Description of the measure
12. (1) A person who intends to reclaim, re-use, recover, recycle, transport, dispose of, transit, trade in, export waste or collect and dispose of waste from industrial, commercial, domestic or community activities or own, construct or operate a waste disposal site or facility for the permanent disposal or storage of waste shall apply to the Agency for a waste management licence in Form III set out in the First Schedule.
(2) The Agency shall, within thirty days of receipt of an application under sub-regulation (1), approve the application if the applicant —
(a) demonstrates technical capacity to reclaim, re-use, recover, transport, trade in, export or recycle waste; and
(b) has measures and facilities in place to ensure the safe reclamation, re-use, recovery or recycling of waste.
(3) The Agency shall, where it approves an application for a waste management licence, issue the licence in Form IV set out in the First Schedule.
19. (1) A person who intends to generate, pre-treat, treat, handle, transport, store, dispose of, transit, trade in or export hazardous waste shall apply to the Agency for a hazardous waste licence in Form V set out in the First Schedule.
(2) The Agency shall, within thirty days of receipt of an application under sub-regulation (1), approve the application if the applicant—
(a) demonstrates technical capacity to safely generate, pre- treat, treat, handle, transport, store, dispose of, transit, trade in or export hazardous waste; and
(b) has measures and facilities to ensure the safe generation, pre-treatment, treatment, handling,
transportation, storage, disposal of, transit, trade in or export of hazardous waste.
31. (1) A person who intends to manufacture, import, export, store, distribute, transport, blend, process, re-process or change the composition of a pesticide or toxic substance or re-process an existing pesticide or toxic substance for a new use shall apply to the Agency for a pesticide and toxic substance licence in Form VIII set out in the First Schedule.
(2) The Agency shall, within thirty days of receipt of an application under sub-regulation (1), approve the application if the applicant—
(a) demonstrates technical capacity to manufacture, import, export, store, distribute, transport, blend, process, re- process or change the composition of a pesticide or toxic substance or re-process an existing pesticide or toxic substance; and
(b) has measures and facilities to ensure the safe manufacture, importation, exportation, storage, distribution, transportation, blending, processing, re-processing or changing of the composition of a pesticide or toxic substance or re-processing an existing pesticide or toxic substance.
42(1) The following persons shall apply for a licence under this Part—
(a) an importer, exporter, producer or distributor of a controlled substance or ozone depleting substance;
(b) an importer, exporter, producer or distributor of technology or a product which uses or contains a controlled or zone depleting substance
42 (3) The Agency shall, within thirty days of receipt of an application under sub-regulation (1), approve the application if the applicant has measures and facilities to ensure the safe—
(b) importation, exportation, distribution, sale or offer for sale, handling, recycling or reclamation of a substance likely to deplete the ozone layer.

The rationale of the measure
These regulations shall apply to private and public industrial and commercial importers, exporters, producers and consumers of ozone depleting substances and greenhouse gases listed in the Second, Third and Fourth Schedules and ozone depleting substance and greenhouse gas dependent equipment listed in the Fifth Schedule.

