(d)controlling import and export of cotton; and
(e)dealing with any other relevant matters in the cotton industry.
(2) The Board shall, upon registration, issue a registration number and Certificate prescribed in the First Schedule

5.(1) All producers, growers, processors, packers, importers and exporters of pecan nuts and/or pecan nut products shall register with SAPPA in the manner prescribed in clause 6.
(2) Each person or entity who becomes a producer, grower, processor, packer, importer and/or exporter of pecan nuts and/or pecan nut products shall register with SAPPA.
(3) A person shall have a choice to register as either a producer or processor or importer or exporter.
(4) A person who is a producer as well as a processor or importer or exporter shall register as a producer and as processor or importer or exporter.
Application for registration
6. Application for registration shall –
(1) be made within thirty (30) days of the commencement of this statutory measure, and in the case of a person becoming a party as contemplated in clause 5 after such date of commencement, within thirty (30) days of becoming such a party;
(2) be made on the application form obtainable free of charge from SAPPA;

- 3. (1) Subject to the provisions of these Regulations and unless a person complies with regulation 5
and 6 of these Regulations, no person may -
(a) use, process, or produce PCB materials or PCB contaminated materials;
(b) import PCB materials or PCB contaminated materials into the Republic of South Africa, or export PCB materials or PCB contaminated materials from South Africa; or
(c) sell PCB materials or PCB contaminated materials in South Africa.
(2) The provisions of sub-regulation (1) do not apply to persons who import PCB waste from a State which is a member of South African Development Community, for the purpose of treatment or safe disposal at a facility authorised in terms of section 20 of Environmental Conservation Act, 1989 (Act No. 73 of 1989) or section 49 of National Environmental Management: Waste Act, 2008 (Act No. 59 of 2008).
Registration
5. (1) Any person who possesses articles must register with the Director-General within 90 days of promulgation of these Regulations.
(2) A person contemplated in sub regulation (1) must register in a form obtainable from the Department.
(3) The Director-General must acknowledge receipt and issue the registration number within 30 days of receipt.
(4) The Director-General may on receipt of the registration form, request incomplete information to be furnished in writing or amendments to be effected on the registration form and the amended registration form to be resubmitted within a specified time frame.
(5) A person who is registered in accordance with sub-regulation (1) must notify the Director-General of any changes in any material detail which has been provided as part of the registration within 30 days of such change taking place. - Reference of the measure

- 5.(1) All Manufacturers, importers and exporters of maize or wheaten products shall register with SAGIS in the manner set out in clause 6. This shall also include any person who acts in the capacity of a aforementioned persons
(2) Each person who becomes a manufacturer, importer or exporter of maize products or wheatn products after the date at which this statutory measure comes into force shall register with SAGIS within 30 Days after he becomes such a manufacturer, importer or exporter;
(3) Upon registration of an applicant by SAGIS a certificate of registration is to be issued to him;
(4) The registration certificate issued in terms of sub-clause (3) shall expire when it is cancelled by SAGIS of when the statutory measure is revoked;
(5) The provisions of sub-cluase 4 shall apply mutatis mutandis to persons who are already registered with SAGIS at the time of this publication;

- The rationale of the measure
- The purpose and aims of the statutory measure is to compel the parties set out herein to register with the South African Pecan Nut Producers Association NPC (SAPPA). Registration is necessary to assist SAPPA in ensuring that continuous, timeous and accurate information relating to the products as defined, is available to all role players. Market information is deemed essential for all role players in order for them to make informed decisions. By combining compulsory registration with the keeping of information and the rendering of returns on an individual basis, market information for the whole of the industry can by processed and disseminated and will form the basis for the collection of levies where applicable and appropriate.
The establishment of the measure would assist in promoting the efficiency of the marketing of pecan nuts and pecan nut products. The viability of the pecan nut industry
will thus be enhanced. The measure will not be detrimental to the number of employment opportunities or fair labor practice.
The measure will be administered by SAPPA, a non-profit company established in terms of the Companies Act (as amended), 2008 (Act 71 of 2008). SAPPA will implement and administer the measure as set out in the Schedule - Coded list of objectives

5.(1) All producers, growers, processors, packers, importers and exporters of pecan nuts and/or pecan nut products shall register with SAPPA in the manner prescribed in clause 6.
(2)Each person or entity who becomes a producer, grower, processor, packer, importer and/or exporter of pecan nuts and/or pecan nut products shall register with SAPPA.
(3)A person shall have a choice to register as either a producer or processor or importer or exporter.
(4) A person who is a producer as well as a processor or importer or exporter shall register as a producer and as processor or importer or exporter.
Application for registration
6. Application for registration shall –
(1) be made within thirty (30) days of the commencement of this statutory measure, and in the case of a person becoming a party as contemplated in clause 5 after such date of commencement, within thirty (30) days of becoming such a party;
(2) be made on the application form obtainable free of charge from SAPPA;
(3) be submitted, when forwarded by post, to – SAPPA

