This updated requirement has been found necessary in order to curb importation of substandard and illicit goods to protect the safety and health of consumers.These inspections will be undertaken by KEBS appointed Inspection agents as provided for under Legal Notice No. 78 of 15thJuly 2005 on the Verification of Conformity to Standards (PVoC) of Imports order

Description of the measure
Further to Our notice of 1st November 2015, we wish to notify the Public and Importers that the requirement for inspection and issuance of Certificate of Conformity has been expanded to cover ALL IMPORTS.
The inspection agents will also supervise and seal container load shipments of certified goods and indicate seal numbers in the respectiveCoCs . Presentation of the Certificate of Conformity (COC) shall be a mandatory document for clearance of the goods under the Scheme for both the Kenya Bureau of Standards and Kenya Revenue Authority

Description
To address the specific concerns of manufacturers with regards to importation of industrial inputs, machinery and spare parts for own use, a mechanism that provides for waiver of the requirement to undergo inspection and expedite their clearance has been established. A criterion for qualification for this waiver shall be developed and manufacturers shall be vetted to prevent abuse. Further, goods already regulated by other government agencies such as the Pharmacy and Poisons Board (PPB), Kenya Plant Health Inspectorate (KEPHIS), Pest Control and Products Board (PCPB) have been exempted from these requirements. Other goods to be considered under exemption are printed matter (text books, magazines etc.) and those certified by KEBS under the Diamond Mark Scheme. However, clearance of goods exempted from these new requirements shall only be undertaken by the two agencies in instances where they are not be mixed with other items that are subject to PVOC inspection

71Any police officer or any other person authorized in writing by the Commissionerof Police for the purposes of this section, the Director of Medical Services or any person authorized by him shall, for the purpose of the execution of this Act, have power to enter the premises, or other place, of any person lawfully carrying on business as a producer, manufacturer, seller or distributor of, or otherwise dealing in, any narcotic drugs or psychotropic substances and to demand the production of, and to inspect, any books or documents relating to his dealings in any such narcotic drug or psychotropic substance and to inspect any stocks of any such

158. Supervision of importation or manufacture of vaccines, etc.
(1) The Minister may provide for the inspection, sampling and examination,
by officers of the Medical Department, of vaccines, vaccine lymphs, sera and
similar substances imported or manufactured in Kenya and intended or used for
the prevention or treatment of human diseases, and may prohibit the importation,
manufacture or use of any such substance which is considered to be unsafe or to
be liable to be harmful or deleterious.