Description of the measure
5. (1) Any person who wishes to import or export ozone depleting substance, greenhouse gas, ozone depleting substance dependent equipment or greenhouse gas dependent equipment or any chemical listed in the Third and Fourth Schedules shall apply to the Ozone Office in Form AP1.
6. (1) The Ozone Office shall, as soon as practicable, but in any case not later than sixty days from the date of receipt of an application—
(a) grant the application (subject to such conditions as it may think fit to impose) and issue to the applicant the import or export license applied for; or
(b) refuse the application giving reasons thereof.
(2) For the avoidance of doubt, the fee for registration paid in terms of section 4 shall be refunded to an unsuccessful applicant.
(3) Where the Ozone Office issues a license in terms of subsection (1), the license shall—
(a) be valid for a period of one year; and
(b) not be transferable to another person.
(4) Any person who contravenes subsection (3)(b) shall be guilty of an offence and liable to a fine not exceeding level eleven or imprisonment for a period not exceeding six months or both such fine and such imprisonment.
7(1) Subject to subsections (2) and (4), the Ozone Office may at any time suspend (for a period not exceeding sixty (60) days) or cancel any licence if the Ozone Office has reasonable grounds for believing that—
(a) the licence was issued in error or through fraud or misrepresentation or non-disclosure of a material fact by the licensee; or
(b) the licensee has contravened any provision of the Act or these regulations or any condition of his or her licence; or
(c) the licensee has ceased the licensed importation or exportation.
(2) The Ozone Office shall notify the licensee in writing of its intention to suspend or cancel his or her licence and the reasons for doing so, and shall call upon the licensee to show cause, within 14 days from the date of the notice, why the licence should not be suspended or cancelled, as the case may be:
Provided that if in the opinion of the Ozone Office the licence needs to be immediately suspended or cancelled in the public interest or to avert an environmental emergency he or she can issue the notice requiring the licensee to show cause after suspending or cancelling the licence. (3) If, at the expiry of the period specified in the notice given in terms of subsection (2), and after considering any representations made by the licensee, the Ozone Office is satisfied for any reason specified in subsection (1) that the licence concerned should be suspended or cancelled, the Ozone Office shall, by notice in writing to the licensee, suspend or cancel the licence or take such other action as it considers appropriate. (4) The penalty of suspension is only available where there has been a contravention of any provision of the Act or these regulations or any condition of a licence which, in the opinion of the Ozone Office, is a contravention that can be easily or speedily remediated by the licensee: Provided that —
(a) if after the expiry of the period of suspension the licensee has not taken the remedial action, the Ozone Office shall forthwith cancel the licence; or
(b) on good cause shown by the licensee, the Ozone Office may extend the suspension for a period not exceeding thirty (30) days to allow the licensee to take the required remedial action.
(5) The Ozone Office shall immediately make an appropriate entry in the register of licences where he or she suspends or lifts a suspension of any licence or cancels it in accordance with this section. Amendment and replacement of licences
8(1) The Ozone Office may at any time amend a licence or any terms or conditions of a licence—
(a) to correct any error in the licence ; or
(b) if the licensee requests the amendment; or
(c) if it considers the amendment necessary to reflect the true nature of the licensed activities; or
(d) if for any other reason it considers the amendment necessary or desirable in the interests of the environment or in the public interest.
(2) The Ozone Office shall notify the licensee in writing of its intention to amend a licence on a ground referred to in subsection (1)(a),(c) or (d) and shall call upon the licensee to show cause, within 14 days from the date of the notice, why the licence should not be amended.
(3)Where a licensee requests an amendment to his or her licence, he or she shall make an application to the Ozone Office therefore in Form AP2, together with the prescribed fee.
(4) If in the opinion of the Ozone Office the amendment sought by the licensee is a material amendment, section 6(2),(3),(4),(5) and(6) shall apply as if the application for the amendment is an application for a licence.
(5)Where a licence is lost or destroyed, the licensee may apply to the appropriate licensing authority in Form AP3, together with the prescribed fee, for a replacement licence: Provided that, if the licensee finds the lost licence he or she shall forthwith surrender it to the Ozone Office. 5
(6) Any person who contravenes the proviso to subsection (5) shall be guilty of an offence and liable to a fine not exceeding level three or imprisonment for a period not exceeding one month or both such fine and such imprisonment.
9 (1) The Ozone Office shall establish and maintain a register of licences to be known as the Import and Export Licensing Register, which shall be for the purposes of registering all licensed importers, exporters or consumers of ozone depleting substances, greenhouse gases, ozone depleting substance dependent equipment and greenhouse gas dependent equipment and in which the following shall be recorded—
(a) the name and address of every licensee and the addresses at which he or she operates from; and
(b) the date of issue of every licence and of any renewal thereof; and
(c) any special terms or conditions subject to which any licence is issued or renewed; and
(d) the particulars of any suspension or cancellation or amendment of a licence.
(2) Any person may—
(a) inspect the register of licences free of charge at all reasonable times at the premises of the Ozone Office or at such other place that the Ozone Office may direct; or
(b) obtain copies of or extracts from the register for a prescribed fee.
(3) The Ozone Office shall keep and maintain the register in both material and electronic form. (3) The Ozone Office through an officer tasked with the duty, shall be responsible, subject to any direction given to him or her by the Secretary for Environment, Water and Climate that all consignments are marked clearly, recording—
(a) the name, identity and quantity of imported or exported ozone depleting substances; and
(b) details concerning contact address, labels and the packaging; and
(c) any other particulars that may be required by the Ozone Office.
(3) All imported ozone depleting substances and ozone depleting substance dependent equipment shall be utilized before their phase out.
(4) The officer shall not allow the importation of a substance whose phase-out date has expired.

