- 6.(4) Nothing in this section shall apply to the re-import of firearms or ammunition in respect of which a firearm licence is in force.
6A(2) If any firearm or ammunition imported under subsection (1) is of a type normally used for military purposes, the same shall be deemed to be the property of the Republic.
(5) Any firearm or ammunition imported under this section which has not been released in accordance with subsection (4) shall be deemed to be the property of the Republic.
6B. (1) The provisions of section six shall not apply to any diplomatic agent of a foreign government or organisation who is entitled to diplomatic immunity or privileges under the Diplomatic Immunities and Privileges Act if at the time of his first arrival in Zambia
7. (1) Any person who imports any firearms or ammunition for the purpose of sale shall forthwith deposit the same in the public warehouse nearest to the place of entry, or in such other public or private warehouse as the Registrar may direct. - Reference of the measure

- 3. (1) The International System of Units shall be authorized measure by reference to which any measurement in
trade in Zambia shall be made.
(2) The International System of Units shall consist of-
(a) the base units set out and defined in the First Schedule;
(b) the supplementary units set out and defined in the Second Schedule;
(c) the derived units set out in the Third Schedule; and
(d) any special or permitted units that may be used in conjunction with units mentioned in paragraphs (a) to (c) as adopted by the General Conference and set out in the Fourth Schedule.
(3) The International System of Units prefixes for multiples and sub-multiples of the units referred to in sub-section (2) are those set out
and defined in the Fifth Schedule.
(4) Additional Units of measurement that may be used are set out in the Sixth Schedule.
(5) Units of measurements of length, area, volume, capacity, mass, weight, electricity and time are set out in the Seventh Schedule.
(6) The denominations of physical weights and measures that shall be used for the purpose of trade in Zambia are set out in the Eighth Schedule.
(7) The Minister may, by statutory instrument, from time to time amend any Schedule to this Act.
$ (1) The Agency shall authorise the use of such standards of weights and measures as the Agency considers necessary;
(2) Every standard referred to in subsection (1)-
(a) shall be of a donomination equivalent to-
(i) a weight or measure authorised by this Act; or
(ii) a multiple, aliquot pacer sub-multiple of such a weight or measure;
(b) shall be verified-
(i) in the case of a weight or measure authorised by this section; or
(ii) in the case of a weight or measure authorised by such competent institution as the Minister directs; and
(c) shall be made of such materials and in such manner and placed and kept in such a receptacle as affords it, as far as practicable, protection against mechanical and atmospheric agencies and any likely source of error.
(3) A standard of a litre or capacity measurement may, as the Agency thinks fit, be-
(a) provided either as a separate standard or by means of divisions marked on a standard of a larger measure; and
(b) either marked in whole or in part with sub-divisions representing any smaller units of measurement; or
(c) multiples or sub-multiples of such a unit, or have no such markings.
(4) Where a standard of weight or measure is about to be brought into use in Zambia the Minister shall, on the recommendation of the Board, by notice published in the Gazette or a newspaper with daily circulation, declare that such standard of weight or measure is about to be brought into use in Zambia and specify in that notice on date on which that standard of weight or measure shall become operative.
(4A) The standard of weight or measure referred to in subsection (4) shall, upon publication, of the notice referred to in that subsection, become a national standard of weight or measure and shall, for all purposes, be conclusively deemed to be true and accurate.

- 23.(1) Where a person has in his possession any goods for sale or delivery, or any goods in respect of which any representation of weight or measure is made for the purposes of sale or any other trade purpose, he shall-
(a) provide an assized instrument capable of weighing or measuring such commodity; and
(b) keep and operate the same in such a place and manner so that the weighing or measuring and the weight indicated or measure determined, as the case may be, are clearly visible to the purchaser at all times.
(2) In any case where an automatic instrument is used in the packing for sale of commodities not exceeding fifty kilograms in weight or twenty-five litres in capacity, the person responsible for that packing shall cause to be kept and used near the automatic instrument such assized instrument as would enable
the verification of the correct operation of the automatic instrument.

24A.(1) Subject to the provisions of this section a person who sells any commodity by weight shall sell it by net weight or net content. (2) A person who sells any commodity referred to in subsection (1) shall not deliver, or cause to
be delivered, the commodity to a purchaser unless there is in respect of such commodity an invoice or delivery note showing the net weight or measure of such commodity: Provided that where a weight has been prescribed for a sack, bag or pocket, it shall be sufficient for the invoice or delivery note to contain only the number of sacks, bags or pockets sold.
24B.(1) A person shall not sell any pre-packaged commodity by weight or measure unless the net weight or measure is marked on the wrapper or container of the commodity in the prescribed manner in accordance with an authorized measure.
(2) A person who purchases a pre-packaged commodity which is sold by weight or measure may require the seller to verify, in the presence of the purchaser, the net weight or measure of the commodity.
(3) a person who fails to comply with a request made under subsection (2) commits an offence and is liable, on conviction, to a fine not exceeding ten thousand penalty units or to imprisonment for a term not exceeding twelve months, or to both.
(4) The provisions of this section shall apply to any commodity in respect of which weight or measure is used to designate the grade or class of such commodity
33.Any person who sells or exposes for sale any goods in a denomination of weight or measure other than the denominations of weight or measure authorised under this Act shall be guilty of an offence - Reference of the measure