Description of the measure: 28. Offences in connection with obstruction of inspector
Any person who refuses or fails to produce to an inspector any weight, measure, weighing or measuring instrument in his possession or custody or control for use for trade, whereof the inspector requires the production under this Act, or who obstructs or hinders or assaults an inspector in the performance of any duty or act imposed or authorized by this Act or who fails to comply with any reasonable request made by an inspector in the course of his duty under this Act, shall be guilty of an offence.
29. Presumption concerning possession
Where any weight, measure, weighing or measuring instrument is found in the possession or control of any person carrying on trade or is found on any premises, whether in a building or not and whether open or enclosed, which are used for trade, that person shall be deemed for the purposes of this Act to have the weight, measure or weighing or measuring instrument in his possession for use for trade and the onus of proving the contrary shall be upon him.
31. Prescribed weighing or measuring instrument, etc.
(1) The provisions of this section shall apply to the use for trade a weighing or measuring instrument of such class as may be prescribed.
(2) No person shall use any article for trade as a weighing or measuring instrument to which this section applies, or have any article in his possession for such use unless that article, or weighing or measuring instrument to which this section applies in which that article is incorporated or to the operation of which the use of that article is incidental, has been passed by an inspector as fit for such use and, except as otherwise expressly provided by or under this Act, bears a valid stamp of verification indicating that it has been so passed; and if any person contravenes this subsection, he shall be guilty of an offence and any article in respect of which the offence was committed shall be liable to be forfeited.
(3) Where a person submits any weighing or measuring instrument of a pattern in respect of which a certificate of approval granted under section 30 is for the time being in force, and an inspector is of the opinion that the weighing or measuring instrument is intended for trade for a particular purpose for which it is not suitable, he may refuse to pass or stamp it.
56. Powers of entry and seizure
(1) An inspector may at any reasonable time inspect and test all weights, measures or weighing or measuring instruments which are used or are in any person’s possession, or upon any premises for the purposes of trade, and may cause such weights, measures or weighing or measuring instruments to be compared with the working standards, and may apply such test as may be necessary to determine the accuracy therefor, and may seize and detain such of them as are liable to forfeiture under this Act.
(2) For the purposes of subsection (1), an inspector may enter any shop, factory, store or warehouse, stall, yard or other premises wherein he has reasonable cause to believe that there are any weights, measures, weighing or measuring instruments which he is authorized under this Act to inspect or where any goods are bought, sold, exposed, pre-packed or kept for sale, or weighed or measured for sale or for conveyance or carriage or for any other trade purpose.
(3) An inspector authorized under this section may also inspect and weigh or otherwise measure or count any goods on any premises or at any place where goods are bought, sold or exposed for sale, and may stop any vehicle or person carrying goods for sale or delivery to a purchaser and may enter any premises where goods have been delivered to a purchaser in order to ascertain that the provisions of this Act have been complied with and for any such purpose may use any weighing or measuring instrument which complies with the provisions of this Act and which may be upon such premises; and the inspector may require the production of any documents or records appertaining to the quantity or gauge of such goods and such reasonable assistance from any person present and having an interest in those goods as may be necessary.
(4) An inspector may weigh or otherwise measure any container in or on which any goods are made up and may do anything else as respects the goods or container which is reasonably necessary, and which does not damage or depreciate the goods or container to ascertain whether the requirements of this Act are complied with.
(5) For the purposes of subsection (4), an inspector may if necessary break open any container of goods or open any vending machine in which goods are offered or exposed for sale.
(6) Where an inspector has reasonable cause to believe that any document produced to him under subsection (3) contains any inaccurate statement of quantity or gauge or may be required as evidence in proceedings under this Act, he may seize and detain the document giving in exchange thereof a certificate in the prescribed manner, signed by him to the effect that the document has been seized and giving reasons for the seizure.
(7) An inspector entering any premises by virtue of this section may take with him such other person and such equipment as may appear to him necessary.
(8) If any person discloses to any other person any information with respect to any secret manufacturing process or trade secret obtained by him in premises where he has entered by virtue of this section or any information obtained by him in pursuance of this Act he shall be guilty of an offence unless the disclosure was made in or for the purposes of the performance by him or any other person of the functions under this Act.
(9) For the purposes of this section the powers of an inspector shall include power to require the person in charge of any vehicle carrying goods for sale, or for delivery after sale, by weight or measure to a purchaser to have it check-weighed.
57. Power to make test purchase
(1) An inspector may make such test purchases of goods as may appear expedient for the purposes of determining whether or not the provisions of this Act are being complied with; and the expenses incurred in making any such purchase shall be met from public funds.
(2) An inspector may, in connection with the investigation of any alleged offence arising out of a test purchase involving payment with money, search any person for the money; or enter and search premises, or search any box or receptacle and the contents thereof at the place at which such test purchase has been made, and may seize the money so found and retain any change received for the purchase as evidence of the transaction.
(3) Any goods purchased in pursuance of subsection (1) in respect of which no court proceedings are instituted shall be disposed of in such a manner as the Minister may prescribe.

Description of the measure: 26. Power to stop dangerous methods
(1) If an inspector finds any method of work, storage, packing or use in connection with explosives to be in conflict with this Act or the rules, or to be in his opinion dangerous to the public security or to the safety of any person, he may in his discretion—
(a) confiscate and remove the explosives;
(b) by order in writing require the immediate discontinuance of such method;
(c) by order in writing require such remedial measures to be taken as in his opinion are necessary.
(2) Any person who is dissatisfied with a confiscation or requisition done or made under this section may within thirty days thereof appeal to the chief inspector of explosives, who shall give his decision thereon with the least possible delay.
(3) If an appellant is dissatisfied with a decision of the chief inspector of explosives given under this section he may within thirty days of such decision appeal therefrom to the Minister, whose decision shall be final.
(4) The provisions of this section shall be without prejudice to any prosecution.

Description of the measure: 20. Inspections
(1) Any plant, plant product and other regulated article imported into Mauritius shall, upon importation, be subject to inspection at the point of entry, or at its final destination, by an officer.
(2) An inspection under subsection (1) shall be carried out at such time and be subject to such fees as may be prescribed.
(3) (a) Where the imported plant, plant product or other regulated article complies with the requirements under this Act, the officer shall authorise delivery of the imported product by written notice to the importer.
(b) Where an officer determines that the imported product fails to comply with the requirements of this Act, or otherwise presents any risk for the introduction or spread of pests, he shall serve a written notice to the importer stating the reasons for his determination.

