- 21.-{ 1) A person shall not import any fertilizer or fertilizer supplement in Tanzania unless-
(a) such fertilizer or fertilizer supplements is registered in terms of this Act;
(b) is of the composition and efficacy specified in the application for registration thereof;
.(c) possesses all chemical, physical and other properties so specified and complies with the requirements prescribed in respect thereof; and
(d) is packed in a sealed container which is marked or labeled in the prescribed manner with the prescribed particulars; .
28. A person shall not manufacture, import, export, sell, distribute any fertilizer or fertilizer supplements unless he is registered pursuant to this Act and conform to the standards prescribed in the regulations
(e) in the case of a fertilizer or fertilizer supplements containing bone or any other substance derived from the carcass of an animal, a permit referred to in section 20 has been issued in respect thereof.
(2) Without prejudice to the provisions of subsection (l) and (2), the Minister may, upon consultation with the Board and on such conditions as he may determine, in writing, permit the import of any consignment of any fertilizer or fertilizer supplements which does not comply with the requirements referred to in subsection (l)(a), (b) and (d).
(3) Fertilizers or fertilizer supplements imported shall-
(a) only be imported through a prescribed port or place;
(b) if the Director directs that a sample thereof be taken, not be removed from any such port or place without the written consent of the Director;
(c) if the Director thus directs, be made available for examination and the taking of a sample at any such port or place in the prescribed manner; and
(d) where a sample thereof has thus been taken, not be sold in Tanzania except on the written consent of the Director and subject to the conditions specified therein.
(4) The provisions of section 32 relating to samples shall, mutatis mutandis, apply with reference to a sample taken in terms of this section.
(5) Where any fertilizer or fertilizer supplement has been imported contrary to the provisions of this section, such fertilizer or fertilizer supplement shall-
(a) at the expense of such importer, be removed from Tanzania within such period as the Director may determine; or
(b) if such importer fails to remove such fertilizer or fertilizer supplement in terms of paragraph (c), be forfeited to the Government, arid be either destroyed or otherwise disposed of in the manner prescribed in the regulations.

- 9.Variety testing, release and registration.
(1)All imported and domestic varieties shall undergo testing in variety performance trials for at least two main growing seasons before their release.
(2)For imported varieties, data from advanced yield trials shall serve as supportive evidence regarding the performance of a variety.
(3)The certification service shall advise the breeder on the appropriate method and period of test for—
(a)agricultural value in an approved number of sites in their appropriate ecological zones;
(b)agricultural value for ratoons, forest and fruit trees, fibres, ornamentals, beverage crops and other plants and zones for which a system of evaluation is not practicable.
(4)The naming of new varieties shall be the responsibility of the relevant plant breeders and shall be subject to approval by the Variety Release Committee.
(5)The Board may grant breeders rights for a variety of seeds on the recommendation of the National Variety Release Committee.
(6)The certification service shall be responsible for undertaking variety testing as required for the granting of plant breeders rights in accordance with relevant law.
(7)All plant breeders, both local and foreign shall apply to the certification service for the release of their varieties.
(8)A variety released under subsection (7) shall be eligible for certification and shall be entered on the National Variety List and East African Common Catalogue.
(9)The maintenance and supply of breeders seed shall be the responsibility of the breeders concerned and a reference sample shall be deposited with the certification service on initial release.
(10)All plant breeders of public or private institutions and importers of varieties for seed production in Uganda shall be registered with the certification service on payment of the prescribed fee.
(11)The breeder or applicant shall provide data for advanced yield, multi-locational trials for at least one main growing season from relevant agro-ecological zones.
(12)The breeder or applicant shall conduct on farm trials for one main growing season concurrently with variety performance trials.
(13)The certification service shall be responsible for conducting variety performance trials in a number of representative locations, but may delegate suitable organisations to carry out this function.
(14)Vegetatively propagated materials shall be evaluated for their genetic and agricultural values.
10. Multiplication and licensing.
(1)Subject to the provisions of this Act, there shall be recognised classes of seeds as may be set out in regulations made under this Act.
(2)All seed merchants and dealers shall be licensed on application to the certification service and shall pay a prescribed annual fee.
(3)The Minister may, by statutory instrument, declare any area as a segregated area and may, by that instrument, prohibit the planting and movement of any type of seed or plant within that area either for a specific period or until the revocation of the instrument.
12.Seed marketing.
(1)All seed offered for sale shall be properly labelled and sealed in accordance with the specifications set out in regulations made under this Act.
(2)A person who intends to import or export seed shall apply to the certification service for a licence in the manner prescribed by regulations made under this Act.
(3) Only seed of approved varieties and which—
(a) meets the standards established by the National Seed Certification Services for domestic seed trade; and
(b) are accompanied by a declaration of minimum certification standards on an ISTA certificate or domestic certificates and a phytosanitary certificate as provided in the Plant Protection and Plant Health Act, shall be imported into Uganda.
(4)All seed intended for export shall comply with the requirements of the importing country.
(5)Genetically modified seeds will be regulated in accordance with the Uganda National Council of Science and Technology Act or any relevant law - Reference of the measure