Description of the measure: 3 (1) Notwithstanding the provisions of any other law, but subject to the provisions of this section , no person shall-
(a) Import into or export from Zimbabwe any wild life, trophy or controlled goods except in accordance with the terms and conditions of –
(i) An open general permit; or
(ii) Permit;

2. The provisions of subsection (1) shall not apply to the import or export of –
(a) any wild life or trophy which was acquitted by the importer or exporter before the convention applied to it, if the importer or the exporter hold the certificate to that effect –
(i) in the case of import granted by an appropriate authority in the country from which the wild life or trophy concerned is being imported ; or
(i) in the case of an export, issued by the Director ; or
(b) any wildlife which was bred in captivity, ranched artificially propagated as the case may be, or any trophy of such wild life , if the importer or the exporter holds the certificate to that effect –
(i) in the case of an import , granted by an appropriate authority in the country in which the wild life concerned was bred or propagated :or
(ii)in the case of an export, issued by the Director,
Or
(c)herbarium specimens, other preserved, dried or embedded museum specimens , or plants material ,
Where-
(i)their import or export is effected by-
A. a museum which is a national museum for the purposes of the National Museum and Monuments Act [Chapter 313];
B. any other museum approved by the Director ; and
C. any scientist approved by the Director ; and
(ii) the specimens and material carry a label issued or approved by the Director

(3) No permit or certificate shall be required in terms of sub section (1) for the import or export of any wild life or trophy
(a) which a personal or household effect, save in the following cases-
(a) where a person who is ordinarily resident in Zimbabwe imports into Zimbabwe any wild life referred to in Part I of the Second Schedule , or any trophy of such wild life , which he acquired outside Zimbabwe ; or
(b) where a person who is ordinarily resident in Zimbabwe imports into Zimbabwe wild life referred to in Part II of the Second Schedule , or any trophy of such wild life, which he acquires outside Zimbabwe in the country where the wild life was removed from the wild , if that country requires the prior grant of an export permit before any export of such wild life or trophy ; or
c) where a person who is not ordinarily resident in Zimbabwe exports from Zimbabwe any wild life referred to in Part I of the Second Schedule or any trophy of such wild life which he acquires within Zimbabwe ; or
(d) where a person who is not ordinarily resident in Zimbabwe exports from Zimbabwe any wildlife referred to in Part II of the schedule which was removed from the wild within Zimbabwe, or any trophy of such of such wild life , if he acquired such wild life or trophy within Zimbabwe.

The rationale of the measure: These regulations shall apply to all medicines other than—
(a) those controlled in terms of the Dangerous Drugs Act [Chapter 15:02]; and
(b) psychotropic substances controlled in terms of the Medicines and Allied Substances
Control (General) Regulations, 1991; and
(c) medicines imported in terms of section 75 of the Act for a named person; and
(d) medicines imported by an individual for personal use.

Description of the measure: 4.(1) Subject to section 13, no person shall import into or export from Zimbabwe any
registered medicine otherwise than in accordance with the terms and conditions of a permit
issued by the Authority.

