importing exempted plastic bags unless he is registered as a manufacturer or an importer of
exempted plastic bags.

List of Exempted Plastic Bags:
Any plastic bag which is —
(a) a transparent roll-on bag solely used to contain fresh, chilled or frozen seafood, meat,
poultry, or offal other than canned food or eggs;
(b) a bag designed to be used for the disposal of waste;
(c) a bag designed for agricultural purposes;
(d) a bag used for the purpose of sampling or analysis;
(e) a bag that constitutes, or forms an integral part of, the packaging in which goods are
sealed prior to sale on the local market or for export;
(f) a transparent pocket type bag not exceeding 300 square centimetres in size;
(g) a transparent resealeable bag with security tamper used by a passenger to contain liquids,
aerosols or gels at an airport or on board of an aircraft or carried by a transfer passenger;
(h) a bag carried by a passenger disembarking from an aircraft or a ship for the purpose of
carrying personal belongings;
(i) a bag manufactured for export;
(j) a biodegradable plastic bag on which particulars are conspicuously displayed;
and
(k) a compostable plastic bag on which particulars are conspicuously displayed.

69D. Registration of manufacturer, assembler or importer
(1) Every manufacturer, assembler or importer of electrical and electronic equipment shall register with the Director-General, in such form and manner as the Director-General may determine.
(2) The information submitted on registration under subsection (1) shall be forwarded to the Director, Solid Waste Management Division.
(3) Any manufacturer, assembler or importer who fails to comply with subsection (1) shall be liable to pay to the Director-General a penalty of 50,000 rupees.

Description of the measure
132 (1) Goods imported for temporary use under section 117 of the Act shall apply to the following -

(a) Commercial travelers' samples;
(b) goods, including stage properties, imported for local exhibition or entertainment;
(c) goods imported solely for renovation or repair;
(d)touring promotional material which are not prohibited;
(e) any vehicles and goods of a kind described in regulations 135, 136 and137;
(f) any vehicle described in regulation 136; and
(g) any other goods the Commissioner may allow, subject to conditions he or she may impose.
(2) For the purpose of this regulation, a “commercial traveler” means any person who satisfies a proper officer that he or she is soliciting orders for merchandise on behalf of a business entity established outside the Community. Commercial travelers' samples and goods imported for use.
135. (1) Where any person who is usually resident outside the Community intends to make a temporary stay in a Partner State, imports -
(a)any road vehicle, including trailers, or cycle, and their accessories, for his or her use during the visit; or
(b)any goods intended for his or her use, convenience or comfort while in a Partner State but not for consumption; or correspond in all particulars with the description in the form, and that they will be exported forthwith, the amount deposited shall be repaid to the importer who shall acknowledge receipt to the proper officer.

136. (1) Where a person who is a resident in the COMESA or SADC or where there exists a bilateral or other agreement between a Partner State and any neighbouring country regarding any matter or field of activity, the implementation of which involves or includes the regular transfer to and from or between the countries of goods and person by motor vehicles or trailers for industrial, commercial or other purposes, the provisions of regulation 135 (2) shall not, subject to sub-regulation (2) of this regulation, apply to such motor vehicles or trailers.
(2) Where any person who is usually resident outside the Community intends to engage in any business involving the transfer of goods or persons into the Community by motor vehicle or trailer for industrial, commercial or other purposes, he or she shall make an application to the Commissioner for the temporary importation of a motor vehicle or trailer using Form C 32.
(3) The Commissioner may grant temporary importation of a motor vehicle or trailer on such conditions as he or she may impose, for a period not exceeding three months: Provided that the Commissioner may, allow where heor she deems fit, a further period as is consistent with the purpose for which the motor vehicle or trailer was imported. Vehicles from one Partner State to another
137. (1) Where a person who is resident in the Community intends to use his or her motor vehicle in another Partner State, he or she shall be allowed to use the motor vehicle without the production of temporary importation documents (Carnet de Passage en Douane,pass sheet, or other similar documents) and without the making of a deposit as required by regulation 135 for a period not exceeding three months or such further period as the Commissioner may allow
(2) A person who intends to use his or motor vehicle under sub regulation (1) shall make application in Form C32
133. (1) A person who intends to import any goods of a kind described in regulation 132(1) (a), (b), (c) and (d) shall apply to a proper officer using Form C 17.
(2) An application in sub-regulation (1) shall state-
(a)the full particulars of the goods imported, specifying the nature of the goods for the purpose of identification; and
(b)the approximate date on which and the port at which the goods will be re-exported.
(3) Where the goods are to be re-exported at a port other than the port of importation, the application shall be made in triplicate.
(4) Where the proper officer so requires, invoices or other documentary evidence of value shall be produced and attached to the application and retained by the officer.
(5) An importer shall deposit an amount of cash sufficient to cover the duty on the goods, or shall execute a security bond in the Customs Bond Form as the proper officer may determine.
(6) A proper officer shall, on application by an owner, state the amount of duty chargeable and the amount of deposit made or of the security bond executed.
(7) A proper officer shall return the duplicate copy referred to in sub-regulation (3) of the application and shall retain and send the triplicate copy where the goods are to be re-exported at a port other than the port of importation, to the proper officer at the port at which the goods will be exported.
(8) Before the deposit referred to in sub-regulation (5) is refunded or the security bond cancelled, the following conditions shall be observed-
(a)the goods shall be re-exported within a period of twelve months from the date of importation; and
(b)the owner shall give due notice to the proper officer at the port of exportation of his or her intention to re-export the goods and shall deliver to the proper officer the duplicate copy of the application issued to him or her at the port of importation.