- 84 A. Any person who makes an entry for imported goods or goods which are to be imported or exported, shall, on making the entry, classify such goods in accordance with the First Schedule (Act No. 2 of 2008)
84B If the Commissioner General is satisfied that a tariff classification made under section eighty-four A-
(a) is inconsistent with the First Schedule; or
(b) is for any reason incorrect; the Commissioner-General shall amend such tariff classification, and the tariff classification as amended shall apply for purposes of this Act. (Act No. 2 of 2008)
84C. (1) An application for an advance tariff ruling in respect of imported goods, or goods to be imported or exported, may be made, by any person, to the Commissioner-General.
(2) An application for an advance tariff ruling referred to in subsection (1) shall be in the prescribed form and shall-
(a) contain a detailed description of the goods in question;
(b) state the suggested tariff classification of the goods in question;
(c) state the basis for the suggested tariff classification of the goods;
(d) where possible, be accompanied by a sample of the goods in question; and
(e) contain such other information as the Commissioner-General may require.
(3) Where the information provided by an applicant under subsection
(2) is not sufficient to enable the Commissioner-General to make a ruling on the tariff classification of the goods in question, the Commissioner-General shall require additional information from the applicant, prior to processing the application.
(4) The Commissioner-General shall, within ten working days from the date of receipt of a complete application, issue an advance tariff ruling, in accordance with the First Schedule, if the Commissioner-General is satisfied-
(a) that the application relates to an importation or exportation of goods actually envisaged;
(b) that the goods in respect of which the application is made are not the subject of litigation; or
(c) where the goods have already been imported, that the goods are not the subject of a dispute between the applicant and the Authority:Provided that if the Commissioner-General, fails to issue an advance
tariff ruling within the period specified in this subsection, the Commissioner - General shall notify the applicant in writing stating the reasons for the failure and advise the applicant when a ruling shall be made
(5) The Commissioner-General may refuse to issue an advance tariff ruling under this section if the Commissioner-General is not satisfied with respect to any of the matters specified in paragraphs (a), (b) and (c) of
subsection (4).
(6) Where the Commissioner-General refuses to issue an advance tariff ruling under this section, the Commissioner-General shall notify the applicant in writing of the refusal to J: issue an advance tariff ruling and shall state the reasons for the refusal.
(7) An advance tariff ruling issued under this section shall -
(a) describe the particular goods in respect of which itis issued; and
(b) be valid for such period as the Minister may, on the recommendation of the Authority, by statutory instrument, prescribe.

84E. An advance tariff ruling issued under section eighty-four C shall be applied solely-
(a) in respect of particular goods where it is established to the satisfaction of the Commissioner-General that the goods in question conform in all material respects to those described in the advance tariff ruling so issued; and
(b) for the purpose of determining-
(i) import or export duties; and
(ii) rebates, remissions or refunds.

- 33.An operator of a pipeline intending to export goods through the pipeline shall provide to the Customs Division prior advice in Form CE 2 (Custom and Excise Report by operator of a pipeline)set out in the Eighth Schedule of the nature and quantity of goods to be exported and the intended date and time of that process and shall not commence any such process or pumping operation without the written permission of an officer.
34.Where warehoused goods are to be exported in bond as stores or ships, aircraft, trains or vehicles other than trains, they shall be placed under seal in the ship, aircraft or train or vehicle as the case may be and the seal shall not be broken while the ship, aircraft train or other vehicle remains in Zambia.
35.The report and application for clearance required to be made in respect of a train or other vehicle pursuant to section forty-nine of the Act shall be made in Form CE 15( Custom and Excise Outward report) set out in the Eighth Schedule.
36.An application for clearance of a ship to leave Zambia pursuant to Section fifty of the Act shall be made in Form CE 15 set out in the Eighth Schedule.
37. An application for clearance of an aircraft to leave Zambia pursuant to section fifty-one of the Act shall be made in Form CE 15 set out in the Eighth Schedule.
38.If a ship or aircraft cleared to leave Zambia delays its departure beyond a period of twenty four hours after clearance is given, or call at another port or aerodrome within Zambia before leaving the Republic, the certificate of clearance shall be deemed to have lapsed and a new application shall be made in Form CE 15 set out in the Eighth Schedule.
39. Unless otherwise stated in these regulations, any requirement for a declaration to be made or lodged shall be taken to refer to a declaration in Form CE 16 (Customs and Excise General Registration Certificate) set out in the Eighth Schedule
50.(1) The entry of warehoused goods for removal as stores for ships, aircraft, trains or vehicles other than trains, shall be made in Form CE 20 set out in the Eighth Schedule.
(2) The Commissioner-General may determine the quantities of goods of each kind which are to be entered as stores for ships, aircraft, trains or vehicles other than trains taking into account the number of the crew, the
passengers and the period during which the ship, aircraft, train or vehicle other than a train is likely to be on its proposed voyage or journey.
(3) Any goods removed under sub-regulation (1) shall be carried by a customs carrier licensed in accordance with the Act who shall be responsible for the duty on the goods until such time as safe delivery of the goods has been effected to the satisfaction of the Customs Division.
55. An application for permission to export goods as ship, aircraft or vehicle stores in pursuant to section fifty-nine of the Act shall be made in Form CE 22 set out in the Eighth Schedule. - Reference of the measure
