  Description of the measure

  3 (1) The Minister of Mines may make orders prohibiting or otherwise controlling the exporting from Zimbabwe of the following goods—
  (a) any minerals, precious metals in unmanufactured form, and rough and uncut precious and semi-precious stones, irrespective of their source;
  (b) any non-ferrous metals or composite non•ferrous metals, other than aluminium, which are produced on mining locations in Zimbabwe;
  including all such slimes, concentrates, slags, tailings and residues as may contain such minerals, precious metals, precious and semi-precious stones and non-ferrous metals.
  (2) Without derogation from the generality of the powers conferred by subsection (1), any order made in terms of this section may— .
  (a) prescribe the terms and conditions subject to which controlled goods may be exported from Zimbabwe;
  (b) provide for the empowering of such person as may be prescribed by the order—
  (i) to issue licences authorizing, to such extent as may be prescribed by the order, the export from Zimbabwe of any controlled goods;
  (ii) when issuing a licence in terms of subparagraph (i), to impose any terms and conditions, not inconsistent with the provisions of the order, subject to which any controlled goods specified in the licence may be exported from Zimbabwe, as the case maybe;

  Description of the measure

  100B. (1) No person shall export a substance listed in Table I of the Sixteenth Schedule without obtaining an export licence granted by the Authority.
  (2) Any person who wishes to export a substance listed in Table I of the Sixteenth Schedule shall submit an application to the Director-General in Form M.C. 11A and such application shall be accompanied by the appropriate fee.
  (3) An Export Licence referred to in subsection (1) shall state—
  (a) the names and addresses of the exporter and importer;
  (b) the name and address of the consignee, if any;
  (c) the name of the substance in Table I of the Sixteenth Schedule;
  (d) the quantity to be exported;
  (e) the expected point of entry in the importing country;
  (f) the expected date of dispatch;
  (g) any other details as may be required by the importing country.

  4(1) Any person who wishes to export unbeneficiated hides in terms of these regulations shall, upon confirmation of the evidence of a stock pile of unbenficiated hides by a recognised Council or Association responsible for the leather industry , apply for a permit in terms of these regulations.
  (2) An application referred to in subsection (1) shall be accompanied by a written confirmation by the Council or Association stating that the applicant has a stockpile of unbeneficiated hides.
  (3) In order to be eligible for registration hereunder the applicant must be registered with Zimbabwe Revenue Authority and have a valid tax clearance certificate

  Parks and Wild Life (Import and Export) (Wild Life) Regulations, 1998.

  Description of the measure

  3 (1) Notwithstanding any other law, but subject to this section, no person shall—
  (a) import into or export from Zimbabwe any wild life, trophy or controlled goods except in accordance with the terms and conditions of—
  (i) an open general permit; or
  (ii) a permit; or
  (iii) a transit permit; or
  (iv) a certificate issued in terms of section five;
  and, where appropriate, in accordance with the terms and conditions of an open general licence or licence issued in terms of the Control of Goods (Import and Export) (Commerce) Regulations, 1974, published in Rhodesia Government Notice 766 of 1974; or
  (b) import into Zimbabwe any wild life referred to in Part I or Part II of the Second Schedule, or any trophy of such wild life, unless, in addition to complying with paragraph (a), he holds an export permit or re-export certificate granted in respect of the wild life or trophy concerned by an appropriate authority in the country from which the wild life or trophy concerned is being imported; or
  (c) import into Zimbabwe any wild life referred to in Part III of the Second Schedule, or any trophy of such wild life, unless, in addition to complying with paragraph (a), he holds—
  (i) a certificate of origin or other document indicating the country of origin of the wild life or trophy concerned; and
  (ii) if the wild life or trophy concerned is being imported from the country specified opposite thereto in Part III of the Second Schedule, an export permit granted in respect of the wild life or trophy concerned by an appropriate authority in that country.
  (2) Subsection (1) shall not apply to the import or export of—
  (a) any pre-convention wild life or trophy for which the importer or exporter holds a certificate which—
  (i) in the case of an import, is issued by an appropriate authority of the country from where the wild life or trophy concerned is being imported; or
  (ii) in the case of export, is issued by the Director; or
  (b) any wild life which was bred in captivity, ranched or artificially propagated, as the case may be, or any trophy of such wild life, if the importer or exporter holds a certificate to that effect—
  (i) in the case of an import, granted by an appropriate authority in the country in which the wild life concerned was bred or propagated;
  (ii) in the case of an export, issued by the Director; or
  (c) herbarium specimens, other preserved, dried or embedded museum specimens, or live plant material, where—
  (i) their import or export is effected by—
  A. a museum which is a national museum for the purpose of the National Museums and Monuments Act [Chapter 25:11]; or
  B. any other museum approved by the Director; or
  C. any herbarium approved by the Director; or
  D. any scientist or scientific organisation approved by the Director.
  (3) No permit or certificate shall be required in terms of subsection (1) for the import or export of any trophy which is a personal effect save in the following cases—
  (a) where a person who is ordinarily resident in Zimbabwe imports into Zimbabwe any trophy of wild life referred to in Part I of the Second Schedule which he acquired outside Zimbabwe; or
  (b) where a person who is ordinarily resident in Zimbabwe imports into Zimbabwe any trophy of wild life referred to in Part II of the Second Schedule which he acquired outside Zimbabwe in the country where the wild life concerned was removed from the wild, if that country requires the prior grant of an export permit before any export of such trophy; or
  (c) where a person who is not ordinarily resident in Zimbabwe exports from Zimbabwe any trophy of wild life referred to in Part I of the Second Schedule which he acquired within Zimbabwe; or
  (d) where a person who is not ordinarily resident in Zimbabwe exports from Zimbabwe any trophy of wild life referred to in Part II of the Second Schedule which was removed from the wild within Zimbabwe, if he acquired such trophy within Zimbabwe.
  (4) The Director may, on such terms and conditions as he may fix, grant written exemption to any person from compliance with all or any of the provisions of subsection (1) in respect of the import or export of wild life or trophies which form part of a travelling zoo, circus, menagerie, plant exhibition or other travelling exhibition, where—
  (a) the importer or exporter has provided the Director with full details of the wild life or trophies concerned; and
  (b) the wild life or trophies concerned—
  (i) were acquired by the importer or exporter before the Convention applied to them; or
  (ii) in the case of wild life, was bred in captivity, ranched or artificially propagated, as the case may be, or, in the case of trophies, were derived from such wild life;
  and