(g) any other goods the Commissioner may allow, subject to conditions he or she may impose.

Description of the measure: 11.-(1)Fishing vessels shall be classified for licensing purposes in classes enumerated in part (a) of the Third Schedule of these Regulations and fees payable for such licences shall be those stated in part (a) of the Third Schedule against each class and upon payment of the said fee and subject to compliance with the provisions of the Act and of these Regulations licensing authorities may issue licences which shall be in the appropriate Form 4 prescribed in the First Schedule of these Regulations.
(2) Any fishing vessel brought into the country whether owned by citizen or non-citizen shall be registered under these Regulations and have licences under non-citizen conditions until such a time the vessel has been properly imported into the country and registered under the Merchant shipping Act No. 43 of 1967.
Exemption:This part of Regulation shall not apply to Government or public corporation owned vessels.
(3) No person shall use for fishing purposes any vessel of a class specified in part (a) of the Third Schedule of these Regulations, unless has a valid licence in respect of such vessel issued in accordance with these Regulations.
(4) No person shall employ cause or permit any other person to use a vessel which such first mentioned person is prohibited from using by the provisions of paragraph (3) of the Regulation.
(5) Application for fishing vessel licences shall be made in the appropriate Form 3 prescribed
in the First Schedule of these Regulations.
(6) Licences permitting the use of the a vessel for fishing purposes shall be in the appropriate Form 4 prescribed in the First Schedule of these Regulations

Procedure for registration of a pesticide
9. Every application for pesticide registration or renewal of registration shall be on a form specified in Schedule I to these Regulations and shall unless otherwise advised, be accompanied by: -
(a)a dossier containing additional information to determine the suitability of the pesticides as to its use and including technical data sheet and direction on how to detect and quantitative the active ingredient:
(b)the appropriate application fee;
(c)a representative sample of the pesticide, certificate or analysis, if already issued and a written declaration that the pesticide has or has not been banned or restricted in the country of origin.
Submission and analysis of samples
10. – (1) A sample submitted for analysis for the purposes of registration shall be accompanied by appropriate standards.
(2) A sample submitted for analysis shall not be ... than 0.5 kilogram in case of solids, or not less than 0.5. liters in case of liquids.
(3) The container in which a sample for analysis is packed shall be sealed and adequately labeled.
(4) Every sample submitted or analysis shall be accompanied with the specifications of the sample and other relevant information
11. – (1) Every pesticide submitted for registration shall be submitted for testing by the Registrar or by a person authorized by him, and the Registrar or the authorized person as the case may be shall carry out such field and/or laboratory tests as are necessary to determine the suitability for use of the pesticide.
(2) Where the testing is carried out by a person other than the Registrar, that person shall submit, as soon as the test is completed the results of the test of the pestcide
12. The Person applying for registration of a pesticide shall satisfy the Registrar that-
(a) the premises for the storage of the pesticide are adequate and well equipped with proper storage accommodation for avoiding any hazards and for preserving the properties of the pesticide in respect of which a registration certificate is sought;
(b)there will be a person or persons on the technical staff of the person applying who is or are qualified or experienced in handling the pesticide
13. – (1) If the Registrar as satisfied that a person applying for registration of a pesticide has complied with the provisions of the Act and these Regulations he may register the pesticide.
(2) On registration the person applying for registration of a pesticide shall pay such fees as are provided under these Regulations.
(3) The Registrar may refuse to register a pesticide if he is not satisfied in terms of sub-paragraph (1).
(4) An appeal from a decision of the Registrar refusing to register a pesticide under sub-Regulation (1) shall lie to the Minister and the Minister’s decision shall be final.
(5) Every appeal under sub-Regulation (4) shall be made within sixty days from the date of the decision of the Registrar.
14. – (1) If the Registrar approves registration be shall issue a certificate of registration in a form prescribed in Schedule VI in respect of the pesticide whose registration is sought.
(2) Every certificate for registration shall expire after five years.
15. _ (1) Where by reason of non-compliance with any provisions of these Regulations or any direction given by him the Registrar is unable to register a pesticide but is satisfied that steps can be taken with diligence by the applicant to comply with such provision or direction, as the case may, he may in his absolute direction, by notice in writing (hereinafter referred to as a notice of determent), defer registration of that pesticide pending compliance with such provision or direction.
(2) The Registrar shall transmit the notice of deferment to the person who applies for registration of the pesticide.
(3) A notice of determent shall, subject to the provisions of this Regulation and any condition specified in that notice, entitle the person applying for the registration of a pesticide to use or dispose for use by the public the pesticide.
(4) Every provisional registration shall expire after two years.
16. – (1) Where a pesticide is highly toxic persistent, biologically cumulative or where that pesticide may cause poisoning of which no effective antedate is know and available the Registrar may register that pesticide subject to such conditions and restrictions as to its use or the quantity to be disposed of and other conditions that he may deem necessary.
(2) Every registration of pesticide for restricted use shall expire after two years.
28. – (1) Upon the coming into operation of these Regulations any person engaged in the business of import or manufacture or sale of any pesticide, whereby that pesticide is not registered, shall within three months apply to the Registrar for registration of that pesticide.
(2) Where an application is made items of sub-Regulation (1) of this Regulation the Registrar may grant provisional registration in respect of the pesticide and the application of Regulation 15 shall apply mutates mutandis in respect of that pesticide

15.-(I) An application for the registration of a producer, importer, exporter, transporter, storage and dealing in chemicals shall be submitted to the Registrar in the prescribed manner and form, as set out in the Fourth Schedule.