Description of the measure: 10. Powers of entry and inspection
(1) The Chief Radiation Protection Officer or an authorised officer may, at any reasonable hour , with the assistance of the Commissioner of Police or such other person or authority, as he thinks necessary, for the purposes of this Act -
(a) enter, inspect and examine any premises, vehicle, vessel, aircraft or any carriage where he has reasonable grounds to believe that radioactive material or any source of ionizing radiation is stored, used, transported or disposed of, in such premises or mode of transport;
(b) require the production of any licence or permit authorising the use or import as the case may be, of any radioactive material, radioactive substance or sources of ionizing radiation;
(c) by written notice, require a licensee to have his employees, who are or may be exposed to ionizing radiation, to be monitored and medically examined; and
(d) by written notice, require any person to be medically examined and monitored by the Ministry responsible for the subject of health, where such examination appears to be reasonable and necessary.
(2) Every person who is in possession of any radioactive material or any source of ionizing radiation shall allow the Chief Radiation Protection Officer or an authorised officer to enter his premises, inspect, examine, and take samples or do any other act in the discharge of his duties under this Act.

Description of the measure
53. Where any goods which have been entered cannot, on account of their value, size, packing or for any other reason, be easily examined by the proper officer, in a transit shed or a Customs area, and the importer desires that the goods be examined at his or her private premises, he or she shall apply in writing to a proper officer, who may in his or her discretion grant the application under such conditions as he or she may impose.
114. (1) All postal articles shall, where the Commissioner so requires, be produced by an officer of the post office to a proper officer for examination, either at the port of arrival in, or departure from the Community, as the case may be, or at any other place in the Community as the Commissioner may direct.
119(1) where goods are imported through a registered courier, the Commissioner may, in his or her discretion, accept the Customs declaration on the form provided by the courier in the country of origin, for the purpose of assessing the duty on the goods, in lieu of the entry required under the provisions of the Customs laws.
(2) Where goods are exported through a registered courier, a declaration from the sender regarding the description of the contents of the package and the value of the goods shall be affixed to the courier article and shall be deemed to be the entry required under the Act.
(3) Sub-regulations (1) and (2) shall not apply to goods where an individual package exceeds seventy kilograms or a value of one thousand dollars.
(4) A licensed courier shall present all the imported goods to a proper officer for examination and assessment of duty. Customs declaration on courier articles.

(2) For the purpose of production of postal articles under sub regulation (1), the officer of the post office shall be deemed to be the agent of the importer or exporter..
115. In any case where a postal article, or any part of its contents, is found on
examination to be conveyed otherwise than in conformity with the provisions of any written law on postal services in a Partner State, or not to agree with any entry, invoice or other document purporting to relate to its contents, or is found to consist of goods prohibited to be conveyed by post, or to be imported or exported, as the case may be, or goods regulated by or under the Act, contrary to any conditions regulating such importation or exportation, the postal article and all its contents shall be deemed to be goods imported or exported contrary to the Act and shall be dealt with as provided in the Act.

116. Where an addressee of a postal article does not claim a postal article, and where the postal article is not delivered to an alternative addressee or returned to the sender within such time as may be specified in the laws of the Partner States relating to the postal services, or where the addressee refuses to pay the duty, if any, in respect of the goods contained in the postal article, the post office shall send the postal article to the Customs for deposit in the Customs warehouse, and the postal articles shall be dealt with in accordance with section 42 of the Act.
121. (1) All courier articles shall be produced by an officer of the courier to a proper officer for examination, either at the port of arrival in, or departure from the consignments Community, as the case may be, or at any other place in the Community as the Commissioner may direct.
(2) For the purpose of production of courier consignments under sub regulation (1), the officer of the courier shall be deemed to be the agent of the importer or exporter.
Detention of courier articles.
122. (1) A courier article and all its contents shall be deemed to be goods imported or exported contrary to the Act and shall be dealt with as provided in the Act, where the courier article, or any part of its contents, is found on examination –
(a) not to be conveyed in conformity with the provisions of any written law in a
Partner State;
(b) to be inconsistent with any entry, invoice or other document purporting to relate to its contents, and which may be transmitted with the article or produced by the addressee;
(c) to consist of goods prohibited to be conveyed by courier, or to be imported or exported, as the case may be, or goods regulated byor under the Act, contrary to any conditions regulating the importation or exportation of the article.
(2) Imported goods not entered within the prescribed period, shall be detained by the Customs and shall be dealt with in accordance with section 34 of the Act.