  Description of the measure

  1. The exit from the country of animals, their products, by-products, offal, biological products, fodder, without the prior authorization of the Veterinary Authority, which shall issue the veterinary certificate in accordance with the import license issued by the Veterinary Authority of the importing country shall be prohibited.
  2. The veterinary certificate issued for the purpose of export shall:
  (a) identify the animals or their products and fodder as presented;
  (b) Identify the date, place of inspection and name of the inspector;
  (c) Indicate each of the tests and their results, if they have been requested and / or performed;
  (d) Confirm that the health charges defined by the Veterinary Authority of the importing country have been fulfilled.
  3. The exit of animals, their products, by-products, offal and fodder from regions considered to be infected or suspected, may be authorized provided that they are subject to the sanitary or processing measures indicated by the Veterinary Authority of the importing country.
  4. The sanitary measures referred to in paragraph 3 of this Article shall be carried out at their respective places of production.
  5. In the cases referred to in paragraph 3 of this Article, transport from the place of origin to the shipment shall be carried out on specially prepared vehicles and on the conditions laid down by the Veterinary Authority.

  72. Exporting of motor vehicle
  (1) If the title holder of a motor vehicle, other than a manufacturer or a builder of a new motor vehicle, intends to export such motor vehicle, such title holder shall notify the Director thereof on Form MVRA.
  (2) On receipt of a notification referred to in subregulation (1), the Director shall update the particulars pertaining to such vehicle in the register of motor vehicles

  ARTICLE 9
  The import and export of controlled substances as provided for in Annex 1, as well as air-conditioning, refrigeration, heat pumps or fire-extinguishers containing any of these substances may only be authorized under the terms of this Regulation, when they come from countries or are destined to countries that are parties to or to which the Montreal Protocol applies.
  ARTICLE 10
  1. The importation and exportation of goods referred to in the preceding article, as well as aerosol containers, shall be subject to the prior obtaining of an import or export authorization, to be issued by the National Authority.
  2. In view of the authorization referred to in the preceding paragraph, the tenderer must fill out the forms appearing as Annexes 3 and 4, including:
  (A) The name and address of the importer and exporter;
  B) The NUIT;
  (C) The country of import or export;
  (D) A statement of the purpose for which the requested import is intended (raw material, or other use of the controlled substance);
  (E) The place and date foreseen for importation;
  (F) The potential addressees and their quantities.
  3. The National Authority may, in addition, request the interested party or any other entities the information they deem relevant for the decision on the application for authorization.
  4. The application for authorization to import or export aerosol dispensers, air-conditioning equipment, refrigeration, heat pumps and fire extinguishers shall indicate the substance used as a propellant or as a refrigerant.
  5. After examination and approval of the documentation, including additional information, where necessary, the National Authority shall decide on the request, within a maximum period of 15 days.

