  Description of the measure

  14(1) The Director or any administrative officer or inspector may enter any land, building, shed, place, carriage, van, truck, motor vehicle, aircraft, boat, or lighter containing or carrying, or having been used for the purpose of containing or carrying—
  (i) animals, and may examine the same and any animals found therein for the purpose of ascertaining whether any such animal is infected by a notifiable disease or for the purpose of ascertaining whether the provisions of this Act in respect of the cleansing and disinfection of such building, shed, place, carriage, van, truck, motor vehicle, aircraft,boat or lighter have been properly carried out; and
  (ii) meat, carcasses, hides or any article manufactured from the product of any animal, and may examine the same for evidence of notifiable disease or for the purpose of ascertaining whether the provisions of this Act in respect of the cleansing and disinfection of such building, shed, place, carriage, van, truck, motor vehicle, aircraft, boat or lighter have been properly carried out.
  (2) Whenever such an inspection is carried out under this section, the owner or occupier of the aforesaid land, building, shed, place, carriage, van, truck, motor vehicle, aircraft, boat or lighter shall render such reasonable assistance as may be required of him by the officer carrying out the inspection. Any owner or occupier who refuses or fails to render such reasonable assistance as may be so required of him shall be guilty of an offence.

  Description of the measure

  (2) Whenever such an inspection is carried out under this section, the owner or occupier of the aforesaid land, building, shed, place, carriage, van, truck, motor vehicle, aircraft, boat or lighter shall render such reasonable assistance as may be required of him by the officer carrying out the inspection. Any owner or occupier who refuses or fails to render such reasonable assistance as may be so required of him shall be guilty of an offence.

  Description of the measure

  26. (1) Upon receipt of an application, the Authority shall screen the application for completeness and shall, within thirty days from the date of receipt, acknowledge receipt of the application in writing.
  (2) Where an application is not complete, the Authority shall request the applicant to submit additional information.
  (3) Where the Authority requests for additional information from the applicant,the time taken before getting the information shall not be reckoned by the Authority in calculating the time taken prior to making a final decision on the application.
  27 (1) Where the application for approval under this Act has been screened and found to be complete, the Authority shall—
  (a) subject to section 28, undertake a risk assessment in terms of the provisions of the Fifth Schedule; and
  (b) audit risk assessment information submitted by the applicant, if any. (2) Risk assessment under this section shall be carried out taking into account available information concerning any known risk posed by potential exposure to a genetically modified organism.
  (3) Upon completion of the risk assessment, the Authority shall make a report of its findings, and shall indicate any measures to be taken to ensure the safe use of a genetically modified organism.
  (4) The Authority shall liaise with the appropriate regulatory agency to ensure that appropriate measures are in place to manage and control risks identified during the risk assessment process.

  Description of the measure

  5. All birds imported from overseas shall be subjected to examination on board ship by an inspecting officer at the time of importation, and no birds shall be moved from the place appointed for examination by the inspecting officer except with the written consent of that officer.
  6. The inspecting officer shall satisfy himself, after due inquiry, that the birds imported have not during the voyage either been in contact with any animal which would be likely to spread disease or been exposed to any other infection.
  7. The importer shall satisfy the inspecting officer that no fodder or foodstuff likely to cause disease have been taken on board and have been in contact with the birds imported, and no fodder, foodstuffs or equipment shall be landed from the ship except such as are approved by the inspecting officer acting in accordance with instructions from the Director.
  8. The inspecting officer may cause all birds imported to be inoculated, dipped, disinfected, sprayed or otherwise treated before a permit for movement is issued from the place of detention.

  Description of the measure

  6. (1) An authorized officer may, for the purpose of the Act or these regulations, enter and inspect any premises, boat, vessel, transport vehicle, reefer container, warehouse or cold storage facility where the fish or fish product is stored.
  (2) On arrival of the consignment, the registered person, importer or his agent shall –
  (a) notify the authorized officer of the date of arrival of the consignment at least 48 hours in advance;
  (b) submit relevant import documents for verification;
  (c) request for an inspection at the port of entry; and
  (d) make arrangement for inspection of the consignment at the port of entry.
  (3) The importer shall ensure that the consignment of fish, or fish product, is not removed from the port before it is inspected and approved by an authorized officer.
  (4) Any consignment of fish or fish product, landed at the port of entry, shall be inspected in the presence of the importer or his agent.
  (5) Where an inspection is being carried out, the authorized officer may –
  (a) require the importer to produce any document in relation to the business;
  (b) check the whole consignment, or parts thereof, as may be deemed appropriate;
  (c) open as many boxes, containers or packages as he may deem fit;
  (d) collect appropriate number of samples for identification and laboratory analysis.