5.(1)(b) in the case of an application for an export permit, in Form I.E.3 and shall be
accompanied by the fee prescribed in the Second Schedule

5 (4) An application for the issue of an export permit shall state, for each medicine to be
exported—
(a) the name and address of the exporter; and
(b) the trade name or proprietary name of the medicine, if any; and
(c) the International Non-Proprietary Name (INN) or generic name of the medicine; and
(d) its strength; and
(e) the total quantity of the medicine; and
(f) the name and address of the manufacturer; and
(g) the Zimbabwean registration number; and
(h) the cost, insurance, freight (CIF) value of the consignment; and
(i) the port of entry

Description: These regulations apply to all medicines other than
(a)Psychotropic substances (Amphetamine, Dexamphetamine, Methamphetamine, Methylphenidate, Phencyclidine, Amobarbital, Cyclobarbital, Pentobarbital, Secobarbital, Amfepramone, Barbital, Ethinamate, Meprobamate, Methylphenobarbital, Phenobarbital, Pipradrol)

(b)Drugs controlled in terns of the Dangerous Drug Act ( coca leaves; “Indian hemp”, “bhang”, “camba”, “dagga”, “mbanje” or “intsangu”, resins obtained therefrom and all preparations of which such resins form the base; raw opium;1.Medicinal opium.
2. Any medicinal extract or tincture derived from the plant Cannabis sativa L. and any
preparation, not being a preparation capable of external use only, made from such
medicinal extract or tincture.
3. Morphine and its salts.
4. Cocaine (including synthetic cocaine) and ecgonine and their respective salts, and the
esters of ecgonine and their respective salts. (For the purposes of this Act, the expression
“ecgonine” means laevo-ecgonine and includes any derivatives of ecgonine from which it
may be recovered industrially.)
5. Any solution or dilution of morphine or cocaine or their salts in an inert substance,
whether liquid or solid, containing any proportion of morphine or cocaine, and any
preparation, admixture, extract or other substance (not being such a solution or dilution as
aforesaid) containing not less than one-fifth per centum of morphine or one-tenth per
centum of cocaine or of ecgonine.
6. Diacetylmorphine (commonly known as diamorphine or heroin) and the other esters of
morphine and their respective salts.
7. Dihydrohydroxycodeinone (also known as oxycodone);
Dihydrocodeinone (also known as hydrocodone);
Dihydromorphinone (also known as hydromorphone);
Acetyldihydrocodeinone;
Dihydromorphine;
their esters, and the salts of any of these substances and of their esters.
8. Morphine-N-oxide (commonly known as genomorphine) also the morphine-N-oxide
derivatives, and the other pentavalent nitrogen morphine derivatives. )

(c) Any medicines exempted from the operation of any or all of the provisions of the Medicines and Allied Substance Control Act
(d) The Regulations also excludes medicines imported by an individual for personal use.

Description of the measure: 3 (1) No person shall export any consignment of fruit, vegetables or flowers by air from Zimbabwe except:—
(b) in accordance with the terms and conditions of a permit issued by an inspector.
(2) An inspector may issue a permit authorising, subject to any terms and conditions as may be specified in the permit, the export of consignments of fruit, vegetables or flowers by air from Zimbabwe.

Description of the measure
3(1) Subject to section 12C of the Value Added Tax Act [Chapter 23:12], export tax relief shall be granted on unbeneficiated hides exported by a registered merchant listed in the Schedule.
(2) The registered merchant referred to in subsection (1) shall be issued with an export permit by the Minister responsible for Agriculture as approved by the Minister of Industry and Commerce.
4(1) The registered merchant who wishes to export unbeneficiated hides in terms of these regulations shall , upon confirmation of the evidence of a stockpile of unbeneficiated hides by the Minister responsible for Agriculture, apply for a permit in terms of these regulations.

