F61: Custom inspection, processing and servicing fees
FEES AND PENALTIES
12. – (1) An importer or his agent shall have the duty to pay fees to the Bureau.
(2) The fees charged under sub-regulation (1) shall include:
(a) a non-refundable application fee payable upon filling the application forms;
(b) transport, board and lodging costs of the Bureau's inspectors during the inspection and sampling of the shipment;
(c) testing fees which include all expenses pertaining to testing of samples by the Bureau or any other accredited
laboratory as clearly recalled in the schedule of fees available from the Bureau; and
(d) batch certificate fee or fees equivalent to 0.2 percent of the Cost and Freight (“C” and “F”) value which covers guarantee costs as well as random market surveillance samples after release of the consignment to the market.
7. -(1) No imported food shall be removed out of the customs area before it is inspected or examined as the case may be and certified as fit for human consumption in writing by the inspector.
(2) Before its arrival or soon after, the food importer or captain of the vessel or his agents shall give the inspector a copy of food cargo manifest stating the kind and amount of food packaging unit used and the name of country of origin.
(3) Any importer of food shall ensure that the imported food is labelled in Kiswahili or English or both
(4) Any other language may be used in labelling of food provided that language is used together with Kiswahili or English or both.
(5) Each imported food consignment shall be accompanied by a health certificate issued by a competent authority in the country of origin acceptable to the authority showing-
(a) That the food is fit for human consumption at the time of exportation; and
(b) that it meets the standards prescribed for it by the food control authority of the country of origin stating such standards.
Taking of samples
8-(1) any inspector who has procured or taken a sample of imported food shall as soon as he receives the results of the analysis inform the customs officer of his decision regarding the facts of the imported food and both the inspector and customs officer, where necessary work in co-operation to effect the decision, that is to release or order for re-exportation of the food to the country of origin or dispose off as the case may be as soon as reasonably possible.
(2) Cost of re-exportation or disposal of food found unfit for human consumption or inspection at port of entry shall be borne by the importer of that food.
Certification of food exports
9-(1) When deemed necessary or upon request from an exporter of food or importing country, the authority shall issue a health certificate to accompany food exports.
(2) The authority shall issue health certificate if it is satisfied that-
(a) The food has been registered and manufactured under licence issued by it or the food consignment has been inspected and found in compliance with specifications prescribed by it;
( b) the food does not contravene any provisions of the Tanzania food drugs and cosmetics act,2013 or registered made there under.
(3) The authority may withdraw, cancel or suspend any heath certificate issued by it if it is discovered that false information was given in obtaining the health certificate.
10. A person who seeks or obtain services rendered under these regulations shall be charged fees as provided for under the fees and charges regulations made under this Act.
E: Protection of the environment and G: Protection of national security
Description of the measure
41. (1) Where a surveyor carries out a survey or inspection to determine whether the provisions of Annex II to MARPOL 1973/78 have been complied with, a charge of US$ 30 per cargo tank surveyed or inspected is payable.
(2) If a certificate of inspection is required, an additional charge of US$ 30 shall be payable.
46. (1) Subject to sub-regulations (2) and (3), where a seaman is engaged or discharged before a proper officer in terms of section 113(1) or (4) of the Merchant Shipping Act, No. 21 of 2003, a charge of US$ 3 shall be payable by the master or owner of the ship from which the seaman is engaged or discharged.
(2) Where the engagement or discharge of a seaman is effected on board ship at a port in the United Republic, the charge payable in terms of subparagraph (1) is subject to an additional charge of US$ 20 for each visit that the proper officer is required to make to the ship in order to complete such discharge.
(3) Where the engagement or discharge of a seaman is effected on board ship at a port outside the United Republic at the request of the master or owner of the ship, the proper officer's travel and subsistence expenses shall be payable in addition to the applicable charges on normal working hours and US$ 30 outside the Authority’s normal working hours
7.-(1) Any person who intends to release a variety shall be required to submit to the Tanzania Official Seed Certification Institute an application for DUS test and NPT, on Form SR III A and SR IIIB respectively, as set out in the FifthS chedule to these Regulations.
(2) An application for DUS test shall be made one season prior to the application for NPT and shall be supported by the following:-
(a)sufficient seed sample for the first season DUS test;
(b)variety description;
(c)application fees and DUS testing fees as set out in the Sixth Schedule to these Regulations; and
(d) on farm trial and farmers assessment data.
(3) Upon receiving the application and materials, TOSCI shall conduct a DUS test,repot the results to the
applicant and issue the DUS test certificate for the qualified application on Form SR IV as set out in the Fifth Schedule to these Regulations.
(4) The application for NPT test shall be supported with the following:-
(a)a minimum of two recent previous seasons advanced yield trial data from not less than three recognized testing sites in Tanzania or any other country which is in agreement for harmonization of seeds policy and legislations with Tanzania,as set out in the Seventh Schedule to these Regulations;
(b)sufficient seed sample for conducting NPT and second DUS test;
(c) fees for the NPT and second DUS test; and
(d) any other additional information that may be required for determination of the merits of the candidate variety.
(5) TOSCI shall conduct NPT for a minimum of one season in at least three sites as set out in the Seventh Schedule to these Regulations, and shall conduct second DUS test and submit the report to NPT-TC for review.
(6) TOSCIshall develop procedures and conditions for conducting DUS test and NPT for perennial crops.
(7)Upon completion of review of the NPT report, NPT-TC Secretary shall report the results to thapplicant and present the NPT data and the recommendations of the NPT-TC to the NVRC on Form SR Vas set out in the Fifth Schedule to these Regulations.
(8) The National Variety Release Committee shall review the recommendations of the NPT-TC and advise the National Seed Committee.
(9) In order for a candidate variety to be recommended for release to the National Seeds Committee, a breeder shall be required to submit to TOSCI an authentic sample of pre-basic seed for reference purpose.
(10) The amount of authentic sample referred to in sub-regulation (9) shall be:-
(a)four kilograms for cereals, pulses or any other big seed crops; or
(b)one hundred grams for small seed crops species
(11) TOSCI shall have discretion to determine the amount of authentic sample needed for plant species other than those referred under sub-regulation (10).
(12) A breeder shall be required to replenish the authentic sample as it may be required by TOSCI.
Consultative services
50. (1) Where a person requests a consultative service, the charge prescribed for that service shall be payable.
(2) If the service requested is not fully specified in this determination, a charge of US$ 30 per surveyor-hour or part thereof shall be payable.
(3) Where an officer is requested to interpret any requirement applicable to a particular class or category of ship, a charge of US$ 30 per surveyor-hour or part thereof shall be payable.
Exemption Certificate.
51 A charge of US$ 200 shall be payable when an exemption Certificate is granted to a ship under and in accordance with the provisions of the SOLAS 1974.
Fees and Expenses of the receive of wrecks.
52. The receiver of wrecks shall be reimbursed the expenses incurred by him in performing his duties
54. Copies of documents Where a person requests a copy of a document belonging to the Authority for commercial
purposes, a charge of US$ 20 shall be payable.
76A In respect of any imported goods that are of a kind or class subject to excise duties in terms of section seventy-six there shall, in addition to such other duties imposed by this Act or any other written law, be charged, levied collected and paid excise duties at the rates specified in the excise tariff.
76B There shall be charged, levied, collected, and paid in respect of services rendered, imported into or provided within Zambia excise duties at the rates specified in the services excise tariff set out in the Eighth Schedule, in this Act referred to as the services excise tariff.(Acts No. 4 of 1999 and No.3 of 2004)
105 (4) A customs officer shall detain the wild animal, trophy or prescribed trophy to which subsection (3) applies and the cost incurred in connection with the detention and storage of the wild animal, trophy or prescribed trophy shall be borne by the importer or exporter, as the case may be, and be recoverable from the importer or exporter as a civil debt to the Government.

