73. (3) A person may not import, export, re-export or introduce from the sea of a specimen of a listed
threatened or protected species through a port of exit or entry other than the following-
(a) land ports-
(i) Beit Bridge border post;
(ii) Golela border post
(iii) Jeppes Reef border post;
(iv) Lebombo border post;
(v) Maseru border post;
(vi) NaKop border post;
(vii) Ramatlabama border post;
(viii) Vioolsdrift border post; or
(b) airports and harbours-
(i) Cape Town International Airport;
(ii) O.R. Tambo International Airport;
(iii) King Shaka International Airport;
(iv) Port Elizabeth International Airport;
(v) Kruger Mpumalanga International Airport;
(vi) Cape Town Harbour;
(vii) Durban Harbour; or
(viii) Port Elizabeth Harbour.
73 (4) Notwithstanding the provision of subregulation (3), a person may not import, export or re-export a
rhinoceros horn hunting trophy through a port of entry or exit other than O.R. Tambo International
Airport.
25(3) A transporter or importer who illegally traffics hazardous waste shall transport the hazardous waste back to the country of export at the transporter’s or importer’s expense.
20 (3) Where the relabelling or reconditioning of an article referred to in subsection (1) is not carried out within ninety days of its importation, the article shall be exported by the importer within a further period of thirty days or other period that the Minister may determine and, where it is not so exported, it shall be forfeited and disposed of as the Committee may direct.
25 (3)A transporter or importer who illegally traffics hazardous waste shall transport the hazardous waste back to the country of export at the transporter’s or importer’s expense.
(4)The Agency shall, where the reexport of illegally trafficked hazardous waste is not practicable, direct the method of disposal for the hazardous waste and the exporter, importer and transporter shall meet the cost of the disposal.
14. (1) A person shall not re-export any specimen of species listed in Column I and Column II of the First Schedule without the prior grant and presentation of a re-export certificate.
36. (1) An enforcement officer may, where any specimen is imported contrary to these Regulations—
(a) re-export the specimen
37.(3) An enforcement officer shall, where an invasive alien species or feral is introduced into Zambia contrary to these Regulations—
(b) re-export the species within seven days of the introduction at the cost of the importer;

3. Imposition of duty
Subject to section 6, export duty shall be payable on all bonemeal, bloodmeal and carcassmeal exported from Botswana at the rates set out in the Schedule.
Samples and temporary exports
6. Nothing in sections 3 and 5 shall apply in respect of any consignment of bonemeal, bloodmeal or carcassmeal-
(a) which does not exceed 2,5 kilograms in weight and is exported from Botswana as a bona fide sample; or
(b) which is temporarily exported from Botswana in transit to some place within Botswana.

3. Levy on cattle exported
(1) Upon every head of cattle exported from Botswana, there shall be paid to the
Botswana Government, such a levy as may be prescribed.
2) Upon every head of cattle slaughtered by it, there shall be paid a levy by—
(a) the Botswana Meat Commission;
(b) a municipal abattoir;
(c) a private abattoir; and
(d) a butchery, to the Botswana Government, at the same rate as the levy imposed under subsection (1)
5. Penalty
(1) Any person who exports or attempts to export any cattle from Botswana without having first paid the levy imposed by this Act commits an offence and shall be liable to a fine not exceeding P300 or to imprisonment for a term not exceeding two months, or to both, in respect of each head of cattle exported or attempted to be exported.

4. Export duty to be paid
(1) Export duty shall be payable on all calf-skins, hides or skins exported from Botswana at the rates set out in the Schedule.
(2) Such duty shall be paid by the person applying for an export permit under section 3, to the District Commissioner, or other official to whom application for the permit is made, before the permit is issued.
(3) The President may from time to time by order published in the Gazette make such alterations to any of the rates set out in the Schedule as he may deem necessary to maintain
the export duty payable in respect of the calf-skins, hides or skins, as the case may be, to which that rate relates, at or approximating to eight percent of the average export selling price thereof.

(3) No person shall deal in minerals unless he has been registered as a dealer and has been issued with a mineral dealers licence by the Commissioner: Provided that a person holding a valid mining title who has declared as provided by this Act that he is in production and is disposing of the type of mineral for which he is licensed to mine shall not be required to obtain a mineral dealers licence.
(4) A person who has been issued with a mineral dealers licence shall maintain a proper register of the kind, quantity and quality of minerals dealt in, bought, sold, bartered, exported, cut or polished, the manner by which it was obtained or disposed of; and the dealer shall make the register available for inspection by the Commissioner or any person authorised by him in writing.
(5) A mineral dealers licence issued under this section shall expire on the 31st December in the year of issue.
(6) The fees for a mineral dealers licence shall be prescribed by the Minister by notice in the
Gazette
.(6A) Any person who possesses or deals in any mineral without a mineral without a mineral dealer’s licence shall be guilty of an offence and liable to a fine not exceeding twenty thousand shillings or to imprisonment for a term not exceeding two years or to both; and the minerals in respect of which the offence was committed shall be forfeited to the Government.
(7) For the purposes of this section, “to deal in minerals”includes to buy, sell, barter deposit or receive as a pledge or security, export, cut or polish any miners which are subject to this Act.

19. Cess to be paid before export
(1) No sisal fibre shall be exported unless the amount due thereon in respect of any cess levied under this Part has been paid.
(3) An application shall be accompanied by the payment of a registration fee of one hundred thousand shillings where the applicant wants to export or import mill white sugar or industrial sugar.

4(5) Where the competent authority grants the application, it may issue a registration certificate to the applicant on payment of the appropriate registration fee specified in the First Schedule and on such terms and conditions as it may determine.
6. (1) A registered person shall apply for an export health certificate to the competent authority in such form as it may determine.
(3) (a) Where a registered person complies with the standards applicable in the importing country, the competent authority may, on payment of the appropriate fee specified in the First Schedule, issue to the registered person the appropriate export health certificate referred to in the Fourth Schedule.

15. Tobacco not to be manufactured or exported unless cess paid
(1) Any person who sells any tobacco and does not immediately upon completion of the sale pay any amount due for cess in respect of such tobacco shall be guilty of an offence.
(2) Any person who exports any tobacco in respect of which the cess has not been paid shall be guilty of an offence.