Description of the measure: 3. (1) Subject to the provisions of subsection (2) , no person shall export from Zimbabwe except in accordance with the terms and conditions of a licence issued under section 4, any goods listed in the first schedule
(2) The provisions of sub section (1) shall not apply in relation to any goods which are in the course of transit through Zimbabwe to a place beyond the borders thereof
4. The Secretary may, subject to the provisions of this order and of any other law in force in Zimbabwe, issue a licence authorizing the export from Zimbabwe of any goods listed in the first Schedule on such terms and conditions as may be specified in or attached to that licence.
5(1) An application for the issue of a licence in terms of this order shall be made in writing , and shall be addressed to the Mining Commissioner
(2)Upon receipt of an application made in terms of subsection (1) the Mining Commissioner shall satisfy himself that the applicant has –(a) produced the goods to be exported from his own registered or tributed mining location; or
(b) otherwise lawfully acquired them ; and shall thereafter forwards the application to the Secretary , together with his report and recommendation thereof
6(1) The Secretary may , by notice n writing to a licence holder , revoke a licence issued by him in terms of section 4 if such licence-holder (a) has failed to comply with the provisions of this order ; or
(b) has failed to comply with the terms and conditions under which the licence was issued ; or
(c) has made any statement in his application for a license which is found to be inaccurate or misleading
(3) A license revoked in terms of subsection (1) shall be returned immediately by the holder thereof to the Secretary
7. A license issued under section 4 shall not be transferrable , and any purported transfer of such license shall be invalid
8. The provisions of this order shall not apply to the export of previous metals by the Reserve Bank of Zimbabwe

Description of the measure: 9 (1) Any person who wishes to export any pesticides out of Zimbabwe may apply for a permit to do so.
Provided tat the pesticides , are locally registered and bear the company name , registration number, pesticide name, and formulation source of pesticide, amount paid for pesticides and receipt number and expiry date for pesticides.
(2) An application for an export of pesticides permit shall be shall be made in writing to a registering officer in the Form P.5. prescribed in the First Schedule together with the payment of a prescribed fee: Provided that export of pesticides permit shall be valid thirty days from the date of issue per consignment.
(3) Any person who wishes to export any pesticides, in terms of subsection (1) , shall ensure that the products bear Zimbabwean labels.

Description of the measure: 12. No person who is not an authorized or licensed person shall supply to or procure for, or offer to supply to or procure for, any person including himself, or advertise for sale a Part IV drug or Part IV preparation.
13. (1) Subject to the provisions of subsection (2), no authorized or licensed person shall supply to or procure for any person a Part IV drug or Part IV preparation otherwise than in accordance with the provisions of this Part and, in the case of licensed person, otherwise than in accordance with the terms and conditions of his licence.
Applications for licences or permits
44. (1) An application for a licence under section 4 or 11 of the Act or for a licence or permit under these regulations shall be–
(a) made in the case of an application–
(ii) to export or move drugs, Form DD5;
which shall be obtained from the Secretary;
(b) accompanied, if the application is for a licence to export any drug from Zimbabwe, by the original copy of the certificate of the country of importation officially approving the import of that drug;
(c) accompanied by the appropriate fee, if any, prescribed in the Fifth Schedule.

Notes
1. The export of goods below $2 000 000 in value does not require approval under the principal regulations.

