- 104. (1) Goods in transit to a foreign port shall be entered at the port of importation using Form C. 17.
(2) An owner of the goods in transit shall at the time of entering the goods produce documents relating to the goods to a proper officer
(3) An owner of goods to be entered for transit shall furnish a bond using the Customs Bond Form. or any other security in such amounts as the Commissioner may require.
(10) A vehicle shall not be used in the transportation of goods in transit unless the vehicle is licensed by the Commissioner using Form.C. 38 or by a competent authority in the COMESA or SADC Member States and approved by the Commissioner using Form. C29.
105. (1) Goods reported for transhipment shall be entered using Form C. 17 and a bond in respect of the goods shall be executed using the Customs Bond Form.
(2) Goods which are not reported for transhipment and are unloaded, may be entered for transhipment in accordance with the provisions of this regulation where –
(a)they have not been entered under the Act; or
(b)the master or agent applies for and obtains the permission of a proper officer to amend the inward report of the importing aircraft or vessel.
(3) Goods reported for transhipment shall be entered and reshipped within twenty-one days after the commencement of the discharge of the importing aircraft or vessel or within such further period as a proper officer may allow.
106. Goods entered for transhipment may, with the permission of a proper officer and subject to any conditions he or she may impose,be transhipped direct from an importing aircraft, vessel or vehicle to the exporting aircraft, vessel or vehicle, if the goods are reported by the importing aircraft or vessel or vehicle for transhipment.
(11) A licence for a vehicle to convey goods in transit issued by the Commissioner shall be recognized in all other Partner States for the purpose for which the licence was issued.
119(1) where goods are imported through a registered courier, the Commissioner may, in his or her discretion, accept the Customs declaration on the form provided by the courier in the country of origin, for the purpose of assessing the duty on the goods, in lieu of the entry required under the provisions of the Customs laws.
(2) Where goods are exported through a registered courier, a declaration from the sender regarding the description of the contents of the package and the value of the goods shall be affixed to the courier article and shall be deemed to be the entry required under the Act.
(3) Sub-regulations (1) and (2) shall not apply to goods where an individual package exceeds seventy kilograms or a value of one thousand dollars.
(4) A licensed courier shall present all the imported goods to a proper officer for examination and assessment of duty. Customs declaration on courier articles.
124. Where cargo is loaded in an aircraft or vessel for carriage coastwise to more than one port or place, separate transires shall be prepared for each port or place.
125. (1) Coastwise cargo shall not be loaded on an aircraft or vessel for carriage coastwise or removed from a Customs area or a transit shed after it is unloaded or landed, without the prior permission of a proper officer.
(2) Any person who contravenes this regulation commits an offence.
126. Where a master of a coasting aircraft or vessel intends to proceed to a
sufferance wharf to load or unload coastwise cargo, he or she shall apply to a proper officer for permission using Form. C. 10.
128. Except with the written permission of a proper officer, coastwise cargo or goods for transfer shall not be loaded on or unloaded from a vessel of less than two hundred and fifty tons register, until the master delivers to a proper officer the transire relating to the cargo to be loaded or unloaded. - Reference of the measure

(a)lent, sold, pledged, hired, given away, exchanged or otherwise disposed of without the prior permission of the Commissioner; or

- 19.-(1) Every licensee shall furnish to the licensing authority such records pertaining to fish, species of fish products captured, killed, processed, preserved, packed,bought,sold,imported,exported,or otherwise acquired or disposed off as the Director of Fisheries may by general or special order direct.
(2) Every licensee shall submit to the licensing authority such periodic returns as the Director of Fisheries may by general or special order direct.
32. Every foreign fishing vessel that enters the territorial waters shall fly its national flag and ensure that its registration mark is clearly visible, and it shall clear its decks of fishing gear which shall be stowed in such manner as to preclude its use.
33. No person being on board a Tanzania fishing vessel shall bring in to the. Territorial waters any fish or fish products received outside such waters from a foreign vessel, unless he is authorized to do so by provisions of the Act or regulations made thereunder.
34. At any place where fishing for any type of fish is prohibited under these Regulations, no
Person shall have in his possession any fish or such type of fish the fishing of which is thereof, without lawful excuse, the proof of which shall be upon him.
35. No person shall set or use seine nets, gill nets or other fishing gear in such place or manner as to obstruct navigation.

- 27. A grower, trader, processor, exporter, importer and ginner shall maintain quality of cotton at all levels of production, processing and marketing as provided in these Regulations.
50-(1) A person registered under these Regulations shall maintain books and records of cotton dealing and shall, using the prescribed forms under the Fifth Schedule, submit to the Board accurate and proper reports of-
(a)in the case of a licensed buyer and processor, the amount of cotton purchased or processed by him for every week, month or year within a cotton season;
(b)in the case of a licensed exporter, cotton purchased and exported, within each month of the cotton season;
(c)in the case of a licensed importer, a monthly return of cotton imported and sold locally.
(d)In the case of textile spinning mill, a monthly report of lint purchased.
(2) Any information under Sub regulation (1) shall be availed to cotton inspectors upon request.

