Registration as an export establishment
3(1) When the owner, lessor or management of abattoir, deboning establishment, cold store or ancillary premises desires to use premises for-
(a) the slaughter and dressing of animals or poultry from which meat , offals or any other part intended for export; or
(b)deboning and preparation of carcasses, meat or by-products intended for export ;or
(c ) the storage of carcasses, meat, offals or by-products intended for export;
The owner, or the lessor or management authorized by the owner, shall apply to the director for registration of the premises as an export establishment on Form P.E.2.
(2)an application in terms of subsection (1) shall be accompanied by-
(a)comprehensive and adequate plans and a full description of the premises to which the application relates; and
(b)a full description of the equipment and fitting to be used ; and
(c) an explanation of the operations to be carried out; and
(d)a site-plan showing the area to be used and adjacent properties and buildings ;and
(e) any other relevant information that may be required by the director.
(3) as soon as practicable after receiving an application in terms of this section, the director shall consider the application, and if he is satisfied that the applicant’s premises fulfill the requirements of these regulations, he shall-
(a) allocate to the an official identification number and enter that number in a register; and
(b) issue a certificate on Form P.E.2; and
(c ) publish by notice in the Gazette notification of the registration and the purposes for which registration has been granted.
(4) A certificate of registration shall expire on the 31st December of the year of issue
(5) No person shall use any premises for the purposes referred to in paragraphs (a),(b) and (c) of subsection (1) unless such premises are registered in terms of this section.
Renewal, transfer and alteration of registration
4. (1) any licensee who wishes to renew the registration of his premises as an export establishment shall submit to the director an application on Form P.E 3 no later than the 1st of November of the year in which his premises were registered.
(2) Any licensee who, by reason of sale or cession, transfers the ownership or operation of an export establishment to another person, shall submit to the director an application Form P.E. 4 together with proof of registration in the year in which the transfer was made.
(3) any licensee who wishes to make alterations or addition to his export establishments shall submit an application to the director on Form P.E. 5.
(4) as soon as practicable after receiving an application in terms of subsection (1), (2) or (3) , the director shall consider the application , and if he is satisfied that-
(a) there is no change in the use of the premises for the purpose specified in the certificate of registration ; and
(b) there is no reduction in the standards of hygiene or quality of the products of the export establishment;
he shall endorse the application and return it to the licensee.
Cancelation of registration
5. where the director is satisfied that –
(a) an export establishment is not being uses for the purpose specified in the certificate or registration; or
(b) the equipment available in the export establishment has ceased to be adequate ; or
(c ) the operations being carried out on the establishment have ceased to be satisfactory ; or
(d) alterations and additions which have not been approved have been made; or
(e) the licensee has failed to comply with the provisions of these regulations;
he may cancel the registration in respect of that export establishment.
Appeals
6. (1) if the director rejects an application for registration , renewal of registration or transfer or transfer of the registration in terms of this Part, or cancels and existing registration, the aggrieved party may appeal in writing to the minister of Agriculture within fourteen days of such rejection or cancellation , giving the ground for such an appeal.
(2) Within thirty days of receiving an appeal in terms of subsection (1) , the Minister shall, after consultation with the director , notify the applicant of his decision:
Provided that that the Minister may, within that time –
(i) Require the director to furnish him with the reasons for his rejection or cancellation;
(ii) Authorize the use of the premise in respect of which the appeal is made as an export establishment

4(2) In order to be eligible for registration hereunder the registered merchant must be registered with the Zimbabwe Revenue Authority and have a valid tax clearance certificate.
6(1) The Minister responsible for Agriculture may cancel or suspend the validity of the permit issued to the registered merchant if such a registered merchant-
(a) ceases to hold a stockpile of unbeneficiated hides, or
(b) fails to comply with or contravenes any of the provisions of these regulations ; or
(c) so requests
(2) If any registration is cancelled in terms of subsection (1) , any relief granted in terms of these regulations shall immediately become due payable.