2. Approval granted under this Schedule does not exempt the exporter from the need to obtain approval or authority required under any other enactment.
Part 1: Temporary exports
1. Goods exported for repair and return or replacement.
2. Goods exported for testing, specialist examination or for the purposes of an exhibition or trade fair.
3. Machinery and equipment, including transport vehicles, exported for the purpose of hire or the performance of a contract.
4. Household effects being exported by a person leaving Zimbabwe for the purposes of education, sabbatical leave or the performance of a contract.
5. Animals exported for the purpose of exhibition at or competition in a show.
6. Empty containers owned by a Zimbabwean resident.
7. Trade samples, up to a value of $10 000.
1. Handicrafts such as sculptures, crochet work and woven items, where the application to export them is supported by
(a) an export order; and
(b) an invoice; and
(c) a duly completed Form CD1.
2. Wild life, where the application to export the wild life is supported by
(a) an export order; and
(b) an invoice; and
(c) any form required under the Control of Goods (Import and Export)
(Wild Life) Regulations, 1982 (Statutory Instrument 557 of 1982);
and
(d) a safari operator%s register, in the case of a trophy; and
(e) a veterinary certificate, where appropriate; and
(f) a duly completed Form CD 1.
3. Wild life products, where the application to export them is supported by
(a) an export order; and
(b) an invoice; and
(c) any form required under the Control of Goods (Import and Export)
(Wild Life) Regulations, 1982 (Statutory Instrument 557 of 1982);
and
(d) a duly completed Form CD1.
4. Pedigree livestock, other than horses, where the application to export the
livestock is supported by
(a) an export order; and
(b) an invoice; and
(c) a list of the animals concerned, specifying their breed and registered
number; and
(d) a duly completed Form CD 1 showing the value of each animal and
supported by a valuation certificate from a reputable valuer of
livestock; and
(e) written approval of the export from the Ministry of Agriculture; and
(f) a veterinary certificate.
5. Horses, where the application to export them is supported by
(a) a valuation of each horse by a veterinary surgeon; and
(b) a statement of #
(i) the reason for the export; and
(ii) the final destination of the horses, if they are to be sold; and
(iii) the latest date of the horses% return, if their export is temporary;
and
(iv) the date the exporter acquired the horses; and
(v) the age, the dam and the sire of each horse; and
(c) a brief indication of the training, if any, undergone by the horses; and
(d) a letter of support from the Horse Import/Export Advisory
Committee; and
(e) a duly completed Form CD 1.
6. Agricultural products and by-products, where the application to export them is
supported by an export order; and
an invoice; and
any permit required under the Control of Goods (Import and Export)
(Agriculture) Regulations 1965 (R.G.N. 656 of 1965); and
where appropriate, a phytosanitary certificate from the Ministry of
Agriculture; and
where appropriate, a fumigation certification confirming that the products
or by-products were fumigated prior to loading or dispatch; and
a duly completed Form CD 1.

Description of the measure: 3. (1) Subject to subsection (2), no person shall export from Zimbabwe, except in accordance with the terms and conditions of a permit issued under section 4, any goods listed in the Second Schedule.
(2) Subsection (1) shall not apply in relation to any goods which are in transit through Zimbabwe to a place beyond the borders thereof.
4. The Secretary may issue a permit authorising, subject to this order and any other law in force in Zimbabwe—
(b) the export from Zimbabwe of any goods listed in the Second Schedule; on such terms and conditions as may be specified in or attached to the permit.
5. An application for the issue of a permit under this order shall be made in writing and, subject to section 6, shall be addressed to the Secretary for Industry and International Trade, Private Bag 7708, Causeway, Zimbabwe.
6. Where a permit is required in accordance with this order and also in accordance with the Animal Health (Import) Regulations, 1989, published in Statutory Instrument 57 of 1989 (hereinafter called "Animal Health (Import) Regulations") to authorise the import into Zimbabwe of the same goods—
(a) an application for the issue of a permit in terms of this order shall be deemed to be an application for the issue of a permit in terms of the Animal Health (Import) Regulations;
(b) if the Secretary issues a permit, he or she shall thereupon forward the permit and the application to the appropriate person authorised to issue a permit in terms of the Animal Health (Import) Regulations to be dealt with by such person in accordance with such regulations unless—
(i) he or she is satisfied that the person authorised to issue a permit in terms of the Animal Health (Import) Regulations has already issued a permit which is in force; or
(ii) the applicant specifically requests otherwise;
(c) the Secretary shall not issue a permit under this order, if he or she is satisfied that the person authorised to issue a permit in terms of the Animal Health (Import) Regulations has already refused to issue a permit;
(d) if the Secretary issues a permit under this order after being furnished with a permit issued by the person authorised to issue a permit under the Animal Health (Import) Regulations which is in force, he or she shall thereupon forward both permits to the applicant.
7. (1) The Secretary may, by notice in writing to a permit holder, revoke a permit issued by him or her under section 4 if the permit holder has failed to comply with this order or if any statement made in the application for a permit is found to be inaccurate or misleading.
(2) A permit revoked in terms the subsection (1) shall be returned immediately by the holder thereof to the Secretary.
8. A permit issued under section 4 shall not be transferable and any purported transfer of such permit shall be invalid.
9. Nothing contained in this order or in any permit issued thereunder shall exempt the holder of such permit from complying with the provisions of the Grain Marketing Act [Chapter 18:14] or any other law in force in Zimbabwe controlling the import into or export from Zimbabwe of the goods to which such permit relates.
10. Any permit issued under section 6 of the Control of Goods (Agriculture) (Import and Export) (Agriculture) Order, 1974, published in Rhodesia Government Notice 216 of 1974, shall be deemed to have been issued by the Secretary under section 4 of this order.