31 (2)The Agency shall, within thirty days of receipt of an application under sub-regulation (1), approve the application if the applicant—
(a) demonstrates technical capacity to manufacture, import, export, store, distribute, transport, blend, process, re- process or change the composition of a pesticide or toxic substance or re-process an existing pesticide or toxic substance

- 7 (1) The rejection mark shall be a mark of six-pointed star design.
(2) An assizer shall reject an instrument under section nineteen of the Act if—
(a) such instrument, bears a stamp of assize, by obliterating such stamp with a rejection mark;
(b) such instrument, does hot bear a stamp of assize by stamping the rejection mark in a suitable position thereon; or
(c) such instrument bears a seal of assize, by the removal of such seal
8. (1) The capacity of a weighing instrument shall be clearly and conspicuously stamped on the beam, steel yard or on a metal plate permanently secured to some prominent part of the instrument.
(2) The capacity of a fabric measuring instrument shall be clearly and conspicuously stamped thereon,
(3) The denomination of weight shall, except where the small size of it renders it impracticable, be clearly and conspicuously stamped on an upper surface of the weight.
(4) The capacity of the measure shall, unless otherwise prescribed, be clearly and conspicuously stamped on the outside of the measure or on a metal plate permanently secured thereto.
10. No person shall supply any new or repaired weighing or measuring instrument unless it has been assized:

- 10. (1) Every licensed importer or exporter of ozone depleting substances, greenhouse gas, ozone depleting substances dependent equipment or greenhouse gas dependent equipment shall in the form and manner and within the time required by the Ozone Office, furnish the Ozone Office with annual reports or other information in connection with—
(a) quantities of ozone depleting substances, greenhouse gases, ozone depleting substances dependent equipment and greenhouse gas dependent equipment imported or exported, used or destroyed by approved means; and
(b) sources of each ozone depleting substance, greenhouse gas, ozone depleting substance dependent equipment and greenhouse gas dependent equipment imported or exported indicating country, address, contact person, address and contact telephone or fax numbers; and
(c) quarterly or half-yearly inventories of ozone depleting substance, greenhouse gas, ozone depleting substance dependent equipment, greenhouse gas dependent equipment indicating total capacity, consumed quantities and projected imports or exports and consumption for the following year.
(2) ) Any person who does not comply with the requirements of subsection (1) shall be guilty of an offence and liable to a fine not exceeding level five or imprisonment for a period not exceeding three months or both such fine and such imprisonment
11. (1) No person shall repair, service, handle, install or decommission an ozone depleting substance, greenhouse gas, ozone depleting substance dependent equipment and greenhouse gas dependent equipment unless he or she has been trained and certified to do any such activity by the National Ozone Office, in accordance with the National Standard on certification.
(2) Retailers, sellers and distributors of ozone depleting substances and greenhouse gases, shall not sell such substances to any person unless he or she has been trained and certified in the handling of such substances by the National Ozone Office.
(3) The owner of the ozone depleting substance dependent equipment or greenhouse gas dependent equipment with a rated charge of ten kilograms to be repaired, serviced, handled, installed or decommissioned shall submit a written request to the National Ozone Office before any work commences.
(4) The National Ozone Office shall supervise, monitor and certify the recovery of refrigerant, installation or decommissioning of ozone depleting substances dependent equipment or greenhouse gas dependent equipment. (5) Any person who contravenes the proviso to subsection (5) shall be guilty of an offence and liable to a fine not exceeding level three or imprisonment for a period not exceeding one month or both such fine and such imprisonment.
12.(1) If the owner or other person having control of ozone depleting substance, greenhouse gas, ozone depleting substance dependent equipment or greenhouse gas dependent equipment wishes to destroy them, he or she shall submit a written statement to the National Ozone Office.
(2) If the Ozone Office grants permission for the goods to be destroyed, an enforcement officer shall be appointed to witness the destruction and when the substance and equipment has been destroyed the enforcement officer shall record the quantities destroyed and sign a certificate of destruction.
(3) Any person who does not comply with the requirements of subsection (1) shall be guilty of an offence and liable to a fine not exceeding level eleven or imprisonment for a period not exceeding six months or both such fine and such imprisonment. - Reference of the measure