9 (1) Any person who wishes to export any pesticides out of Zimbabwe may apply for a permit to do so.
Provided that the pesticides, are locally registered and bear the company name , registration number, pesticide name, and formulation source of pesticide, amount paid for pesticides and receipt number and expiry date for pesticides.
(2) An application for an export of pesticides permit shall be shall be made in writing to a registering officer in the Form P.5. prescribed in the First Schedule together with the payment of a prescribed fee: Provided that export of pesticides permit shall be valid thirty days from the date of issue per consignment.
(3) Any person who wishes to export any pesticides, in terms of

Registration of an export establishment
4. (1) Where the owner, lessor or management of a fish processing establishment , or ancillary premises desires to use the premises for –
(a) the processing of fish; or
(b ) the storage of processed fish or by-products intended for exports ;
The owner or the lessor or management authorized by the owner, shall apply to the Director for registration of the premises as an export establishment on Form 1.
(2) An application in terms of subsection (1) shall be accompanied by –
(a) Comprehensive and adequate plans and a full description of the premises to which the application relates ; and
(b) A full description of the equipment and fittings to be used; and
(c) An explanation of the operations to be carried out ; and
(d) A site plan showing the area to be used and adjacent properties and buildings; and
(e) Any other relevant information that may be required by the Director.
(3) As soon as practicable after receiving an application in terms of this section, the Director shall consider the application, and if he is satisfied that the applicant’s premises fulfill the requirements of these regulations he shall –
(a) Allocate to the premises an official identification number and enter that number in a register ; and
(b) Issue a certificate on Form P. E. F 1.;
(c) Publish by notice in the Gazette notification of the registration and the purposes for which registration has been granted.
(4) A certificate of registration (Form P.E.F2) shall expire on the 31st December of the year of issue.

6. Where the Director is satisfied that –

(d) Alteration and addition which have not been approved have been made; or
(e) The licensee has failed to comply with the provisions of these regulations.
He may cancel the registration in respect of that export establishment.
Appeals
7.(1) If the Director rejects an application for registration, renewal of registration or transfer of registration in terms of this part , or cancels an existing registration, the aggrieved party may appeal in writing to the Minister of Lands and Agriculture within 14 days of such rejection or cancellation , giving the grounds for such an appeal.

3(1) An application for the registration of a farm feed shall be made by -
(a) submission of a sample; and
(b) completing form F.F.1 specified in the First Schedule in triplicate and submitting it to the registering officer; and
(c ) accompanied by the container and a reproduction of any label or inscription on the container in which the feed will be sold.
(2) Renewing of registration is made by sample submission and undergoing the same process as in subsection (1) and is done annually.
(8) Where an applicant wishes to register constituents claimed to have nutritive or prophylactic value or growth - stimulating properties, other than those set out in the Second Schedule, the application for registration shall state -
(a) in the case of inorganic constituents other than salt, the percentage of the constituents other than salt, the percentage of the constituent expressed in terms of the elementary form; and
(b) in the case of salt , the maximum percentage expressed as NaC1; and
(c) in the case of added vitamins, antibiotics, drugs and hormones the content of the active constituent;
and all shall be used at the levels accepted by the Medicine Control Authority of Zimbabwe and the registration number shall be quoted on the application for registration.
(10). An application for the registration or for the renewal of a registration of a farm feed containing any ingredient of animal origin shall contain a certificate stating that such substance has been sterilised in the manner prescribed in the Fertilizers and Farm Feeds (Sterilisation of Animal Products) Regulations , 1976, published in the Rhodesia Notice 1127 of 1976.
7(3) All exports of farm feeds shall ensure that-
(a) they comply with the requirements of section3 of these regulations ; and
(b) the feed and feedmill must be registered prior to application for export permit.

12. Registration of waste carrier
(1) The provisions of this section shall come into effect 12 months after the coming into operation of this Act.
(2) Subject to subsection (6), no person shall cause or effect the movement of controlled waste within Botswana or the trans-boundary movement of controlled waste without being registered as a waste carrier under the provisions of this section:
Provided that any person carrying on business as a waste carrier before the commencement of this Act or such other person as the Minister may determine on the recommendations of the Director, may, upon being registered, continue in such business or commence operations of such business pending the determination of the application for a licence under section 13.

11. Registration and Markings
(1) All persons wishing to internationally trade specimens of any species listed in Appendix I must be registered with the Management Authority.
(2) All persons wishing to produce captive bred animals and artificially propagated plants for commercial international trade purposes of any species listed in Appendix I must be registered with the Management Authority and where required with the Secretariat in the case of captive bred animals. If these species are also listed in terms of section 56 of NEMBA and are already registered under the applicants name as Threatened or Protected Species, an integrated registration certificate may be issued.
"international trade" means any export, re-export, or import covered by the customs regulations and introduction from the sea;

21. Control of export of cattle and the licensing of export slaughter-houses
(3) Notwithstanding the provisions of section 29 of the Control of Livestock Industry Act the President shall not license any slaughter-house as an export slaughter-house in pursuance of that section unless that slaughter-house is operated, directly, indirectly or in association with others, by the Commission.