Description of the measure: 3 (1) The Minister of Industry and International Trade may make orders prohibiting, restricting or otherwise controlling the import into or the export from Zimbabwe of any goods specified in the First Schedule or any class of such goods.
(2) Without derogation from the generality of the powers conferred by subsection (1), an order made under this section may—
(a) prescribe the terms and conditions subject to which controlled goods or any class of such goods may be imported into or exported from Zimbabwe;
(b) provide for empower such person as may be prescribed by the order—
(i) to issue permits authorising, to such extent as may be prescribed by the order, the import into or the export from Zimbabwe of any controlled goods or any class of such goods;
(ii) when issuing a permit in terms of sub-paragraph (i), to impose any terms and conditions, not inconsistent with the provisions of the order, subject to which any controlled goods specified in the permit may be imported or exported, as the case may be;
(iii) to revoke any such permit issued by him or her in such circumstances and in such manner as may be prescribed by the order.

Description of the measure: 72A. (1) Any person who wishes to
(a) import a psychotropic substance shall submit an application to the Director-General in Form M.C. 10A;
(b) export a psychotropic substance shall submit an application to the Director-General in Form M.C. 10B.
(2) Any person who imports or exports a psychotropic substance shall, for every import and export, as the case may be, whether such import or export consists of one or more substances, obtain a separate licence from the Authority for such importation or exportation.
(3) An import or export licence granted by the Authority shall state—
(a) the name and address of the importer or exporter, as the case may be;
(b) the international non-proprietary name of the psychotropic substance or if there is no such name, the appropriate name set out in Part I of the Eighth A Schedule;
(c) the quantity to be exported or imported;
(d) the pharmaceutical form;
(e) the period within which the import or export shall be effected;
(f) where the substance is imported or exported in the form of a preparation, the name of the preparation;
(4) An export licence shall state—
(a) the number and date of the import authorization; and
(b) the authority by whom it is issued.
(5) No export licence shall be granted in respect of a psychotropic substance by the Authority unless the exporter produces to the satisfaction of the Authority proof of an import authorization issued by a competent authority of the importing country confirming the approval of the proposed importation.
(6) A copy of the export licence shall accompany each consignment of a psychotropic substance, which is to be exported.
(7) Where any psychotropic substance is imported into Zimbabwe, the Director—General shall return authorization of the government of the exporting country and shall endorse on such authorization the amount of such substance, which has been actually imported.
(8) No psychotropic substance, which is in transit through Zimbabwe being exported from a destination outside Zimbabwe to another destination, shall be permitted to pass through Zimbabwe unless a copy of the export authorization is presented to and approved by the Director-General.
(9) Every consignment of a psychotropic substance whether imported or exported shall be accompanied by an export licence or similar authorization.
(10) Any consignment referred to in subsection (9) which is not accompanied by an export licence or similar authorization shall be detained by a customs officer until such licence or authorization is presented to and approved by the Director-General.
(11) No person shall mislabel any psychotropic substance intended for export.
(12) No psychotropic substance shall be imported or exported by ordinary or registered letter post.
(13) A licence granted by the Authority in term of subsection (1) shall –
(a) in the case of an import licence, be in Form M.C. 27;
(b) in the case of an export licence, be in Form M.C. 28.