(d) medicines imported by an individual for personal use.

(b)Drugs controlled in terns of the Dangerous Drug Act ( coca leaves; “Indian hemp”, “bhang”, “camba”, “dagga”, “mbanje” or “intsangu”, resins obtained therefrom and all preparations of which such resins form the base; raw opium;1.Medicinal opium.
2. Any medicinal extract or tincture derived from the plant Cannabis sativa L. and any
preparation, not being a preparation capable of external use only, made from such
medicinal extract or tincture.
3. Morphine and its salts.
4. Cocaine (including synthetic cocaine) and ecgonine and their respective salts, and the
esters of ecgonine and their respective salts. (For the purposes of this Act, the expression
“ecgonine” means laevo-ecgonine and includes any derivatives of ecgonine from which it
may be recovered industrially.)
5. Any solution or dilution of morphine or cocaine or their salts in an inert substance,
whether liquid or solid, containing any proportion of morphine or cocaine, and any
preparation, admixture, extract or other substance (not being such a solution or dilution as
aforesaid) containing not less than one-fifth per centum of morphine or one-tenth per
centum of cocaine or of ecgonine.
6. Diacetylmorphine (commonly known as diamorphine or heroin) and the other esters of
morphine and their respective salts.
7. Dihydrohydroxycodeinone (also known as oxycodone);
Dihydrocodeinone (also known as hydrocodone);
Dihydromorphinone (also known as hydromorphone);
Acetyldihydrocodeinone;