  15.-(1) Any seed importer, exporter, producer, processor, distributor or seller shall, before operating, register with the Director or any other person appointed by him in that behalf
  (2) Any owner or operator of a seed processing factory or seed testing laboratory shall be required to obtain registration of his factory or laboratory from the Director.
  (3) Every application for registration under subsection (1) shall be, submitted to the Director in the prescribed manner and shall be accompanied by the prescribed registration fee.
  (4) The Director may, after receiving an application for registration-
  (a) grant registration if he is satisfied with the contents of application; or
  (b) refuse an application.
  16.-(l) The Director shall after granting the registration, issue a certificate of registration to a seed dealer subject to such terms and conditions as may be determined by the Minister.
  (2) A registration certificate granted shall be conspicuously displayed on the business premises of a registered seed dealer.
  17.-(l) The Director may, if he is satisfied that any conditions subject to which a seed dealer was registered have not been complied with, cancel the certificate of registration issued to a seed dealer.
  (2) The Director shall not cancel the registration of a seed dealer under this section unless the dealer has been given an opportunity to show cause as to why the registration should not be cancelled.
  18.Any person who is not satisfied by the decision of the Director for refusal of registration, cancellation of registration or permit under the provisions of this Act may, within thirty days appeal to the Minister whose decision shall be final
  19.-(1) No person shall-
  (a) import, export, produce, process, distribute or sell seeds unless he is registered as such under this Act; or
  (b) test, process or multiply seeds otherwise than in a registered laboratory seed processing factory or, as the case may be, a seed multiplication farm.
  (2) Notwithstanding subsection (1), nothing in this Act shall, be construed as preventing the sale of quality declared seeds as such to a neighbour fanner, whereby such seeds are grown by a smallholder fanner for use as seeds in his own farm.
  (3) Where a registered Seed Dealer contracts any person to import, export, produce, process, distribute or sell seeds, that person shall be bound by the terms and conditions provided for under this Act.

  102. Goods entered under bond for exportation or use as stores or for transhipment shall not, unless the Commissioner otherwise directs, be deemed to have been put on board such aircraft or vessel unless they are-
  (a) entered using Form C.17;
  (b) produced to a proper officer for examination immediately prior to loading;
  (c) loaded on the exporting aircraft or vessel immediately after examination;
  (d) produced to a proper officer, if he or she requires, after loading;
  (e) certified on the appropriate form by the master or other principal officer of the aircraft or vessel as having been received on board; and
  (f) except in the case of aircrafts or ships’ stores, included in the outward manifest of the aircraft or vessel
  103. (1) Vehicles and goods, other than vehicles and goods to which the provisions of regulations 132, 133, 134 and135 apply, which are exported overland shall be entered using Form C 17.
  (2) A person in charge of a vehicle, whether or not the vehicle is conveying goods, shall report to a proper officer, the full particulars of the vehicle and the goods, if any, using Form C2.
  (3) A person who contravenes this regulation commits an offence
  103. (1) Vehicles and goods, other than vehicles and goods to which the provisions of regulations 132, 133, 134 and135 apply, which are exported overland shall be entered using Form C 17.
  (2) A person in charge of a vehicle, whether or not the vehicle is conveying goods, shall report to a proper officer, the full particulars of the vehicle and the goods, if any, using Form C2.
  (3) A person who contravenes this regulation commits an offence.
  107. The certificate of clearance of a vessel departing to a foreign port shall be in accordance with Form C. 14.
  108. (1) The outward manifest of a vessel shall be in accordance with Form C. 2, and shall contain particulars of all cargo shipped in accordance with the description of the cargo in the relevant bill of lading or freight note, together with the weight or cubic measurement of such cargo in the manner specified in regulations 18 and 19
  (2) Each page of the outward manifest, other than that on which the declaration is signed, shall be initialed by the master or his or her agent, and the master or agent shall number and seal together the pages and shall,where required, sign the outward manifest in the presence of the proper officer.
  (3) The outward manifest referred to in sub-regulation (1), may be in an electronic form.
  (4) Where an outward manifest is made in an electronic form in accordance with sub-regulation (3), the proper officer may require the master to submit the transcript in such time as the proper officer may determine.
  (5) A transcript submitted under sub-regulation (4), shall be initialed in the manner specified in regulation 14.Clearance and general declaration for aircraft.
  109. (1) Before departing to a foreign port, a master of an aircraft shall deliver to a proper officer a general declaration for the aircraft using Form. C. 4.
  (2) The proper officer shall return one copy of a signed Form. C. 4 to the master, which shall be the certificate of clearance of the aircraft.
  (3) A report of the cargo shall be made using Form. C. 2, which shall be attached to Form. C. 4.
  (2) The declaration referred to in sub-regulation
  (1) shall give an accurate description of the quantity or weight, the country of origin and value of the contents of the parcel or consignment.
  (3) Where the parcel referred to in sub-regulation
  (1) contains goods of a commercial nature, an invoice or a statement showing full particulars of the goods shall be enclosed in the parcel; and where the goods are enclosed in two or more parcels, an invoice or a statement showing full particulars of the goods shall be enclosed in one of the parcels, which shall be clearly marked "invoice or statement enclosed".
  (4) Where the invoice or statement cannot be conveniently enclosed inside the parcel, it shall be securely attached to it.