COFFEE AUCTION AND EXPORTS
Auctions
49. (1) Subject to sub-regulation (5), all coffee whether intended for export or not, shall be sold through auctions conducted by the Board, at the Moshi Coffee Exchange.
(2) At the auction, coffee shall be sold by way of catalogues:-
(a)prepared in a manner which does not disclose the identity of the coffee owner ;and,
(b)displaying grades of coffee, which conform to the drawn samples.
(3) The Board or its designated agent, shall draw pre-auction and post-auction samples, for purpose of ensuring that the samples drawn represent coffee offered for auction or coffee to be exported after auction.
(4) The coffee whose samples have been drawn, shall be kept under the custody of the auctioneer, until is passed over to the buyer. Some coffee exporters to be allowed to by-pass auction
(5) The Board may, after being satisfied that applicants for direct export licences of coffee have complied with conditions set out in the Third Schedule, allow exporters of coffee categorized in that Schedule, to export coffee without passing through the auction

19. Restriction on export and sale of cotton
(2) The Minister may from time to time, after consultation with the Board, fix prices at which purchasers of raw cotton may purchase the cotton.

72.(1) Rates of royalties shall be as specified in the Third Schedule of these
Regulations.
(2) The value of a precious metal ora non-precious mineral shall, for the purpose of computing the royalty payable on such precious metal or non-precious mineral, be deemed to be the latest price on the London Metal Exchange or any other Metal Exchange or market as known to the Commissioner; and in the absence of proof to the contrary—
(a)gold shall be deemed to be ninety-five per centum fine;
(b)tin ore shall be deemed to contain seventy-five per centum tin;
(c)the valuable contents of other metals, ore or minerals shall be such as the Commissioner may determine; except that where a precious mineral or non-precious metal is exported to a refinery approved by the Commissioner, the value shall be the gross sum realized as shown by the original sales account to be produced to the Commissioner.
(3) For the purposes of paragraph
(c) of sub-regulation (2) of this regulation, the gross sum realized shall be
the sum realized without any reduction or abatement for transport, marketing, insurance, returning or any other charges or whatsoever.
74.(1) An application for a mineral dealer’s licence under section 70 of the Act
shall be in Form XIV and a mineral dealer’s licence shall be in Form XXIII in the First Schedule to these Regulations; and there shall be paid for every such licence the applicable fee specified in the Third Schedule to these Regulations.
(2) Minerals obtained under a mineral right or under a mineral dealer’s licence may only be exported under an export permit granted by the Commissioner.
(3) An application for an export permit under section 116 of the Act shall
be in Form XIII in the First Schedule to these Regulations, accompanied by the
applicable fee specified in the Third Schedule to these Regulations; and an export permit shall be in Form XXXVII in the First Schedule to these Regulations.
75.(1) An application for a goldsmith’s licence under section 73 of the Act shall be made to the Commissioner in Form XV of the First Schedule to these Regulations, accompanied by the applicable fee specified in the Third Schedule to these Regulations, and the licence shall be in Form XXIV in the First Schedule to these Regulations.

34. Import, export, re-export and transit of game animals and trophies
(1) No person shall import, export, re-export or acquire transit rights for game animals without an import, export, re-export and transit permit respectively.
(2) An application for an import, export, re-export or transit permit for game animals not listed under the Fifth Schedule of the Act shall be made in the form set out in the Twenty Sixth Schedule.
(3) An import, export, re-export and transit permit for game animals and trophies not listed under the Fifth Schedule of the Act shall be in the form set out in the Twenty Seventh Schedule.
(4) An import, export, re-export and transit permit for game animals and trophies specified in the Fifth Schedule of the Act, shall be in the form set out in the Twenty Eighth Schedule.
(5) If an import, export, re-export or transit permit is unused for whatever reason it shall be surrendered to the issuing office before another one is issued.
(6) A permit applied for under this regulation may be issued on the payment of an appropriate fee specified in the Twenty-Ninth Schedule.
(7) A permit issued under this regulation shall be subject to such terms, conditions and requirements as may be endorsed in the permit.
(8) Any person who contravenes any provision of this regulation shall be guilty of an offence.

19A. Import, export, etc. of endangered species of flora
( 1) Subject to the provisions of this section, no person shall import, export or re-export, possess or transport any species of flora specified in the Convention except in accordance with a permit or certificate, as the case may be, issued by a management authority in consultation with the scientific authority.
(2) The Minister may make regulations for the issue and renewal of import, export or re-export, possession or transportation permits or certificates, and the conditions and duration of the permits or certificates.
