the number of containers necessary to feed a baby during the first six months of life exclusively on the infant; and
(g) in the case of feeding articles and pacifiers, the label bears a notice in bold conspicuous characters of not less than eight-point size in black against a white background stating, as may be appropriate that "The use of a feeding bottle/feeding cup/pacifier interferes with breastfeeding."
Appeals against decisions of Committee
14. (1) Any person who is aggrieved by a refusal of the Committee or by any conditions imposed by the Committee in terms of section 11 may appeal in writing to the Minister within thirty days of being notified by the Committee of its decision.
(2) On any appeal being made to him in terms of subsection (1), the Minister, after making such inquiry into the matter as he deems necessary, may-
(a) uphold the decision appealed against; or
(b) set aside the decision' appealed against in whole or in part and make such decision in its place as he thinks appropriate;
and any such decision of the Minister shall, for the purposes of these regulations, be deemed to be the decision of the Committee .
(3) The decision of the Minister in terms of subsection (2) shall be made within ninety days of the date of the appeal.
Requirements for labels of sweetened condensed milk, and dried skimmed milk, evaporated milk, whole cows milk or low fat milk
15. (1) No person shall market any sweetened condensed milk, dried skimmed milk, evaporated milk, whole cows milk or low fat milk the label of which contains purported instructions on how to modify the milk concerned for use as-
(a) an infant food; or
(b) as an ingredient of infant formula.
(2) The label of every container of –
(a) any sweetened, condensed , dried, skimmed, evaporated or low fat, milk shall bear a notice, as specified in the Schedule, in eighteen –point bold upper case non-serif characters in black against a white background and inside borders stating “Unfit for babies” as well as the same statement in vernacular (read annex on Labels);
(b) any whole cow’s milk shall bear a notice, as specified in the Schedule, in eighteen –point bold upper case non-serif characters in black against a white background and inside borders stating “Unfit for babies unless modified in accordance with the advice of a health practitioner or a nutritionist”.
(3) This section shall be additional to, and not in substitution for the requirements of any other enactment relating to the labeling of food and dairy produce. - Reference of the measure

- 9.(1) For the purposes of section 8 of the Act and subject to the provisions of this section ,the container in which the farm feed is sold shall be durable and legibly marked or labelled in English or an of the vernacular languages with-
(a) the brand name under which the farm feed is registered ; and
(b) the particulars specified in the Second Schedule , the numeric values of which shall be the same as the relevant information contained in the application for registration; and if desired the name and address of the person in whose name such feed is registered may be similarly given.
(2) In the case of protein concentrate feeds, the label shall bear a statement of the proportions in which it is recommended that the concentrates shall be fed with the grain meal.
(3) In the case of poultry mashes, the label shall state whether the feed is intended for feeding with or without scratch grain.
(4) Where a farm feed contains urea, biuret ,antibiotic , drugs or hormones the label shall if required by the registering officer in terms of section 4(4) of the Act, as a condition of registration bear-
(a) a statement giving instructions for use, and
(b) an appropriate warning
(5) Where a label or inscription upon a container claims a content of any constituent ,other than those set out in the Second Schedule , the content shall be registered and in the case of –
(a) inorganic constituents, the elemental content shall be stated except for salt where the maximum percentage, expressed as NaC1 shall be stated; and (b) added vitamins, antibiotics, drugs, and hormones, the content of the of the active constituent shall be stated; an shall be used at the levels accepted by the Medicines Control Authority of Zimbabwe and the Registration number of the shall be quoted on the application for registration.
(6) Any commercial bags should bear a registration number of the feed under consideration.

(1) whisky shall be potable alcoholic distillate obtained from a mash of cereal grain or cereal grain products saccharified by the diastase of malt or other enzyme and fermented by the action of yeast and aged in small wood
(2) blended whisky, shall be so described on the label, may be produced from a blend of whisky and neutral sprit.
(3) whisky and blended whisky may contain a flavouring or caramel
(4) no person shall make any claim with respect to the age of whisky other than the period during which the whisky has been stored and aged in small wood for at least three years:
Provided that any period not exceeding six months during which such whisky was held in other containers may be claimed as age.
(5) blended whisky may be described as containing whisky of a particular age ; provided that such age is assessed in the manner referred to in subsection (4)
(6) scotch whisky shall be whisky distilled in Scotland as Scotch whisky for domestic consumption in accordance with the laws of the United Kingdom
(7) Irish whiskey shall be whiskey distilled in the United Kingdom or in the Republic of Ireland as Irish whiskey for domestic consumption in accordance with the laws of the United Kingdom or the Republic of Ireland
(8) Canadian whiskey , Canadian rye whiskey or rye whisky shall be whisky distilled in Canada as Canadian whisky for domestic consumption in accordance with the laws of Canada