(1) Subject to the provisions of subsections (2) of this section, bureau shall, by notice published in the Gazette, declare any mark which has been approved by the Bureau for any commodities or the manufacturing, production, processing or treatment of any commodities, to be a standard mark in respect of it and may, in like manner, cancel or, amend that mark.
(2) The notice shall contain information with regard to the relevant standard or its amendment which the Bureau may considers necessary.
(3) Notwithstanding the existence of any other standard, the standards declared by the Bureau shall prevail over any other existing standards.
13. (1) A person who intends to use a standard mark in connection with any commodities shall make application to the bureau in such manner as may be described in the Regulations.

- 13. (1) A person who intends to use a standard mark in connection with any commodities shall make application to the bureau in such manner as may be
described in the Regulations.
(2) The Bureau may, if satisfied that the commodities conform to a standard, grant a licence to the applicant to use a standard mark upon such terms and conditions, as may be described in the Regulations.
(3) A person who:-
(a)Applies a standard mark to any receptacle or cover of any commodities or to any label attached to any commodities or any receptacle or its cover; or
(b)Places or encloses any commodities in a receptacle or cover to which a
Standards mark has been applied or in a receptacle or cover to which is attached a label to which that mark has been applied, Shall, for the purposes of subsection (2) of this section be deemed to have applied that standard mark to that commodities.
(4) The issuance of licence under subsection (2) of this section shall be in the discretion of the Bureau and license may be issued subject to conditions to be specified in it and subject to the payment of any fees which may be prescribed by the Board in the Regulations.
(5) The Bureau may as its discretion revoke or suspend any license issued under this section or vary any condition attached to any license.
(6) Any person who is contravenes the provisions of subsection (2) of this section or any other conditions specified in a licence issued to him commits an offence.
14. (1) Any person who is aggrieved by:-
(a)The refusal of the Bureau to issue a licence; or
(b)Any condition attached to a licence; or
(c)The variation, cancellation or suspension of any licence, May within fourteen days of the notification of act complained of being received by him, appeal in writing to the Minister who shall, within thirty days, either confirm, set aside or
vary the decision complained.
(2) Any person who is dissatisfied by the decision of the Minister may refer the matter to the High court of Zanzibar.
15. (1) Every person to whom a license has been issued under this Act shall furnish within a period which may be specified the samples of any commodities to which the license relates and all such information with regards to such commodities or its manufacturing, production, processing or treatment as may be specified in the request.
(2) Every person to whom a license has been issued to offer a calibration service shall be required to submit such samples of any commodities to the Bureau for calibration against the national measurement standard of this equipment or instrument.
(3) Every person who has been licensed to undertake a scientific or industrial measurement or use of such measurement equipment shall submit, from time to time, the equipment to the Bureau for calibration or recalibration against the Nation Measurement Standard or National Standard.
(4) Any person who contravenes any of the provisions of this section commits an offence.
16. (1) A standard which is intended primarily to:-
(a)Protect the consumer or user against danger to health or safety;
(b)Protect public or industrial health, welfare or safety;
(c)Protect the environment;
(d)Ensure acceptable quality in products imported for domestic use or re-export;
(e)Ensure acceptable quality in products imported for domestic use or re –export;
(f)Ensure acceptable quality in any case where there is restriction in choice of source of supply;
(g)Require adequate information to be given to the consumer or user;
(h)Prevent fraud or misrepresentation arising from misleading advertising
or labeling, Shall, on the recommendation of the Bureau, be declared by order of the Minister to be compulsory standard.
(2) Minister shall publish in Gazette give at least compulsory standard and
Shall there by indicate the date on which it is intended that the compulsory
Standard and shall come into effect and having regard to paragraphs (a) to (h)
of subsection (1) of this section, the order shall state the purposes for which the standard is intended.
.(3) Whenever the Minister has declared a standard to be a compulsory standard a person shall not sell a commodity unless it complies with that standard or has been manufactured, produced or treated in accordance with the standard.
17. The Minister may upon recommendation of the Bureau and subject to the provisions of this Act, by notice published in the Gazette declare any standard, specification, code of practice prescribed by the Bureau, person shall not carry on business or perform any function under a name which contain the word “standard”.
18. (1) Except with consent of the bureau, a person shall not carry on business or perform any function under a name which contain the word “Standard”.

