- 4(1) No person shall import into Zimbabwe, any substances listed and equipment or appliance which uses or whose function relies on the substances listed in the Second Schedule.
(2) Any person who contravenes subsection (1) shall be guilty of an offence and liable to a fine not exceeding level fourteen or imprisonment for a period not exceeding twelve months or both such fine and such imprisonment.
(3)In addition, the court convicting a person of an offence under subsection (1), may, upon the application of the Prosecutor, declare any ODS, GHG, GHG dependent equipment or ODS dependent equipment in respect of which the offence has been committed to be forfeited to the State.
(4)Any ozone depleting substance and ozone depleting substance dependent equipment forfeited in terms of subsection (3) shall be destroyed or otherwise dealt with as the Secretary for Environment, Water and Climate may direct.
(5)The court convicting a person of an offence under subsection (1) shall cancel any license issued to such a person. - Reference of the measure

- 13. Licensing of waste carriers
(1) The provisions of this section shall come into effect 18 months after the coming into operation of this Act.
(2) Subject to subsections (3) and (12) no person shall cause or effect the movement of controlled waste within Botswana or the trans-boundary movement of controlled waste without a waste carrier licence issued under this section.
(3) Subsection (2) shall not apply to-
(a) the transportation of controlled waste between different places within the same premises;
(b) the transportation of controlled waste in transit from a country or territory outside Botswana to another and such waste is not deposited in Botswana, provided that the person carrying the waste is not resident in Botswana and holds the prescribed qualifications or other qualifications recognised by the Director to transport controlled waste; or

- 6. Application for permit to acquire arms and ammunition
(1) An application for a permit to acquire or import arms or ammunition may be made by a registered wholesale or a retail arms dealer for the purpose of sale or by an individual for his personal use.
(2) An application under subregulation (1) shall be made by the applicant in person, on Form
1 set out in the First Schedule in respect of arms and on Form 2 set out in the First Schedule in respect of ammunition to a licensing officer of the district in which the applicant carries on business or normally resides:
Provided that where the applicant is a company or a partnership the application shall be made by the secretary of the company or a partner in the firm of the partnership.
(3) On receipt of an application to acquire or import arms under this regulation a licensing officer shall, as soon as practicable, forward the application together with his recommendation thereon, to the Central Arms Registry:
Provided that, where the applicant is an individual, a licensing officer shall not recommend the issue of a permit unless he has personally interviewed the applicant and is satisfied that-
(i) the applicant-
(a) has good reason for acquiring or importing the arms;
(b) is of sound mind, temperate habits and of good character without any serious criminal conviction, and would use the arms applied for without danger to the public safety or peace; and
(c) is not less than 18 years of age; and
(ii) the issue of a permit would not be contrary to the provisions of the Act or of these Regulations.
(4) In respect of an application by an individual for a permit to import ammunition only, a licensing officer may require the production of the arms for which the ammunition is required together with the registration certificate relating thereto and shall issue the permit in Form 3 set out in the First Schedule if he is satisfied that-
(a) the applicant is in possession of an arms licence for the arms in question;
(b) the arms in respect of which the application is made are in good working order;
(c) the ammunition to be imported is of the type and calibre specified in the registration certificate; and
(d) the issue of a permit would not contravene any limitation placed on the applicant's right to hold ammunition in terms of his registration certificate or of these Regulations.
(5) Where an applicant for a permit to acquire arms or ammunition is a dealer in arms, the licensing officer shall not recommend the issue of a permit unless he is satisfied that, in
(a) respect of any item applied for, the balance held in stock by the applicant is not excessive. - Reference of the measure

- 8. Import permit
(1) No person shall import into Botswana any explosives other than fireworks imported from the Republic of South Africa, Namibia, Zimbabwe or Zambia unless at the time of importation or prior thereto he has obtained a permit in Form B in the First Schedule hereto:
Provided that transit of explosives by rail from a place outside Botswana through Botswana directly to another place outside Botswana shall not be deemed to be importation.
(2) A permit to import explosives shall be obtained in the manner prescribed in the Second Schedule, and shall be deemed to be a permit to possess the explosives so imported.
(3) The Chief Inspector of Explosives at his discretion may issue to any owner of a licensed magazine a general authority to import, possess and dispose of explosives, subject to such conditions as the Chief Inspector of Explosives may impose.
(4) The Chief Inspector of Explosives may at any time revoke such authority.
(5) The Chief Inspector of Explosives shall notify the Officer-in-Charge of the Central Explosives Registry of all permits issued by him under subregulation (2).
(6) No permit shall be issued under the provisions of this regulation authorizing the importation of explosives intended or adapted for military use except upon the written authority of the Minister, and no permit issued under this regulation shall be deemed to authorize such importation unless the authority of the Minister has been so obtained.
(7) Every such holder of a permit shall forward at the time of importation to the Officer-in-Charge, Central Explosives Registry, Private Bag 0049, Gaborone, a copy invoice of every consignment of explosives so imported. - Reference of the measure

- 4. Restriction on importation of certain goods Subject to the provisions of
regulation 10, no person shall import into Botswana any goods specified in Schedule 1 to these
Regulations except under and in accordance with an import permit issued under these
Regulations.
10. Exemptions
Notwithstanding the provisions of regulation 4, an import permit shall not be required for
the importation of goods prescribed thereunder where such goods are being imported for the
following purposes-
(a) as bona fide gifts;
(b) as personal effects; or
(c) as trade samples:
Provided that the total value or quantity of such imports in a single consignment does not
exceed the value or quantity prescribed by the Controller in a notice published in the Gazette for