- 13. Brandy
(1) brandy-
(a) shall be a potable alcoholic distillate obtained by the distillation of wine which is itself produced from grapes in terms of section 5;
(b) may contain caramel and may be blended with fruit or other botanical substances flavourings
(2) no person shall make any claim with respect to the age of brandy other than the period during which such brandy has been stored and aged in small wood for at least three years provided that any period not exceeding six months during which such brandy was held in other containers may be claimed as age.
(3) Cognac brandy or Cognac shall be brandy manufactured in the Cognac district of France for domestic consumption in accordance with the laws of the Republic of France.
(4) Armagnac brandy or Armagnac shall be brandy manufactured in the Armagnac district of France for domestic consumption in accordance with the laws of the Republic of France.
(5) imported brandy shall be a potable distillate obtained by the distillation of wine manufactured in accordance with the laws of the country of origin for domestic consumption and the label shall clearly state such country origin.
Provided that where such brandy is blended, prior to bottling with locally produced ingredients such label shall state that the brandy is product of Zimbabwe

- 7. -(1) No imported food shall be removed out of the customs area before it is inspected or examined as the case may be and certified as fit for human consumption in writing by the inspector.
(2) Before its arrival or soon after, the food importer or captain of the vessel or his agents shall give the inspector a copy of food cargo manifest stating the kind and amount of food packaging unit used and the name of country of origin.
(3) Any importer of food shall ensure that the imported food is labelled in Kiswahili or English or both
(4) Any other language may be used in labelling of food provided that language is used together with Kiswahili or English or both.
(5) Each imported food consignment shall be accompanied by a health certificate issued by a competent authority in the country of origin acceptable to the authority showing-
(a) That the food is fit for human consumption at the time of exportation; and
(b) that it meets the standards prescribed for it by the food control authority of the country of origin stating such standards.
Taking of samples
8-(1) any inspector who has procured or taken a sample of imported food shall as soon as he receives the results of the analysis inform the customs officer of his decision regarding the facts of the imported food and both the inspector and customs officer, where necessary work in co-operation to effect the decision, that is to release or order for re-exportation of the food to the country of origin or dispose off as the case may be as soon as reasonably possible.
(2) Cost of re-exportation or disposal of food found unfit for human consumption or inspection at port of entry shall be borne by the importer of that food.
Certification of food exports
9-(1) When deemed necessary or upon request from an exporter of food or importing country, the authority shall issue a health certificate to accompany food exports.
(2) The authority shall issue health certificate if it is satisfied that-
(a) The food has been registered and manufactured under licence issued by it or the food consignment has been inspected and found in compliance with specifications prescribed by it;
( b) the food does not contravene any provisions of the Tanzania food drugs and cosmetics act,2013 or registered made there under.
(3) The authority may withdraw, cancel or suspend any heath certificate issued by it if it is discovered that false information was given in obtaining the health certificate.
10. A person who seeks or obtain services rendered under these regulations shall be charged fees as provided for under the fees and charges regulations made under this Act. - Reference of the measure

- 17-(1) Labeling and marking of infant formula and supplementary foods shall be in accordance with Tanzania standard 187 and Tanzania standard 180 respectively.
(2) Labels and marks on any infant formula shall include the following information in kiswhili, English and any other language where the product is marketed-
(a) Name of the products that is infact formula and trade name or brand name;
(b) Name and address of the manufacturer or licensed packer;
(c) Batch or code number;
(d) Net content by mass/volume;
(e) List of ingredients with the average content of each nutrient indicated in descending order of proportion;
(f) Protein source and the proportion of saturated and unsaturated farry acids;
(g) The average content of each nutrient;
(h) Directions for storing the unopened container and special directions after the container has been opened.
(i) An indication., with a print letter not less than 5 mm that infant formula is not intended to replace breast feeding but is a complement where breast feeding is insufficient;
(j) The words “ IMPORTANT NOTICE” or their equivalent, directing on how to prepare and use the formula for consumption and shall include:
(i) A statement of the superiority breast feeding;
(ii) A statement that the product shall be used only on the advice of a doctor or health worker;
(iii) Instruction and a warning against the health hazard of inappropriate proportion;
(iv) A statement that infants shall be fed only with cup and or spoon;
(v) Advisory note that infants over 6 months of age should require supplementary foods in addition to the formula.
(vi) Date of manufacturer and expirely to be printed in a tamper proof on the container;
(vii) Country of origin