(a)Psychotropic substances (Amphetamine, Dexamphetamine, Methamphetamine, Methylphenidate, Phencyclidine, Amobarbital, Cyclobarbital, Pentobarbital, Secobarbital, Amfepramone, Barbital, Ethinamate, Meprobamate, Methylphenobarbital, Phenobarbital, Pipradrol)
(b)Drugs controlled in terns of the Dangerous Drug Act ( coca leaves; “Indian hemp”, “bhang”, “camba”, “dagga”, “mbanje” or “intsangu”, resins obtained therefrom and all preparations of which such resins form the base; raw opium;1.Medicinal opium.
2. Any medicinal extract or tincture derived from the plant Cannabis sativa L. and any
preparation, not being a preparation capable of external use only, made from such
medicinal extract or tincture.
3. Morphine and its salts.
4. Cocaine (including synthetic cocaine) and ecgonine and their respective salts, and the
esters of ecgonine and their respective salts. (For the purposes of this Act, the expression
“ecgonine” means laevo-ecgonine and includes any derivatives of ecgonine from which it
may be recovered industrially.)
5. Any solution or dilution of morphine or cocaine or their salts in an inert substance,
whether liquid or solid, containing any proportion of morphine or cocaine, and any
preparation, admixture, extract or other substance (not being such a solution or dilution as
aforesaid) containing not less than one-fifth per centum of morphine or one-tenth per
centum of cocaine or of ecgonine.
6. Diacetylmorphine (commonly known as diamorphine or heroin) and the other esters of
morphine and their respective salts.
7. Dihydrohydroxycodeinone (also known as oxycodone);
Dihydrocodeinone (also known as hydrocodone);
Dihydromorphinone (also known as hydromorphone);
Acetyldihydrocodeinone;
Dihydromorphine;
their esters, and the salts of any of these substances and of their esters.
8. Morphine-N-oxide (commonly known as genomorphine) also the morphine-N-oxide
derivatives, and the other pentavalent nitrogen morphine derivatives. )
(c) Any medicines exempted from the operation of any or all of the provisions of the Medicines and Allied Substance Control Act
(d) The Regulations also excludes medicines imported by an individual for personal use.

(2) Any person who wishes to import or export a substance listed in the Second Schedule shall submit an application to the Director-General in Form P.C.S 1 and such application shall be accompanied by the appropriate fee prescribed in the Schedule.
6. Any person who is issued with an import permit in terms of section 3 shall, on the importation of such substance pay a consignment verification fee prescribed in the Third Schedule. 3

2. Section 3 of the Medicines and Allied Substances Control (Import and Export of Medicines) Regulations, 2008. published in Statutory Instrument 57 of 2008 (hereinafter referred to as the "principal regulations"). is repealed and the following section is substituted-
"3. These regulations shall apply to all medication other than -
(c) medicines imported in terms of section 75 of the Act for a named person:
Provided that -
(i) the consignment clearance fee shall be payable in terms of section 10; and
(ii) medicines shall be imported through the ports of entry referred to in Section 13"

3(1) An application for the registration of a farm feed shall be made by -
(a) submission of a sample; and
(b) completing form F.F.1 specified in the First Schedule in triplicate and submitting it to the registering officer; and
(c ) accompanied by the container and a reproduction of any label or inscription on the container in which the feed will be sold.
(2) Renewing of registration is made by sample submission and undergoing the same process as in subsection (1) and is done annually.
7 (2). All importers of farm feeds shall ensure that-
(a) they comply with the requirements of section 3 of these regulations; and
(b) compulsory pre-shipment inspection, at the expense of the applicant , is conducted ; and
(c) they submit through inspectors, samples to the laboratory for analysis; and
(d) they make all necessary declaration of growth promoters, antibiotics, enzymes and GMO status before import permit is is issued; and
(e) compulsory mycotoxin analysis is conducted prior to registration ; and
(f) they incorporate Zimbabwean registration number, name and physical address of the local distributor, and details of the manufacturer on the label.

43. A charge of US$ 115 per day, or US$ 10 per hour if it is not a full day, and the officer's travel and subsistence expense shall be payable for the attendance of a representing officer.