- 4. Matters required to be registered.
(1) No agricultural chemical whether imported or manufactured in Uganda shall be used, stored, distributed or dealt in in Uganda by way of business unless it is duly registered in the register of agricultural chemicals and a certificate is issued in respect of it under these Regulations.
(2) No person shall manufacture, import, export, store, use, distribute or otherwise deal in any agricultural chemical by way of business unless he or she is duly registered in the register of fumigators and commercial applicators as a fumigator or a commercial applicator and is issued with a certificate in relation to the registration under these Regulations.
(3) No person—
(a) shall use any premises for the manufacturing, formulating, packaging, storing, or selling of any agricultural chemicals; or
(b) being the owner or occupier of any premises, shall permit the premises to be used for the manufacturing, storing or selling of any agricultural chemical,
unless the premises are registered for the purpose in the register of premises referred to in regulation 3 of these Regulations and a certificate of registration is issued in respect of the registration under these Regulations.
(4) For the avoidance of doubt, the requirement of registration of agricultural chemicals includes a requirement of registration of—
(a) a new product being introduced or manufactured in or outside Uganda for the first time, as a new common name and trade name;
(b) a product already existing in Uganda as a common name but which product is being reformulated; and
(c) a product already registered in Uganda under one type of formulation, where the formulation or its trade name changes
8. Application for registration of agricultural chemical.
(1) An application for registration of an agricultural chemical shall be made to the board in Form A in the First Schedule.
(2) The application shall be accompanied by—
(a) five copies of the label for the agricultural chemical or duly certified copies of it;
(b) samples of—
(i) the agricultural chemical for official testing, evaluation and screening;
(ii) the technical grade of the agricultural chemical’s active ingredients;
(iii) the laboratory standard of the agricultural chemical’s active ingredients;
(c) information regarding—
(i) the technical knowledge of the applicant;
(ii) a certified application dosage and prescribed usage of the agricultural chemical;
(iii) the expiry date or the shelf life and date of manufacture of the agricultural chemical;
(iv) Re entry and pre harvest intervals;
(v) the corrosive effects of the agricultural chemical;
(vi) antidotes and first-aid treatment recommended in case of accidental poisoning;
(vii) special protective clothing required in respect of the use of the agricultural chemical; and
(d) such other information or matter as the board may require.
(3) An applicant not resident in Uganda shall apply through an agent who is a permanent (or who is ordinarily) resident in Uganda
12. Refusal to register agricultural chemical.
The board may reject an application for registration of an agricultural chemical if in its opinion—
(a) the application for registration or the label for the chemical does not comply with the Act or these Regulations;
(b) the information provided to the board by the applicant is not sufficient to enable the agricultural chemical to be assessed,evaluated or screened;
(c) the applicant fails to establish that the agricultural chemical has merit or value for the purpose claimed when the chemical is used in accordance with its label directions; or
(d) the use of the agricultural chemical would lead to an unacceptable risk or harm to—
(i) things for which the agricultural chemical is intended to be used; or
(ii) public health, plants, animals or the environment
36. Suspension or cancellation of registration.
(1) Subject to the provisions of this Part, the board may suspend the registration of any agricultural chemical, fumigator, commercial applicator or premises under these Regulations and notify, in writing, the holder of the relevant certificate.
(2) Where a registration has been cancelled under this regulation, the holder of the certificate of registration in relation to the cancelled registration shall, unless an appeal is pending in respect of the cancellation or the cancellation is reversed on appeal, return the certificate immediately to the board.
(3) Where the registration of a fumigator or commercial applicator has been suspended or cancelled under this Part, he or she shall not apply again for registration subject to the reversal of the suspension or cancellation on appeal. - Reference of the measure

(1) Subject to subsection (3), it shall not be lawful for any person—
(a) who is not a citizen of Uganda to hold a buyers licence for the purposes of undertaking any of the business specified in section 3;
(b) who is a citizen of Uganda to trade, under a buyers licence issued to that citizen, on behalf of any person who is not a citizen of Uganda; or

- 3 (5) The Authority shall prior to issuing an import licence, ascertain that the facility from which the drugs to
be imported, are manufactured, complies with the internationally accepted Good Manufacturing Practice Guidelines adopted by the Authority.
4 (1) An application for a licence to import drugs shall be made using Form 23 in the Schedule to these Regulations and shall be accompanied by the licence of the licensed person and the prescribed fees.
(2) An application for a licence to import drugs shall be made by a licensed person.
5 (1) A person shall not import narcotic drugs or psychotropic substances without a permit issued by the Authority.
(2) The permit shall be in the format prescribed in Form 24 in the Schedule to these Regulations.
(3) An application for permit shall be made by a person issued with an import licence under regulation 3.
14(1) The drug imported for the purposes of donation shall be obtained from a source approved by the Authority.
21(4) The Authority shall prior to issuing an export licence, ascertain that the facility from which the drugs to be exported, are manufactured, complies with internationally accepted Good Manufacturing Practice Guidelines adopted by the Authority. - Reference of the measure