  27. Examination of whole consignment
  (1) Where the authorised officer is of the opinion that a whole consignment needs to be examined, the Comptroller of Customs shall release the whole consignment whenever requested to do so by the authorised officer.
  (2) Where the whole consignment is released under paragraph (1), it shall be sealed before its release by the authorised officer.
  (3) The importer shall at his expenses cause the whole consignment to be transported to a place determined by the authorised officer.
  (4) The importer shall allow the authorised officer to have access to the whole consignment within reasonable working hours for the purpose of examining the consignment.
  (5) Where the food has been found to be fit for human consumption, the authorized officer may, in writing, allow the importer to distribute the consigned food.
  (6) Where the food has been found to be unfit for human consumption, the
  authorised officer shall proceed in accordance with section (5) (2) (b) of the Food
  Act.

  12. Power to enter and examine
  An inspector may enter any land, building, shed, place, carriage, van, truck, other vehicle, vessel or aircraft containing or carrying or used for the purpose of containing or carrying animals, and may examine any animals found therein, for the purpose of ascertaining whether any such animal is suffering from disease or for the purpose of ascertaining whether any rules, orders, or directions as to cleansing and disinfecting, made under this Act, and for the time being in force, have been properly carried out.

  Description of the measure

  Article 4: Imported food will be subject, in origin, to compulsorily inspection and quality testing, at the seller's expenses, and these tests shall be made by firms or entities with recognized skills and qualified for such activities.
  Article 5: In all the cases, inspection certificates on food quality shall be issued, according to Article 4, in addition to the certificate of origin or other required documents.
  Article 6: It is reserved, in accordance to the purchase agreement, the right of the importing entity to carry out inspection and analyses at the embarkation or other point agreed by the parties, to the food to be purchased, and the expenses can be shared by both parties, according to agreed contractual conditions.
  Article 7(1): Copies of the documents referred to in Article 5 shall be sent by the seller, by air, as a registered mail, to the importer, without prejudice to other obligations stated in the purchase and sale agreements.
  Article 7(2): Such documentation must be in the importer's possession before the arrival of goods.
  Article 8: The obligations under Articles 5 and 7 shall be mentioned in the purchase agreement.
  Article 9: Seller shall, upon request by the importer, send a quality certificate of the additives used in the product, accompanied by a declaration that they have passed the food purity test.
  Article 10: Imported food shall be mandatorily inspected by Health and Agricultural Services, and may eventually be subjected to control analysis, according to the inspection decision, upon disembarkation at ports or airports or when crossing the border.
  Article 11: The inspection at the country's entry point is extended to the means of transport and shall comply with the requirements set out by the Ministerial Decree 51/84 of 3 October.

  1. Fishery products imported, whose weight exceeds 50 kg, shall be subject to a sanitary license to be issued by the Competent Authority for its commercialization in national territory - and the respective copy be sent to the Ministry of Health
  2. Fishery products importers must apply for the inspection in appropriate time in order to get the Health License, through the model in Annex VI (Request for Health License) duly completed and accompanied by "health certificate", "certificate of origin ", and original and copy of the single document.
  3. At the date of arrival of the import batch, importers shall submit the notice of arrival of the goods in order to proceed to their inspection and issuance of sanitary license requested

  Meat from animals slaughtered in the district, as well as imported meat, fresh meat or preserved by refrigeration, salting, smoking or any other method apart from canning are subject to sanitary inspection.

  Imported fresh meat shall be subject to inspection within two (2) hours of their entry.
  
  Article 11: Sale of meat
  All meat from animals slaughtered on the spot, all imported fresh meat to be offered for sale on the day following that of the slaughter or import into the village, shall be subject to veterinary inspection before the sale.