- 27.-(1) Plant protection substances and plant resistance improvers shall be used only in accordance with good professional practice.
(2)The Minister shall issue or cause to be issued a Code of Conduct for the proper use of plant protection substance, plant resistance improvers and equipment, which shall include, but not limited to, the following-
(a) measures to minimise or discourage the use of plant protection substances, plant resistance improvers and equipment, and other measures which do not attach priority to biological, biotechnological, plant breeding, cultivation and cropping measures,
(b) discouraging or prohibiting the use of plant protection substances, plant resistance improvers and equipment in cases where it is expected that their use will have harmful effects on health of man, animals, ground water or the natural environment;
(c) compulsory requirements to the users of plant protection substances, plant resistance improvers and equipment to observes directions for use;
(d) requirements to any person who applies plant protection substance, plant resistance improvers and equipment within the framework of this Act or instructs or supervises persons who apply the plant protection substances, plant resistance improver and equipment, to have necessary degree of reliability and possess necessary specialist knowledge and skills and to ensure that, the use of plant protection substances and equipment does not result in any avoidable harmful effects on the health of man, animals and the natural environment;
(e) requirements to a person using plant protection substance or plant resistance improvers to furnish proof that he possesses such specialist knowledge and skills for use of the plant protection substance as he is required;
(f) Prohibition. of the marketing of the plant protection substances or plant resistance improvers in retails trade by means of vending machines or other forms of self service;
(g) prohibition of retail selling of plant protection substances, plant resistance improvers and equipment, wholly or in part, if certain facts justify the assumption that the trader or person selling plant protection substances and equipment for him does not possess specialist knowledge necessary for properly informing the purchaser about the use of the plant protection substances, plant resistance improvers and equipment and the risk involved;
(h) requirements to traders or persons selling the plant protection substances, plant resistance improvers and equipment on their behalf to furnish proof that they possess the necessary specialist knowledge;
(i) prohibition of all kinds of handling of plant protection substances, plant resistance improver and equipment by minors, people of unsound mind and people in any other proven state or condition, who when handling plant protection substances, plant resistance improver and equipment, may be predisposed to harmful effects;

- 3. For the purpose of section 8(1) (b) of the Act, Value added tax on goods imported for permanent and temporary into mainland Tanzania shall be treated in the manner described under the East Africa Community Customs management Act
4 (1) an Importer of capital goods may apply to the commissioner General to defer payment of tax due in respect of imported capital goods.
(2) An application for deferment of value added tax shall be in form ITX247.02E as prescribed in the schedule and shall incorporate a declaration by the applicant that goods are for use in the business of the applicant.
5. Subject to Section II of the Act, the commissioner Genera shall not approve an application for deferment of value added tax in respect if each unit of capital goods is twenty million shillings or above.
6. The commissioner Genera may at any time during the period of deferment, inspect the capital goods in respect of which the value added tax was deferred to ascertain whether its duly installed or utilized for the purpose specified in the application.
7 (1) The period of deferment of value added tax shall be ten years from the date of importation
(2) Notwithstanding the provisions of any written law, the period of record keeping in respect of importation of capital goods in which tax is deferred shall be ten years.
8.The deferred tax on imported capital goods shall be treated as output tax and input tax of an importer, and shall be accounted for the same value added tax return of the tax period in which the capital goods are imported
9.Where the period of deferred lapses, the value added tax deferred on capital goods shall not become payable - Reference of the measure

- 30.-(1) A person shall not sell or distribute an adulterated or sub- standard fertilizer or fertilizer supplements.
(2) A fertilizer or fertilizer supplements shall be deemed to be adulterated if-
(a) it contains any deleterious or harmful substance in an amount that renders injurious to plant life, animals, humans, aquatic life, soil, air, water or environment in general when applied in accordance with directions for use provided for in the Regulations;
(b) adequate warning statements or directions for use which may be necessary to protect plant life, animals, humans, aquatic life, soil, air, water or environment in general are not shown on the label or shipping bills and certificate of analysis, as the case may be;
(c) its composition falls below or differs from that which is purported to possess by its labeling or shipping bills and certificate of analysis as the case may be ; or
(d) it contains foreign material other than fertilizer or fertilizer supplement.
(3) Any fertilizer whose standard does not conform to the requirement of this Act shall be seized and disposed of at the cost of the fertilizer dealer in accordance with procedures prescribed in the Regulations made under this Act or other written law. - Reference of the measure

- 47.-(1) The Authority, after considering the application made to it and being satisfied that the conditions set in these Regulations are met, and upon payment of a fee as prescribed in the Fees and Charges Regulations in force, shall issue an import or export permit.
52. (2) Subject to other conditions set in these Regulations, importation of free samples shall meet the following criteria: (b) the quantity of the commercial pack shall not exceed 300 unit packs per single consignment.
53.-(1) Subject to other conditions set in these Regulations, application for importation of free of charge medical devices shall be accompanied by the profoma invoice indicating the unit price of each product.
(2) Without prejudice to other conditions set in these Regulations, all free of charge medical devices shall be charged Free on Board as per Fees and Charge.
